25 What to do after someone dies

Scope: money. This section only covers how to get the procedures done and how to collect the money. That includes what to do first right after the person dies, and which fees have a list you can check. It also covers which money sitting in which accounts can be taken back, and which matters close relatives have the right to handle in person. The first 5 items follow the order in which things happen: the scene, the death certificate, the body and cremation, what to do if you disagree with the cause of death, and canceling the hukou (户口 — household registration). Arrangements an older person should make while still alive, such as intended guardianship (意定监护 — a guardian named by agreement in advance), a will, and accounts, are in Section 17. The 3 benefits for a work-related death are in Section 19.

The funeral part follows the new Funeral Management Regulations, in force from March 30, 2026. How the funeral allowance and the survivor allowance under the pension are calculated is in item 9 (housing provident fund balance and social insurance benefits).

Items in this section (12)
  1. 25.1 If someone dies at home or outside, first tell a natural death from an unnatural one: for an accident, an unknown cause, or a death found only after the person lived alone, call the police at once and do not move the body or the scene
  2. 25.2 The death certificate is the key to everything that follows: whoever provided treatment issues it; for natural deaths at home, contact the local community health service center. It must be issued within one day
  3. 25.3 Transport, storage, and cremation of remains must be handled by funeral homes; hospital morgues cannot provide such services, and storage is generally limited to 3 days
  4. 25.4 Disagreement over cause of death: request an autopsy within 48 hours and have medical records sealed
  5. 25.5 Legal deadlines for canceling hukou registration for the deceased: in cities, before burial; in rural areas, within one month
  6. 25.6 Funeral services are divided into basic and non-basic categories; a list of basic services exists, with their fees set by law
  7. 25.7 If you encounter forced bundling, extra charges beyond the listed price, or a single service being split into multiple line items for billing, make a note of it and file a complaint
  8. 25.8 Funeral agents, buyers of funeral goods, and planners and hosts must register with the county-level civil affairs bureau
  9. 25.9 Collect the money held in different places, one place at a time: the housing provident fund balance, social insurance benefits, and work-injury benefits
  10. 25.10 Close relatives can ask to access, copy, correct, and delete the deceased's account and personal information
  11. 25.11 Repay debts a relative left only with the estate you inherit; if you do not want the debt, renounce the inheritance in writing before the estate is divided
  12. 25.12 After a family member dies, do not start the inheritance at a notary by default: withdraw a deposit of 50,000 yuan or less at one bank directly from the bank, and handle a house at the real-estate registration office with all the heirs together

25.1 If someone dies at home or outside, first tell a natural death from an unnatural one: for an accident, an unknown cause, or a death found only after the person lived alone, call the police at once and do not move the body or the scene

Value: HighEvidence A
In plain terms

For a death by accident, a death nobody can explain, or a death found only after a long time living alone, if there was no treatment at a hospital, the police issue the death certificate. If the scene has been moved, what happened cannot be explained, and the certificate is hard to get. Without that piece of paper, cremation, canceling the hukou (户口 — household registration), and the insurance claim all get stuck. If you cannot tell which kind of death it is, call 110 first. After the police finish checking, they still issue the certificate.

Cost

It costs nothing. 1 phone call is enough.

Benefit

Article 8, paragraph 2 of the Regulations on Household Registration: "Where a citizen dies in an accident or the cause of death is unknown, the head of the household or the person who discovers it shall immediately report to the local police station or the people's committee of the township or town." That means: if there was an accident, or nobody knows how the person died, the head of the household and the person who found them must report at once to the police station or the township or town government. Article 23 of the Funeral Management Regulations: "Where a natural person dies a natural death, the medical institution shall issue a death certificate promptly. For a deceased person in an unnatural-death case handled by the public security organs according to law, who was not treated by a medical institution, the public security organs issue the death certificate." That means: a natural death from illness is certified by the medical institution that treated him. A death with no hospital treatment, which the police are handling, is certified by the police. If the scene has been disturbed, you can neither explain it nor get the certificate easily. Cremation, canceling the hukou, and the insurance claim all wait on this one piece of paper.

