19 Employment, resignation, and work injury

This section is about money: how amounts are calculated, what you sign, and how deadlines run. The first three items cover pay you should receive while still employed; the next five cover leaving a job; the following seven cover occupational disease and work injury. Work-injury payouts are an order of magnitude larger than layoff compensation, and the deadlines are firmer. Damage from occupational disease cannot be undone. Nine more items close the section. The first four cover what to do if you are bullied at work, how to obtain a separation certificate, how personal income tax on severance is calculated, and how to transfer social insurance when you change cities. The middle three cover double wages when there is no written contract, when the employer fails to pay social insurance, and liquidated damages demanded on exit. The last two cover how to respond when the employer wants to reassign or cut pay, and who pays wages and damages for dispatched workers.

Items in this section are grouped by theme below; numbers in parentheses are item numbers.

Contracts and pay while employed: overtime pay (Item 1), annual leave (Item 2), probation (Item 3), double wages without a written labor contract (Item 20), unpaid or underpaid social insurance (Item 21), put disagreement with reassignment or pay cuts in writing (Item 23), equal pay for equal work when dispatched (Item 24), long-term bullying at work (Item 16).

Leaving and layoffs: calculate N first when laid off (Item 4), no 30-day prior notice (Item 5), damages for unlawful termination (Item 6), do not sign “resignation for personal reasons” (Item 7), save evidence before leaving (Item 8), separation certificate (Item 17), individual income tax on severance (Item 18), liquidated damages demanded on exit (Item 22), transfer social insurance to the new place of enrollment (Item 19).

Occupational disease and work injury: three occupational health exams (Item 9), employer must supply protective gear (Item 10), apply for work-injury recognition (Item 11), call 120 first if you feel suddenly unwell (Item 12), no work-injury insurance enrollment (Item 13), work-capacity assessment (Item 14), three payments for work-related death (Item 15).

Items in this section (24)
  1. 19.1 Overtime pay runs at 1.5×, 2×, and 3×; if unpaid, complain to labor inspection, and late payment triggers an extra 50% to 100%
  2. 19.2 Annual leave is 5, 10, or 15 days by cumulative service years; unused days are paid at 300% of daily wage
  3. 19.3 Probation has a legal cap, wages must be at least 80%, and it can only be agreed once
  4. 19.4 If you are laid off, calculate N first: one month’s wage per full year, half a month if under six months
  5. 19.5 If the employer dismisses you citing post-illness inability to work, incompetence, or major change of circumstances, and did not give 30 days’ prior notice, it must also pay one extra month’s wage
  6. 19.6 For unlawful termination, damages are double the economic compensation standard
  7. 19.7 Do not sign “resignation for personal reasons”—once signed, there is no N
  8. 19.8 Before leaving, save pay slips, attendance records, the labor contract, social insurance records, and chat logs
  9. 19.9 Before dusty, noisy, or chemical jobs, check the contract for hazards; the employer arranges and pays for three occupational health exams
  10. 19.10 Dust, noise, and chemical toxins often cause irreversible harm (for example pneumoconiosis and noise-induced deafness): the employer must supply protective gear, and you can refuse work with no protections
  11. 19.11 If you are injured at work or hit on the commute, apply for work-injury recognition first; if the employer will not file, file yourself
  12. 19.12 Do not trust «making it to your desk counts as work injury»: if you feel suddenly unwell, call 120 first, not the time clock
  13. 19.13 If the employer did not enroll you in work-injury insurance, benefits still apply and the employer pays the full standard amount
  14. 19.14 After injuries stabilize, get a work-capacity assessment; disability grade maps directly to money
  15. 19.15 Three payments for work-related death: funeral allowance, dependents' pension, and one-time work-death benefit
  16. 19.16 If you face long-term bullying, insults, or harassment at work, do not just endure it: record evidence, then complain, report, or arbitrate depending on what happened
  17. 19.17 When you leave, get a separation certificate stating contract term, leave date, position, and years of service
  18. 19.18 When you receive severance, first check individual income tax: within 3× the local prior-year average employee wage is tax-free; the excess is taxed separately, not merged into that year's salary
  19. 19.19 When you change cities for work, transfer pension and medical insurance to the new place of enrollment so contribution years keep adding up; do not withdraw from the scheme
  20. 19.20 If the employer still has not signed a written labor contract one month after you start, from the second month you can claim double wages for up to 11 months; after a full year without a contract, it counts as an open-ended contract
  21. 19.21 If the employer does not pay social insurance or underpays it, complain first to force back payment; if you resign for that reason and want economic compensation, the resignation notice must state it is because the employer did not pay social insurance as required by law
  22. 19.22 If the company demands liquidated damages when you leave, first see which kind: only a service period after special training, and non-compete, may agree liquidated damages; other labels are not allowed by law
  23. 19.23 If the employer wants to reassign you or cut your pay and you disagree, say so in writing on the spot; do not stay silent and work under the new arrangement for more than a month
  24. 19.24 If you are labor-dispatched to work at another company, wages must be calculated the same way as for regular staff in the same type of post, and if you are harmed at the host workplace both companies pay together

Weekday overtime is paid at 1.5 times your wage. Rest-day overtime without compensatory time off is paid at 2 times. Work on statutory public holidays such as New Year's Day, Spring Festival, Labor Day, and National Day is paid at 3 times, and the law does not allow compensatory time off to replace that pay. If the employer refuses, file a complaint with labor inspection. After a payment deadline is set and the employer still does not pay, the employer must also pay an additional half to the full amount owed on top of the arrears.