Notes

A death after a long illness, or dying at home at the end of life, counts as a natural death. You can ask the institution that treated him while he was alive to issue the certificate, or the community health service center or township health center for the area where he lived. Who issues the death certificate, the one that provided the treatment, is in item 2 (death certificate). If you cannot tell which kind it is, treat it as unnatural and call 110 first. After the police arrive and finish the investigation, they can still issue the certificate. If you tidy the scene before calling the police, no one can help you. Do not move the body yourself, wash him, or change his clothes, and do not take away medicine bottles or notes.

If the person died in a hospital, get the death certificate from the place that handled the treatment. For a natural death at home, get it from the community health service for that area, or from the township health center. When the death is natural and the cause is clear, it is issued within one day. Canceling the hukou (户口 — household registration), cremation, withdrawing the housing provident fund, collecting social insurance benefits, an insurance claim, and handling the inheritance all use it. As soon as you have it, make several copies.

Cost

No cost at all.

Benefit

According to the “Interim Regulations on Registration and Management of Population Death Information,” death certificates for patients who die in medical institutions are issued by those institutions; for deaths occurring at home or elsewhere, they are issued by the local community health service center or township health clinic. Cases deemed non-natural by police or judicial authorities are handled by those authorities under current rules and procedures. In 2026, five government agencies confirmed that electronic death certificates carry the same legal weight as paper versions; both are equally valid. Certificates for natural deaths with known causes must be issued within one day. If lost, a single replacement can be requested from the original issuer. If basic information is wrong, you can apply with supporting documents for one re-issue.

Notes

This certificate is indispensable for deregistration, cremation, housing provident fund withdrawals, social insurance benefits, insurance claims, and estate settlement — so make plenty of copies right away. If electronic issuance is available, request it as well. Only one replacement is permitted, so keep the original safe. Any mistakes in name or ID number should be corrected on the spot; otherwise you’ll have to repeat the process at every office later on.

Transport, storage, embalming, cosmetic preparation, and cremation can only be done by a funeral home. A hospital morgue does not handle the funeral. At most, it lets the body stay there for a short while. A funeral home generally keeps the body for no more than 3 days. If you need more days, you have to apply for an extension. Cremation takes a death certificate and a cremation confirmation document. The cremation certificate they give you afterward is still needed for the inheritance and for an insurance claim.

Cost

No cost involved.

Benefit

Article 25 of the Funeral Management Regulations states: “Services such as transport, storage, embalming, body preparation, and cremation must be provided exclusively by funeral homes.” No other entities are permitted to offer these services. Article 24 adds: “Morgues operated by medical institutions may not subcontract or provide funeral services; they may only offer temporary storage for remains.” Hospital morgues are thus restricted to short-term storage only. Article 27 specifies: “Funeral homes generally store remains for no more than 3 days; where a longer stay is needed, the family or the party handing over the body shall go through the extension procedure at the funeral home.” Article 28 requires cremation to be performed only upon presentation of a death certificate and cremation confirmation document, after which a cremation certificate is issued. Article 29 further mandates that in regions where cremation is mandatory, remains must be cremated at a nearby funeral home.

Notes

The “one-stop” people who approach you after a death in hospital are mostly not funeral-home staff. Transport itself is a standard service with fixed pricing; see item 6 (list of basic services) for details. Keep the cremation certificate safe — it is required for inheritance, insurance, and moving the ashes. Whether cremation or burial is mandated locally is determined by provincial authorities. Article 9 safeguards the funeral customs of ethnic minorities. Where burial is carried out although cremation is required, or a body is buried or a grave built outside cemeteries and ecological burial zones, the civil affairs bureau orders correction within a time limit.

25.4 Disagreement over cause of death: request an autopsy within 48 hours and have medical records sealed

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Big
  • Measured in Money
Value: HighEvidence A
In plain terms

If you doubt the cause of death, the autopsy has to be done within 48 hours after the person dies. If the hospital can freeze the body, that can be extended to 7 days. The autopsy needs a close relative's signed consent. If they do not consent, or the time is missed, the responsibility for a cause of death that cannot be sorted out falls on that side. When you ask for the autopsy, also ask to have the medical records sealed. Once the body is cremated, an autopsy can no longer be done.