Cost

No cost. Routinely keep copies of clock-in records, shift schedules, and overtime approval forms, and screenshot work-group messages where managers assign extra work. The hard part is remembering to save them every month.

Benefit

Normal working hours under the law are no more than 8 hours per day and no more than 44 hours per week on average. Weekday overtime is generally capped at 1 hour per day. Where special reasons require more, it must not exceed 3 hours per day, and the total in one month must not exceed 36 hours. Overtime pay has three tiers. Extending working hours on ordinary days: at least 150% of wages. Working on a rest day when compensatory rest cannot be arranged: at least 200%. Working on a statutory public holiday: at least 300%. For statutory public holidays, the law does not offer a “substitute with compensatory rest” option. If the employer arranges overtime but does not pay overtime wages, the labor administration department orders it to pay within a set period. If it still does not pay after that period, it must pay the worker an additional sum of 50% to 100% of the amount due on top of the arrears (nationwide). Which days are statutory public holidays is in Article 2 of the State Council holiday measures: New Year's Day 1 day, Spring Festival 4 days, Qingming Festival 1 day, Labor Day 2 days, Dragon Boat Festival 1 day, Mid-Autumn Festival 1 day, National Day 3 days. Article 7 of the holiday measures allows “unified holiday bridging,” linking these days with weekends into longer breaks

Notes

Rest days and statutory public holidays are calculated separately. Statutory public holidays are only the legally designated days each year, such as New Year's Day, Spring Festival, Labor Day, and National Day. In long breaks created by bridging rest days, days that are not the festival days listed in the holiday measures count as rest days: compensatory rest may be arranged where possible; otherwise pay is 200%. That follows from Article 2 of the holiday measures and Article 44 of the Labor Law. “Company policy requires overtime approval” and “I stayed voluntarily” do not mean the employer may withhold pay, but they make evidence harder, so keep assignment and approval records. If the employer wants a comprehensive working-hours system or a flexible working-hours system, it must obtain approval from the labor administration department first; it cannot decide on its own. For dispute arbitration time limits, see Section 8, item 19.

19.2 Annual leave is 5, 10, or 15 days by cumulative service years; unused days are paid at 300% of daily wage

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Medium
  • Measured in Money
Value: OrdinaryEvidence A
In plain terms

With cumulative service of at least 1 year but less than 10 years across all employers, you get 5 days of annual leave per year. At 10 years it is 10 days; at 20 years, 15 days. Job changes still count toward the total. If the employer cannot schedule leave and you agree not to take it, those days are paid at 3 times daily wage. Sign a “voluntary waiver of annual leave” form and you only get normal wages.

Cost

No cost. Add up years worked at all employers once; social insurance payment records are proof. The hard part is refusing to sign a “voluntary waiver of annual leave” form if the company pushes one.

Benefit

After 12 consecutive months of work you are entitled to annual leave. The number of days follows cumulative working time—years at all employers added together. At least 1 year but less than 10 years: 5 days; at least 10 years but less than 20 years: 10 days; 20 years or more: 15 days. Statutory public holidays and rest days do not count toward annual leave days. Where the employer truly cannot arrange leave because of work needs and you agree not to take it, it must “pay annual leave wages at 300% of the employee’s daily wage income” for the days not taken. That 300% already includes the normal wage for the day you would have worked, so the extra cash in hand is 200%. Daily wage = your monthly wage ÷ 21.75. Monthly wage is the average over the 12 months before payment, excluding overtime pay. If you joined the employer mid-year, days are prorated by remaining calendar days at that employer. On resignation, accrue and settle for the portion of the year already worked; excess leave already taken is not clawed back. If the employer neither arranges leave nor pays, it is ordered to correct within a deadline. If it still does not after the deadline, besides the annual leave wage payment, it must pay an additional sum equal to that amount as compensation (nationwide; effective 1 January 2008).

Notes

Cumulative working time must be summed across employers; if you changed jobs, do not count only tenure at the current employer. Only when the employee “does not take leave for personal reasons and states so in writing” may the employer pay only normal wages, so do not sign a “voluntary waiver of annual leave” form. If personal leave totals 20 days or more in a year and the employer does not deduct wages, you get no annual leave that year. Sick leave beyond these lengths also disqualifies you: less than 10 years of service—2 months; 10 to 20 years—3 months; 20 years or more—4 months. Home leave, marriage and bereavement leave, maternity leave, and work-injury wage continuation periods do not count toward annual leave.

19.3 Probation has a legal cap, wages must be at least 80%, and it can only be agreed once

Value: HighEvidence A
In plain terms

For a contract of 3 months to 1 year, probation is at most 1 month. For 1 to 3 years, at most 2 months. For 3 years or more, at most 6 months. The same employer may only put you on probation once; a second probation after transfer after regularization is unlawful. Probation wages must not be below 80% of the lowest grade for the same post or of the contract wage, and must not be below the local minimum wage.

Cost

No cost. Before signing, spend a few minutes checking the contract term against the probation length.

Benefit

For a contract of 3 months or more but less than 1 year, probation must not exceed 1 month. For 1 year or more but less than 3 years, not more than 2 months. For 3 years or more, and for open-ended contracts with no end date, not more than 6 months. For a contract for a defined piece of work, or a contract of less than 3 months in total, probation may not be agreed. “The same employer and the same employee may agree on probation only once”—one probation round per person at that company. If the contract lists only a probation period, that probation is void and the period counts as the labor contract term. Probation wages “must not be lower than 80% of the lowest grade wage for the same post at the employer or 80% of the wage agreed in the labor contract, and must not be lower than the minimum wage standard at the employer’s location.” If probation exceeds the legal limit and you actually worked, the employer must pay compensation for the excess period at the monthly wage standard after probation ends. During probation the employer may terminate only for the legally listed grounds and must explain the reason to the worker (nationwide).

Notes

The three most common violations: a 1-year contract with 3 months of probation; a second probation after transfer following regularization; and “no social insurance during probation”—social insurance obligations start from day one of work regardless of probation; employer duties are in Section 12, item 16. Being dismissed in probation does not mean you get nothing; it depends on whether the employer’s stated reason is one of the lawful grounds for termination. Unlawful termination is compensated at 2N per Item 6.

19.4 If you are laid off, calculate N first: one month’s wage per full year, half a month if under six months

  • Money No cost
  • Time Minutes

  • Benefit Big
  • Measured in Money
Value: Very highEvidence A
In plain terms

When you are laid off, statutory economic compensation is calculated like this: one month’s wage for each full year worked; at least six months but less than a year counts as a year; less than six months gets half a month. Monthly wage here is the average over the 12 months before you leave, including bonuses, allowances, and subsidies. If wages exceed three times the local average monthly wage for the prior year, pay is capped at three times that average, and years of service count for at most 12 years.

Cost

No cost. Run the numbers once with a calculator; about ten minutes.

Benefit

Statutory economic compensation under the Labor Contract Law is what the employer owes when you are laid off—commonly called N. The formula: “one month’s wage for each full year of service … six months or more but less than one year counts as one year; less than six months, half a month’s wage to the worker.” If monthly wage exceeds three times the local average monthly wage of employees for the prior year, use triple that average as the cap, and count at most twelve years of service.

Notes

Monthly wage means average wage over the twelve months before the labor contract is terminated. Bonuses, allowances, and subsidies all count—not base pay alone. That is what employers most often understate. Whether this sum is subject to personal income tax is in Item 18 of this section (tax on compensation).

19.5 If the employer dismisses you citing post-illness inability to work, incompetence, or major change of circumstances, and did not give 30 days’ prior notice, it must also pay one extra month’s wage

  • Money No cost
  • Time Minutes

Value: HighEvidence A
In plain terms

If the employer dismisses you because you cannot work after illness, cannot perform the job, or circumstances changed substantially, it must give 30 days’ written notice. Without notice, it must pay one month’s wage on top of N. That is the common N+1. In negotiation, list that month separately; do not let the employer fold it into N.

Cost

No cost.

Benefit

The Labor Contract Law gives employers two options when terminating under this article. One is “notify the worker in writing thirty days in advance.” The other is “may terminate the labor contract after paying the worker one additional month’s wage.” If they want you out immediately, they pay an extra month. That extra month is commonly called payment in lieu of notice (代通知金), counted separately from N. That month is based on your prior month’s wage; N uses average wage over the 12 months before termination—the bases differ

Notes

The extra month appears only in the three situations under Article 40 of the Labor Contract Law. Illness or non-work injury and, after the medical period, inability to do the original or reassigned work. Inability to perform after training or reassignment. Major change in objective circumstances at signing and failed negotiation. Other situations have no extra month. Economic layoffs (Article 41) require only 30 days’ notice to the union or all employees. Mutual termination proposed by the employer is N. Serious misconduct termination by the employer has no compensation. Unlawful termination is 2N. For the Article 40 three cases, keep N and the extra 1 separate in negotiation; do not let the employer count the extra month as part of N

19.6 For unlawful termination, damages are double the economic compensation standard

  • Measured in Money
Value: HighEvidence A
In plain terms

If termination is unlawful, damages are double the economic compensation standard—commonly called 2N. Whether termination is unlawful depends on the facts. Ask legal aid or a lawyer first, then decide whether to negotiate with the company or go to arbitration.

Cost

No cost. Arbitration takes several months. The hard part is staying with the process the whole time and not dropping out midway.

Benefit

The Labor Contract Law provides that where an employer unlawfully terminates or ends a labor contract, it “shall pay damages to the worker at twice the economic compensation standard under Article 47 of this Law.” The calculation is to compute one economic compensation amount under that standard, then pay double

Notes

This is the common 2N. What counts as unlawful termination depends on the facts. Consult legal aid or a lawyer first, then choose negotiation or arbitration; routes are in Section 7

19.7 Do not sign “resignation for personal reasons”—once signed, there is no N

  • Money No cost
  • Time Minutes
  • Willpower A lot
  • Benefit Big
  • Measured in Money
Value: HighEvidence B
In plain terms

Signing that you resigned for personal reasons usually wipes out both economic compensation and unemployment insurance. Voluntary resignation is not among the situations that trigger compensation, except when you leave because of employer faults such as unpaid wages or failure to pay social insurance. You do not have to sign the same day; sleep on it.