Cost

No cost involved. The hard part is remembering to make this request at such a time.

Benefit

The time limit for autopsies is stipulated in Article 26 of the Regulations on Prevention and Handling of Medical Disputes. The original text reads: “In cases where a patient dies and both the patient and medical institution dispute the cause of death, an autopsy must be performed within 48 hours after death; if the hospital has facilities to freeze the body, this period may be extended to 7 days.” In other words, to determine the true cause of death, an autopsy must be carried out within 48 hours of death, or up to 7 days if the hospital has freezing capabilities. The same article further states: “An autopsy must be approved and signed off by the deceased’s close relatives; failure to sign is regarded as refusal of consent.” If family members do not sign, it is interpreted as a refusal. It also specifies: “If consent is denied or the deadline is missed, leading to uncertainty over the cause of death, the party that refused or delayed bears the responsibility.” Article 24 states that sealing and unsealing of medical records “must be conducted in the presence of both the patient and medical institution.” Both you and the hospital must be present during both the sealing and later unsealing of records.

Notes

After this deadline passes, any later claims of “I always suspected something was wrong” will instead place liability on the party responsible for the delay. Once a body is cremated, no autopsy can ever be performed. Therefore, this decision must be made before contacting any funeral home. Details on how to seal medical records can be found in Section 24.

25.5 Legal deadlines for canceling hukou registration for the deceased: in cities, before burial; in rural areas, within one month

  • Money No cost
  • Time Minutes
  • Willpower None
  • Benefit Small
  • Measured in Time
Value: OrdinaryEvidence A
In plain terms

In cities, you must cancel hukou registration before burial; in rural areas, you must do it within one month. Bring the death certificate and household register to the police station to complete the process. Failing to do so will block any inheritance transfers, benefit claims, or insurance cancellations due to the unresolved hukou status.

Cost

No expense involved. Just bring the death certificate and household register to your local police station.

Benefit

Article 8, Paragraph 1 of the Hukou Registration Regulations states: “When a citizen dies, in cities the household head, relatives, caregivers, or neighbors must report the death to the hukou registration authority and cancel the hukou registration before burial; in rural areas, this must be done within one month. If a citizen dies while temporarily residing elsewhere, the local hukou registration authority must notify the permanent residence’s authority to cancel the registration.” In short, urban residents must act before burial, while rural residents have one month to do so. Any household head, relative, caregiver, or neighbor may initiate the process at the police station, which serves as the hukou registration authority. If the deceased was living temporarily elsewhere, the local police station there must inform the permanent residence’s station to cancel the hukou registration.

Notes

Leaving the hukou registration active will prevent any inheritance transfers, benefit claims, or insurance cancellations, as all these procedures rely on a cleared hukou status. If pension payments continue despite the death, they constitute fraudulent collection and must eventually be repaid. While at the police station, also ask how social insurance and yibao benefits are stopped, as well as how to apply for funeral subsidies. Details on these financial matters are covered in Item 9 (housing provident fund balances and related social insurance benefits).

25.6 Funeral services are divided into basic and non-basic categories; a list of basic services exists, with their fees set by law

  • Benefit Medium
  • Measured in Money
Value: HighEvidence A
In plain terms

Collecting the body, storing it, the farewell, cremation, keeping the ashes, and ecological burial are all on the national list of basic items. Burial of ashes in a niche provided by a public body is on that list too. The prices of these items are set by the rules. Other services must also be put on the list, and no one may invent an extra item and charge for it. Before you set out, first ask which items count as basic and what the local standard is, then talk about the rest.

Cost

It costs nothing. Spend a few minutes looking at the list before you set out.

Benefit

Collecting the body, storing the body, the farewell to the body, cremation of the body, keeping the ashes, and ecological burial are all on the national list of basic items. Burial of ashes in a niche provided by a government-run funeral service body is also on the list. The fees for these items are set by law and by the rules, and the funeral home does not decide them itself. The list of non-basic items is set by the civil affairs department at the level of a city divided into districts or above (the civil affairs department of a prefecture-level city or higher).