Cost

No cost. The hard part is resisting pressure to sign on the spot.

Benefit

The Labor Contract Law limits economic compensation to the legally listed situations. A worker who initiates departure is not included unless the reason is statutory employer fault such as unpaid wages or failure to pay social insurance. Signing “voluntary resignation” usually voids both economic compensation and unemployment insurance.

Notes

A common employer line is “sign first to process exit; compensation comes separately.” If they mean it, put it in the agreement on the spot; otherwise do not sign. Not signing that day has no legal downside; sleep on it.

19.8 Before leaving, save pay slips, attendance records, the labor contract, social insurance records, and chat logs

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Big
  • Measured in Money
Value: HighEvidence B
In plain terms

In dismissal or wage-deduction disputes the employer must prove its case, but for overtime you must prove first, and employers only have to keep wage records for two years. Once you hand back the computer and accounts, you cannot get these materials back. With pay slips, attendance, social insurance records, and original chat logs in hand, you have something to use when the employer denies liability.

Cost

No cost. About half an hour to archive materials. The hard part is remembering before you walk out.

Benefit

Once you return the computer and accounts, these materials are gone for good. Labor disputes follow “who asserts must prove”: what you claim, you must prove. Where evidence is in the employer’s hands, the employer must produce it; failure to do so carries adverse consequences for the employer. In arbitration, if you cannot obtain employer-held materials, the tribunal may order the employer to submit them within a set time. For dismissal, termination, contract cancellation, wage reduction, and calculation of length of service, the employer bears the burden of proof. Overtime is different: you must first prove you worked overtime. If you show overtime records are with the employer and it will not produce them, adverse consequences shift to the employer. The employer is only required to keep wage payment records for at least two years. When paying wages, the employer must give you a personal wage breakdown. Without a written contract, wage payment records, social insurance payment records, and a work ID can all prove an employment relationship. Employment registration forms, attendance records, and testimony of other employees can also be used. Chat logs count as electronic data and can be evidence. Submit originals; printouts from original records still count as originals. In one Shanghai procuratorate case, a worker sought ten years of minimum-wage shortfalls. First- and second-instance courts recognized only the last two years before resignation. The courts held the employer need keep only two years of records, so the worker had to prove the prior eight years. He had ten years of pay slips and bank statements, but the employer disputed authenticity of the slips. In August 2024 he applied for procuratorial supervision. After the procuratorate protested, the employer paid 19,000 yuan in a mediated settlement. He sued when the company cleared staff in 2021; by the supervision application about three years had passed (nationwide)

Notes

Save only your own employment-related materials. Do not take company source code, client lists, or technical documents—risks of taking them are in Section 11. For chat logs, do not rely on screenshots alone; keep originals on the phone and do not delete. Best to save pay slips and bank statements every month; if you sue years after leaving, the employer is not required to keep records from more than two years ago. That Shanghai case turned around because of a procuratorate protest; most people never reach that step. On exit, also obtain a separation certificate from the employer—see Item 17 of this section (separation certificate)

19.9 Before dusty, noisy, or chemical jobs, check the contract for hazards; the employer arranges and pays for three occupational health exams

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Big
  • Measured in Lifespan
Value: HighEvidence A
In plain terms

When signing the contract, the employer must truthfully state in writing what occupational disease hazards the post has, how to protect yourself, and what benefits apply. If it concealed them, you may refuse that work and the employer cannot fire you for it. Three occupational health exams—before starting, while on the job, and before leaving—are arranged and paid by the employer. Without an exit exam, the employer cannot terminate the contract with you.

Cost

No cost. When signing, read the “occupational disease hazard disclosure” section line by line. Keep a copy of each exam report. The hard part is asking in person and getting the documents in hand.

Benefit

The Law on Prevention and Control of Occupational Diseases requires that when signing a labor contract, the employer explain four things. Those four are: what occupational disease hazards the work may cause, what consequences may follow, how to protect yourself, and what benefits apply. The statutory wording is to “truthfully inform the worker and specify it in the labor contract; concealment or deception is forbidden.” If you are later assigned hazardous work not disclosed in the contract, the employer must inform you again truthfully and renegotiate contract terms with you. If the employer fails, “the worker has the right to refuse work involving occupational disease hazards, and the employer may not terminate the labor contract for that reason.” There are three exams: pre-placement, during employment, and pre-departure. “Occupational health examination costs shall be borne by the employer”; the employer pays and must inform you of results in writing. Without a pre-placement exam, the employer must not assign work involving occupational disease hazards. Workers with occupational contraindications must not be assigned prohibited tasks. If health damage related to the job is found, the worker must be transferred from the original post and properly placed. “An employer must not terminate or end the labor contract with a worker who has not undergone the pre-departure occupational health examination.” On leaving, you “have the right to obtain a copy of your occupational health surveillance file; the employer shall provide it truthfully and free of charge, and affix its seal on the copy provided.” That occupational health surveillance file must be copied truthfully, given free, and stamped on the copy (nationwide)

Notes

Three questions at interview roughly show whether the employer is legitimate: whether the post has occupational disease hazards, whether the contract states them, and who pays for the pre-placement exam. If they cannot answer or say “start first and we’ll see,” weigh the risk yourself. Exit exams are most often skipped: without a pre-departure exam, the employer cannot terminate or end the contract. That exam is also key material for a later occupational disease diagnosis; likewise get a stamped copy of the surveillance file before you go. Occupational disease itself follows the work-injury route; benefits start at Item 11.

Pneumoconiosis, noise-induced deafness, and chemical eye burns are all statutory occupational diseases. Once lungs or hearing are damaged, they cannot be restored. You have the right to know what hazards the job carries and to demand protective facilities and personal protective equipment from the employer. You may refuse work without protections. Pay cuts or dismissal for using these rights do not count.

Cost

No cost. The hard part is wearing particulate respirators, earplugs, and safety goggles consistently, and refusing unprotected tasks—coworkers may call you picky.

Benefit

The statutory list of occupational diseases, effective 1 August 2025, has 12 major categories and 135 conditions, including 4 open-ended clauses. The first category is occupational pneumoconiosis. It covers silicosis, coal workers' pneumoconiosis, graphite pneumoconiosis, carbon black pneumoconiosis, asbestosis, and talc pneumoconiosis. Also cement pneumoconiosis, mica pneumoconiosis, potter's pneumoconiosis, aluminum pneumoconiosis, welder's pneumoconiosis, and foundry worker's pneumoconiosis, plus one open-ended clause. Occupational ear, nose, throat, and oral diseases include noise-induced deafness and blast-induced deafness. Occupational eye diseases include chemical eye burns and welder's flash keratitis. Harm from pneumoconiosis and noise-induced deafness is permanent. The US National Institute for Occupational Safety and Health (NIOSH) states that silicosis is permanent lung damage that progresses over time, with no known cure. A Lancet review states that after patients stop dust exposure, lung function still worsens as the disease progresses. The US Occupational Safety and Health Administration (OSHA) states that noise-induced hearing loss is permanent and cannot be corrected by surgery or drugs. The law gives four rights you can cite on the spot. First, to know what occupational disease hazards exist in the workplace, what consequences they can cause, and what protective measures are required. Second, to demand qualified protective facilities and personal protective equipment and improved working conditions. Third, to criticize, report, and complain about violations of occupational disease prevention law and practices that endanger life and health. Fourth, “refuse unlawful orders and forced work without occupational disease protections”—you may refuse noncompliant orders and unprotected tasks. And “any reduction of wages, benefits, or other treatment, or termination or ending of the labor contract, because the worker lawfully exercised proper rights is void.” Pay cuts, benefit cuts, or dismissal for exercising these rights do not count (nationwide)

Notes

Choose the right mask: dusty posts need particulate respirators—that is author experience. If the employer does not issue earplugs in noisy jobs, buy your own for a few yuan a pair; lost hearing cannot be restored. “Work two years, save money, and leave” does not hold for pneumoconiosis. Silicosis keeps worsening after dust exposure stops. So the exit exam matters especially (see Item 9—three occupational health exams arranged and paid by the employer). The revised catalog also adds two categories. One is occupational musculoskeletal disease: carpal tunnel syndrome, limited to manufacturing workers who repeatedly use the wrists or apply force for long periods. The other is occupational mental and behavioral disorder: post-traumatic stress disorder. It is limited to people’s police, medical workers, fire and rescue, and other emergency responders involved in sudden-incident response. First aid for chemicals splashed on the body: Section 13, item 21. How to treat post-traumatic stress disorder: Section 29, item 14 (trauma-focused psychotherapy).

19.11 If you are injured at work or hit on the commute, apply for work-injury recognition first; if the employer will not file, file yourself

  • Money No cost
  • Time Hours
  • Willpower None
  • Benefit Big
  • Measured in Money
Value: HighEvidence A
In plain terms

Injuries at work from the job count as work injuries. Being hit on the way to or from work, when you are not mainly at fault, also counts. Without work-injury recognition, medical costs, wages paid while you heal, and disability benefits all vanish. The employer should file within 30 days. If it does not, you, your family, or the trade union can file with the social insurance agency within one year.

Cost

No cost—one trip to the social insurance administrative agency. Bring three items: a work-injury recognition application form, proof of employment, and a medical diagnosis certificate.

Benefit

Without work-injury recognition, medical costs, wages paid during the work-stoppage period for treatment (停工留薪期工资), and disability benefits all vanish. If the employer misses the 30-day filing deadline, it must pay all work-injury benefits due in that period itself

Notes

Treat the 1-year limit seriously; do not delay. Time lost for reasons not your fault does not count toward that 1 year. There are five such reasons: force majeure, restricted personal liberty, employer-caused delay, imperfect registration systems at the social insurance agency. The fifth is labor arbitration or litigation to confirm the employment relationship. If the employer stalls until the deadline passes, apply anyway and bring evidence of the delay. If the agency refuses to accept the application or you disagree with the decision, you may apply for administrative reconsideration or sue directly. If the employer denies work injury, it must prove its case. Keep your own records too: photos from the day, coworkers' contact details, medical records, and attendance. Article 16 of the regulations lists three exclusions: intentional crime, intoxication or drug use, and self-harm or suicide. Article 15 also lists “deemed work injuries”: sudden illness at work and at the workstation with death, or death within 48 hours after failed emergency treatment.