Notes

A province, autonomous region, or directly governed municipality may add items on top of the national list. First ask which items count as basic and what the local fee standard is, then talk about the rest. The price of a basic item is set by the rules. For items outside the basic list you choose for yourself, but check them against the list and the fee standard as well. Once you can tell the two kinds apart, you have something to say about any part you were overcharged. There is nothing wrong with wanting to give a relative a dignified farewell. This does not urge you to keep it plain, and you decide where the money goes.

25.7 If you encounter forced bundling, extra charges beyond the listed price, or a single service being split into multiple line items for billing, make a note of it and file a complaint

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Medium
  • Measured in Money
Value: OrdinaryEvidence A
In plain terms

The price violations the regulations name are: not posting a price list, adding money on top of the marked price, bundling funeral goods and forcing you to buy them, and forcing you to accept another provider's paid service. Splitting one item into several charges also counts as a disguised price rise. On the spot, ask for the price list first, and keep the proof of the charges and the chat records. Complaining afterward is still in time. For the price, go to the market supervision administration. For funeral services, go to the civil affairs bureau.

Cost

No cost involved. The real challenge is staying diligent in the moment.

Benefit

Regulations identify five categories of price violations. Four of them are: not displaying prices clearly or adding extra charges beyond the listed price — that is, no posted price list or charging more than advertised; bundling services or imposing unreasonable conditions to force a purchase — meaning you can’t obtain a service unless you buy another one; forcing or indirectly forcing you to use paid third-party services — essentially pushing another provider’s services on you; and indirectly raising prices by re-labeling charges — such as charging more under a different name. Additionally, it is prohibited to “split services into multiple items or expand the scope of charges to indirectly raise prices.” This means breaking one service into several line items for billing or extending the range of charges beyond what was originally stated.

Notes

Price-violation investigations fall under the market regulation authority; funeral services themselves are under the civil affairs bureau. Ask for a price list right away, and be sure to keep all receipts, invoices, and chat records. Filing a complaint later is still possible.

25.8 Funeral agents, buyers of funeral goods, and planners and hosts must register with the county-level civil affairs bureau

  • Money No cost
  • Time Minutes
  • Willpower None
  • Benefit Medium
  • Measured in Money
Value: HighEvidence A
In plain terms

Funeral agents, buyers of funeral goods, planners and hosts, and information consultants have to register with the county-level civil affairs bureau. Those that are not registered are not in the funeral-service information system run by the civil affairs bureau. Whether you can look this up yourself differs from place to place. The surest way is to call the county-level civil affairs bureau and ask. Those who overcharge by trickery, or who resell information about the deceased, will be dealt with according to law.

Cost

It costs nothing. Ask whether they are registered.

Benefit

An intermediary that is not registered is not in the funeral-service information system run by the civil affairs bureau. Those who charge in violation of the rules by deception, push a family into a large showy funeral, force people to accept a service, or resell information about the deceased will be dealt with according to law. They are also marked in the system and made public, and anyone can see it.

Notes

Online tomb-sweeping platforms are regulated the same way. Article 45 of the regulations does not allow them to induce spending, and does not allow them to handle the deceased's information unlawfully.

25.9 Collect the money held in different places, one place at a time: the housing provident fund balance, social insurance benefits, and work-injury benefits

  • Money No cost
  • Time Hours
  • Willpower None
  • Benefit Big
  • Measured in Money
Value: HighEvidence A
In plain terms

Heirs can withdraw the housing provident fund (公积金 — mandatory housing savings) balance. It is not in a bank account, so it is easy to miss. Money left in the individual account of the basic pension can also be inherited. If a person covered by the enterprise employees' pension dies of illness, the family also receives a funeral allowance and a survivor allowance for 3 to 24 months. If the death was caused by work, there are 3 more work-injury payments.

Cost

It costs nothing, but you have to go to several windows. Before you go, get the death certificate and proof of kinship ready.

Benefit

The balance of the housing provident fund account (the money still left in his provident-fund account) can be withdrawn by heirs and by legatees. A legatee is the person named in a will to receive something. If the death was caused by work, there are 3 more payments: a funeral allowance, a dependents' pension, and a one-time work-death benefit. Money left in the individual account of the basic pension can be inherited; the Social Insurance Law says so in writing. If a person covered by the employees' pension dies of illness, or dies from a cause that is not work, the family can also receive a funeral allowance and a survivor allowance, together called survivor benefits. The standard for enterprise employees is calculated on a nationwide formula. The funeral allowance is 2 times the previous year's monthly per capita disposable income of urban residents in that province. The survivor allowance uses that same monthly per capita income as the base, and is paid for 3 to 24 months according to the years of contributions. Under 5 years, 3 months are paid. For 5 to 10 years, 6 months are paid. For 10 to 15 years, 9 months are paid. For 15 years or more, each extra 1 year adds 1 month, up to 24 months. If the person had already retired, each 1 year of pension already received subtracts 1 month, and the minimum is 9 months.

Notes

The provident-fund sum is the one most often forgotten, because it is not in a bank account and it does not go into the division of the estate on its own. Money left in the individual pension account and the survivor benefits are calculated separately and paid separately. Handle them together at the social insurance window where he was insured. The documents each place asks for are different. If contributions were under 5 years, the survivor benefits together do not exceed the money he himself paid in. This formula comes from the rules for the enterprise employees' pension. For survivor benefits under the pension for government bodies and public institutions, and under the urban and rural residents' pension, ask at the window. If the funeral expenses and the survivor allowance were paid into his bank account, how to withdraw them is in item 12 (withdraw the deposit directly at the bank). The formal requirements for a will and for inheritance are in Section 17. If you plan to renounce the inheritance to stay clear of the debt, do not withdraw this money first. See item 11 (a written statement renouncing the inheritance).

25.10 Close relatives can ask to access, copy, correct, and delete the deceased's account and personal information

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Medium
  • Measured in Freedom
Value: OrdinaryEvidence A
In plain terms

After the person has died, close relatives, for their own lawful and proper interests, can ask the platform to access, copy, correct, or delete the deceased's personal information. If the platform refuses, it has to give a reason. You can also sue in court. There is one exception. If he made other arrangements while alive, for example by naming someone to inherit an account or by leaving a clear wish, follow his arrangements.

Cost

It costs nothing. Only if the platform will not cooperate do you need to complain or to sue.

Benefit

The law states it in so many words: when a natural person has died, close relatives, for their own lawful and proper interests, may exercise the rights to access, copy, correct, delete, and otherwise deal with the deceased's relevant personal information. Close relatives can ask the platform to bring his information out to be looked at, to make 1 copy, to correct an error, and to delete it. Article 50 requires the platform to set up a convenient mechanism for accepting and handling applications. "If it refuses a person's request to exercise a right, it shall state the reasons." If the platform refuses, "the individual may bring a lawsuit in a people's court according to law."

Notes

The article includes the sentence "except where the deceased made other arrangements while alive." If he set an account heir while alive, or left a clear wish, follow what he left. So while he is still clear-headed, it is worth writing down where the accounts and the passwords are to go. See Section 17. 25.11 Repay debts a relative left only with the estate you inherit; if you do not want the debt, renounce the inheritance in writing before the estate is divided

  • Money No cost
  • Time Minutes
  • Willpower None
  • Benefit Big
  • Measured in Money
Value: Very highEvidence A
In plain terms

When a person dies, the debts they owed do not disappear with them. But heirs such as the children and the spouse repay only with the share of the estate they inherited. They do not pay the shortfall out of their own pocket. If you do not want to take on this debt, write a statement renouncing the inheritance before the estate is divided, and you give up the estate as well. If you say nothing, that counts as accepting the inheritance.

Cost

A written statement costs nothing. The real price is that the house, the deposits, and the rest of the estate are given up along with it. If you accept the inheritance, a creditor may sue you. You have to answer the suit, and you have to produce materials showing what the estate is worth.