19.12 Do not trust «making it to your desk counts as work injury»: if you feel suddenly unwell, call 120 first, not the time clock

  • Money No cost
  • Time Minutes
  • Willpower None
  • Benefit Big
  • Measured in Lifespan
Value: Very highEvidence A
In plain terms

Rushing to the office when you feel unwell will not earn extra money. «Deemed work injury» requires sudden illness during working hours and at the workstation; illness on the way before you arrive does not qualify. Rescue beyond 48 hours also does not qualify. Minutes spent chasing those conditions cost you your chance to survive.

Cost

No monetary cost.

Benefit

«Deemed work injury» requires sudden illness «during working hours and at the workstation» with death, or death within 48 hours after failed emergency treatment. Delaying care to meet those conditions trades your chance to live for compensation you may never receive

Notes

Both conditions must hold: working hours and the workstation. Illness on the commute before arrival does not apply. If illness starts at the workstation and you are sent home or to hospital and die within 48 hours despite treatment, the rule may still apply. What matters is where you were when illness started, not where death occurs. Short videos that say «hold on until you reach the company and you get paid» get it backward. What changes outcomes is whether you reach hospital in the first tens of minutes after onset. The 48-hour line is fixed; treatment beyond 48 hours excludes the case.

19.13 If the employer did not enroll you in work-injury insurance, benefits still apply and the employer pays the full standard amount

  • Money No cost
  • Time Hours
  • Willpower Some
  • Benefit Big
  • Measured in Money
Value: HighEvidence A
In plain terms

Even without work-injury insurance enrollment, work-injury benefits still apply. The employer must pay the same items and amounts in full, missing nothing. Non-enrollment adds penalties on the employer: order to pay premiums, a daily late fee of 5/10000 of the amount unpaid, and a fine of 1 to 3 times the unpaid amount if still not paid. “The company has no insurance so it cannot pay” is false.

Cost

No cost. If the employer disputes liability, arbitration or even litigation starts at several months. The hard part is staying with the process for those months.

Benefit

The regulations state plainly: if an employer that should enroll in work-injury insurance did not, and an employee is injured, that employer pays benefits under the same items and standards as the regulations. Which payments and how much match enrolled cases; only the payer changes to the employer

Notes

“The company did not buy work-injury insurance for you, so it cannot compensate” is one of the most common lies in these cases. Non-enrollment only adds penalties on the employer; your benefits do not shrink.

19.14 After injuries stabilize, get a work-capacity assessment; disability grade maps directly to money

  • Money No cost
  • Time Hours
  • Willpower None
  • Benefit Big
  • Measured in Money
Value: HighEvidence A
In plain terms

After injuries stabilize, a work-capacity assessment turns grade directly into money. The lump-sum disability benefit uses your own wage: grade 5 — 18 months, grade 6 — 16 months, grade 7 — 13 months. Grade 8 — 11 months, grade 9 — 9 months, grade 10 — 7 months. Do not sign a “one-time settlement” agreement before the assessment result is out.

Cost

No cost. One work-capacity assessment process; expect waiting time before and after.

Benefit

The lump-sum disability benefit converts disability grade into months of your own wage, paid once. Grade 5 — 18 months, grade 6 — 16 months, grade 7 — 13 months of your wage. Grade 8 — 11 months, grade 9 — 9 months, grade 10 — 7 months of your wage

Notes

Grades 5 and 6 keep the employment relationship; you remain the employer's employee and receive a monthly disability allowance. For grades 7 through 10, when the contract ends or you terminate it, two more lump sums apply. A one-time work-injury medical subsidy from the fund and a one-time disability employment subsidy from the employer; amounts are set by the province. Do not sign a “one-time settlement” before the assessment result is out. Work-injury prostheses, wheelchairs, and similar assistive devices must first be confirmed by the work-capacity assessment committee; see Section 33, item 7 (ask the county disabled persons' federation for the full picture).

19.15 Three payments for work-related death: funeral allowance, dependents' pension, and one-time work-death benefit

  • Money No cost
  • Time Hours
  • Willpower None
  • Benefit Big
  • Measured in Money
Value: HighEvidence A
In plain terms

Work-related death means three payments; do not negotiate on only one. Funeral allowance equals 6 months of the local prior-year average employee monthly wage. Dependents' pension is paid monthly from the deceased's wage: spouse 40% per month, other dependents 30% each per month. The one-time work-death benefit is 20 times the prior year's national urban per capita disposable income—one figure nationwide.

Cost

No cost—one set of procedures.

Benefit

Work-related death money comes in three parts. First, funeral allowance: 6 months of the prior-year average employee monthly wage in the insurance pooling area where you were enrolled. Second, dependents' pension from the deceased's wage, paid monthly: spouse 40% per month, other dependents 30% each per month. Third, one-time work-death benefit: 20 times the prior year's national urban per capita disposable income. Nationwide there is only this one figure, not by region. For deaths in 2026, that payment is about 1,130,000 yuan (113万 / exact value 1,130,040 yuan). The calculation is prior-year national urban per capita disposable income 56,502 yuan × 20.

Notes

The one-time work-death benefit is uniform nationwide and updates each year with data from the National Bureau of Statistics. Reject “our local standard is lower” in settlement talks.

19.16 If you face long-term bullying, insults, or harassment at work, do not just endure it: record evidence, then complain, report, or arbitrate depending on what happened

  • Money No cost
  • Time Hours
  • Willpower A lot
  • Benefit Medium
  • Measured in Lifespan
Value: OrdinaryEvidence B
In plain terms

People bullied at work later face roughly 60% higher risk of heart disease and stroke, and more bullying means higher risk. Years later, bullied workers are about twice as likely to have suicidal thoughts as others. Insults and mistreatment are not something you shrug off.

Cost

No monetary cost. Time to log dates, who was present, exact words, and to keep original chat screenshots and emails. Arbitration or litigation can take months. Changing jobs is the highest cost — whether to leave is your call.

Benefit

For health: three Swedish and Danish cohorts together, 79,201 employed people aged 18 to 65. None had cardiovascular disease at baseline; mean follow-up 12.4 years. 9% reported workplace bullying in the past year. Bullied workers had about 59% higher risk of cardiovascular disease (coronary and cerebrovascular disease) (HR 1.59, 95% CI 1.28–1.98). Those who faced workplace violence had about 25% higher risk (HR 1.25, 1.12–1.40). For both, more exposure meant higher risk. A Norwegian follow-up survey using a national random sample of 1,846 employed people, measured every two to three years for three rounds: bullied workers were about twice as likely to develop suicidal thoughts (OR 2.05, 95% CI 1.08–3.89). The reverse did not hold — prior suicidal thoughts did not predict later bullying. Legally, China has no dedicated «workplace bullying» statute; match the act to existing rules. Employers who insult, physically punish, beat, illegally search, or illegally detain workers face administrative penalties, must compensate harm, and bear criminal liability if applicable. If an employer uses violence or threats to force work, you may terminate the contract at once without prior notice and claim economic compensation. Employers must prevent and stop sexual harassment via authority or hierarchy; victims may hold harassers civilly liable. Labor arbitration closes within 45 days from acceptance; complex cases may extend up to 15 days more.

Notes

Graded B because health figures come from follow-up studies, not randomized trials, and «bullying» was self-reported. Four steps you can take now. Step one: start logging today; recording — Section 8, item 41. Step two: raise the issue in writing through internal channels and keep proof you did. Step three: if you are beaten, confined, or publicly humiliated, call the police. Step four: if unpaid wages or missing social insurance (社保) forced you out, follow this section item 7 (do not sign voluntary resignation) and item 8 (save evidence before leaving). How economic compensation is calculated: this section item 4 (calculate N when laid off). Pure cold-shoulder, exclusion, or petty obstruction mostly fit no specific statute; main routes are internal complaint, transfer, and changing jobs. Arbitration runs up to 60 days from acceptance; a first-instance court must under the rules finish within 6 months, and may be extended; you pay your own lawyer. If you are at breaking point, call 12356 — Section 1, item 25 (12356). This item does not tell you to quit at the first insult; the cost of changing jobs is yours to weigh.

19.17 When you leave, get a separation certificate stating contract term, leave date, position, and years of service

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Medium
  • Measured in Money
Value: OrdinaryEvidence A
In plain terms

Whether you were dismissed, the contract expired, or you resigned, the employer must give a separation certificate when you leave and transfer your personnel file and social insurance within 15 days. The certificate must state contract term, separation date, position, and years at this employer. You need it for unemployment registration. If the employer refuses, labor authorities order correction, and the employer must pay for any loss it caused you.

Cost

No monetary cost. Ask in person before you go, or send a written request and keep proof you asked. Hard when relations are bad. If the employer stalls, complaint or arbitration can take weeks to months.

Benefit

The Labor Contract Law requires a certificate when the contract is terminated or ended. The rule does not depend on who initiated it — non-renewal, resignation, or dismissal all count. The employer must complete personnel file and social insurance transfer within 15 days. Implementing regulations require four items on the certificate: contract term, date of termination or end, job position, and years of service at the unit. The Unemployment Insurance Regulations require workers who become unemployed to take the employer's certificate promptly to the social insurance agency for unemployment registration. Unemployment benefits start from the registration date. If the employer does not issue a written certificate, the labor administration orders correction. If you suffer loss, the employer pays damages. The law also provides that a new employer who hires someone still bound to a former employer and causes loss to the former employer bears joint and several liability. The separation certificate is written proof that you and the former employer have ended the relationship (nationwide)

Notes

The law does not tie issuing the certificate to finishing handover; economic compensation is paid after handover is done. If the employer drags its feet, send one more written demand. If still no certificate, call 12333 or complain to labor inspection at the human resources bureau. Complaints are free; after a case is opened, investigation must finish within 60 working days, extendable 30 working days for complex cases. To claim damages from the employer, use labor arbitration — also free — within one year. After acceptance, arbitration closes within 45 days, extendable 15 days. You must prove the loss yourself, for example delayed unemployment registration or a new employer refusing you for lack of proof. If you disagree with the award, go to court; ordinary first-instance procedure must under the rules finish within 6 months, and may be extended. Labor dispute court fees are 10 yuan per case; attorney fees are not litigation costs and you pay yourself. The four required items do not include reason for leaving. If the certificate says «voluntary resignation for personal reasons» and that is false, object on the spot — see this section item 7 (do not sign voluntary resignation). How to claim unemployment insurance: Section 7, item 1.