Benefit

Article 1161 of the Civil Code: "An heir clears the taxes and debts the decedent legally owed, limited to the actual value of the estate obtained. This limit does not cover any part beyond the actual value of the estate that the heir repays voluntarily." That means: for the taxes and debts he owed, you pay only with the share of the estate you inherited. You do not pay the part beyond that, unless you yourself are willing to pay. Paragraph 2 of the same article: "An heir who renounces the inheritance may bear no duty to clear the taxes and debts the decedent legally owed." Article 1159 of the Civil Code says that, when the estate is divided, the taxes and debts he owed are paid first. Article 1124 of the Civil Code: a person who renounces an inheritance must "make a statement of renunciation in writing before the estate is handled; if no statement is made, the heir is deemed to accept the inheritance." Article 33 of the Supreme People's Court's Interpretation (1) on the Inheritance Book: the written statement is given to the estate administrator or to the other heirs. Article 35 of that interpretation: if the renunciation is made only after the estate has been divided, what is renounced is not the right of inheritance but property already in hand. Article 1145 of the Civil Code: the heirs may choose an estate administrator, and if none is chosen they serve together. Article 1147 of the Civil Code: the estate administrator must take stock of the estate, make an estate list, and deal with the decedent's claims and debts. In a case in Yuzhou, Henan, the borrower died of illness in March 2023, and the children had not renounced the inheritance in writing. In May 2023 the court ordered the children to repay 95,000 yuan of principal and interest, within the actual value of the estate they inherited. The children said the value of the company they inherited could not be calculated, and the judgment could not be enforced. Accounts and a car in the children's names were frozen and seized, and they were placed on the list that restricts high consumption. Only in February 2025 was there a settlement, and they paid 90,000 yuan. In a Chongqing case, the borrower died of illness before the principal and interest on a loan of 400,000 yuan were paid off, and every heir stated that they renounced the inheritance. But his spouse and daughter had already withdrawn the basic pension and the occupational annuity that counted as his estate. The procuratorate found that the 2 of them had not expressly renounced, so they were treated as having accepted the inheritance. In November 2025 the spouse settled with the creditor and paid the debt in full. Debts of this kind run from 10,000 yuan to several hundred thousand yuan, so the benefit is rated large.

Notes

The people this mainly benefits are you yourself, and your spouse and children. The spouse is counted separately. A loan the 2 of them signed together, or a loan taken for ordinary household spending, counts as a joint debt of the couple. The spouse is then personally the debtor, and renouncing the inheritance does not get out of it. When the estate is divided, half of the couple's joint property goes to the spouse first, and only what remains is the estate. If you plan to renounce, do not withdraw money from his accounts first. The housing provident fund balance and the balance of the individual basic-pension account named in item 9 of this section (housing provident fund balance and social insurance benefits) are money only an heir can withdraw. The Chongqing case was a withdrawal followed by a claim of renunciation. If renouncing the inheritance would leave you unable to meet a legal duty such as supporting a parent or raising a child, the renunciation is void. If collectors come to the door, first ask for the IOU, the contract, and the other proof, and have them go to the estate administrator or sue. Do not sign a promise to repay the part that is beyond the estate, because a repayment you are willing to make yourself is also recognized by the law. If you are actually sued, an ordinary first-instance procedure has to be finished within 6 months after the case is filed, and it can be extended. Summary procedure is 3 months. Lawyer fees are not among the litigation costs borne by the losing side. If you hire a lawyer, you pay. Keep the estate list and the materials showing what the house and the deposits are worth. Enforcement uses them to calculate how much you must repay. Why paying a debt by dying does not work is in Section 29, item 13 (do not treat death as a way to pay a debt).

25.12 After a family member dies, do not start the inheritance at a notary by default: withdraw a deposit of 50,000 yuan or less at one bank directly from the bank, and handle a house at the real-estate registration office with all the heirs together

  • Money No cost
  • Time Hours
  • Willpower None
  • Benefit Medium
  • Measured in Money
Value: OrdinaryEvidence A
In plain terms

If the deceased's deposits at one bank add up to no more than 50,000 yuan, the spouse, the children, and the parents can withdraw them with the documents, and they do not need a notary. A house does not have to go through a notary either. All the heirs go together to the real-estate registration office and can get it done there. A notary costs money. In Fuzhou and Xiamen, for example, a house is charged by floor area, and 1 unit is in principle charged at most 10,000 yuan.

Cost

It costs nothing. Go to each bank that holds a deposit, one bank after another. For a house, every heir has to be at the registration window on the same day. If someone will not come, or someone does not agree on the division, this path does not work, and the only routes left are a notary or a lawsuit.

Benefit

On the deposit side, Document No. 18 of 2021 from the China Banking and Insurance Regulatory Commission and the People's Bank of China provides that a small deposit that meets the conditions no longer requires notarization. There are 3 conditions. Condition 1: the balances of the accounts at the same bank add up to no more than 10,000 yuan. A bank may raise that on its own, up to 50,000 yuan. Condition 2: the applicant is the spouse, a child, or a parent, or an heir or a legatee named in a notarized will. Condition 3: the money is taken out all at once, and the account is closed afterward. The spouse, the children, and the parents submit 4 kinds of documents: a death certificate; kinship papers such as the household register (户口簿 — the hukou booklet), a marriage certificate, or a birth certificate; their own identity document; and a commitment letter signed in their own hand. Jin Gui [2024] No. 6 (金规〔2024〕6号) provides that, from June 1, 2024, the limit is raised across the board to 50,000 yuan. Small and medium-sized rural banks may wait until December 31, 2025 to put it in place. Accumulated-gold products, and treasury bonds and wealth-management products sold through the bank, can be withdrawn the same way once they mature or are redeemed, and the amounts count together toward the 50,000 yuan. Funeral expenses and a survivor allowance paid into his account do not count toward the 50,000 yuan, and the spouse, the children, and the parents can withdraw them with this same set of documents. On the house side, Article 14 of the detailed implementing rules for the Interim Regulations on Real Estate Registration says that an application to register an inheritance or a bequest "shall submit materials on the death, a will or an agreement of all statutory heirs on how the real estate is divided, and materials on kinship with the decedent, and may also submit notarized materials or a legal document that has taken effect." Notarization is only one option. In 2016 the Ministry of Justice issued a document abolishing the 1991 joint notice that had required stronger notarization for real-estate registration. The Fuzhou Real Estate Registration and Transaction Center has explained what to do when notarized materials are not submitted. All the statutory heirs, or all the legatees, must go together to the registration office to have the materials checked, and sign an undertaking (a written statement that the materials are true). The fee follows the Fujian standard. For an inheritance notarization that does not involve real estate, the part within 200,000 yuan is charged at 0.8%, and the minimum is 300 yuan. Real estate is charged by floor area. In Fuzhou and Xiamen the charge is no more than 70 yuan per square meter, and 1 unit is in principle no more than 10,000 yuan. On that standard, the notarization fee for a deposit of 50,000 yuan is 400 yuan, and a house of 90 square meters in Fuzhou is at most 6300 yuan. The saving is several hundred to several thousand yuan, so the benefit is rated medium.

Notes

The 50,000 yuan is counted separately at each bank. If 3 banks each hold 40,000 yuan, all 3 can be withdrawn this way. Sums over 50,000 yuan are not covered by these 2 notices. Before you go, ask that bank which documents it wants. The rule also does not apply when the depositor or the applicant is a compatriot from Hong Kong, Macao, or Taiwan, a foreigner, or a person settled abroad. Even if there is only 1 notarized will, the title still cannot be transferred directly. All the statutory heirs still have to appear and confirm. If you plan to renounce the inheritance to stay clear of a debt, do not withdraw the money first. See item 11 (a written statement renouncing the inheritance). When first-order heirs withdraw the money, they can also ask for the account statements for the 6 months before the death and for the period after the death. Looking up other personal information is in item 10 (the account and personal information). If the heirs disagree and cannot work it out, you have to sue. An ordinary first-instance procedure must by rule finish within 6 months, and may be extended; you pay the lawyer fee. Notarization fee schedules differ by province. Follow the documents of the local development and reform department and the justice department. The 50,000 yuan limit is given as of October 2026. Follow the latest notice from the National Financial Regulatory Administration and the People's Bank of China.