19.18 When you receive severance, first check individual income tax: within 3× the local prior-year average employee wage is tax-free; the excess is taxed separately, not merged into that year's salary

  • Money No cost
  • Time Minutes
  • Willpower None
  • Benefit Big
  • Measured in Money
Value: Very highEvidence A
In plain terms

One-time compensation from ending employment is tax-free up to 3 times the local prior-year average employee wage. Amounts above that are taxed on their own, not added to that year's wages. If the employer lumped the whole payment into the month's wages and withheld tax that way, ask the employer first, then call 12366 for the tax bureau.

Cost

No cost. Look up the local prior-year average employee wage, then spend a few minutes checking how the employer withheld tax. The individual income tax app shows line-by-line filing for each payment.

Benefit

A Ministry of Finance and State Taxation Administration circular covers one-time compensation income from terminating a labor relationship with an employer. That income includes economic compensation, living allowances, and other subsidies. The portion within 3 times the local prior-year average employee wage is exempt from individual income tax. The portion above 3 times is not merged into annual comprehensive income; it is taxed separately under the comprehensive income rate table. On that table, the portion within 36,000 yuan for the year is taxed at 3%; the portion from 36,000 yuan to 144,000 yuan at 10%. Higher brackets go up to 45%. Example: if the local prior-year average employee wage is 100,000 yuan, 3 times is 300,000 yuan. On 360,000 yuan compensation, only the 60,000 yuan excess is taxed—3480 yuan. If the full 360,000 yuan were taxed under that table, tax would be 58,080 yuan. Effective 1 January 2019; no end date stated (nationwide)

Notes

The same circular sets an end date for the annual one-time bonus policy, later extended to 31 December 2027. The termination-compensation rule has no end date and does not follow the bonus extension. The circular names economic compensation, living allowances, and other subsidies; it does not separately name payment in lieu of notice or damages for unlawful termination. If unsure whether those count, call 12366 for the local tax bureau. Which figure counts as “local prior-year average employee wage” is determined by the local tax bureau. How compensation itself is calculated: Item 4 of this section (calculate N when laid off), Item 5 (no 30-day prior notice), and Item 6 (damages for unlawful termination). One-time subsidies for early retirement or internal retirement use a different formula and are not covered here.

19.19 When you change cities for work, transfer pension and medical insurance to the new place of enrollment so contribution years keep adding up; do not withdraw from the scheme

  • Money No cost
  • Time Minutes
  • Willpower None
  • Benefit Big
  • Measured in Money
Value: Very highEvidence A
In plain terms

When you change cities, both pension and medical insurance records can follow you, and years you already paid keep counting. Before pension-claiming age you cannot cancel enrollment (退保) and take the money out. If medical contributions lapse more than 3 months, you may wait up to 6 months before reimbursement at the new place—so do not leave a long gap.

Cost

No cost. Once you are enrolled and paying in at the new place, your new employer or you file a transfer application, in person at a counter or online. Pension transfers take several dozen working days end to end; medical insurance takes about 15 working days.

Benefit

The Social Insurance Law states that when you take a job in another place (formally, across pooling areas), your pension record moves with you and contribution years accumulate. Employee medical insurance works the same: the record follows the person and years accumulate. At retirement the pension is calculated in segments and paid by one place. Cross-province pension transfer follows the transfer-and-continuation measures issued by the General Office of the State Council. Before benefit-claiming age, the pension relationship may not be terminated and you may not withdraw from the scheme (退保). The Social Insurance Law also states that the individual account may not be withdrawn early. Money in the individual account transfers in full with interest. The employer-paid portion is the pooled fund; it transfers at 12% of your actual contribution wage for each year from 1998 onward. When you claim the pension, calculation uses your contribution wage each year, contribution years, and average wages where you claim. Procedure: once enrolled and paying at the new place, the employer or you apply in writing to the new place of enrollment. The new place reviews within 15 working days; the old place completes transfer out within 15 working days after receiving the letter agreeing to accept. After the new place receives the record and funds, it completes the process within a further 15 working days. Under the 2020 nationwide-handling list, this was to be available for nationwide handling by year-end. You only apply to the place you are moving to; no need to return to the place you left. For employee medical insurance, the old place must first suspend coverage and you must already be enrolled at the new place before you apply. You can apply online on the National Healthcare Security service platform or at a counter. The old place transfers out within 10 working days; the new place takes in within 5 working days, with individual account balance moved along. If the gap before transfer is 3 months or less, after back contributions under the new place's rules there is no waiting period: reimbursement from the contribution month, and the gap period can be reimbursed retroactively. If the gap exceeds 3 months, the waiting period follows local rules and in principle does not exceed 6 months (nationwide)

Notes

If you move across provinces to a province that is not your hukou (户口) province, and you are a man aged 50 or older or a woman aged 40 or older, your pension record stays with the old place of enrollment. The new place only opens a temporary account recording all employer and individual contributions. Where you collect the pension at retirement works like this. If the record is in your hukou province, you collect there. If not in your hukou province but you have 10 years of contributions where the record sits, you collect there. If it is under 10 years both in your hukou province and where the record sits, the record goes to the last place where you reached 10 years and you collect there. If under 10 years in every place, records are gathered at your hukou place and you collect there. Collection place changes which average wage enters the formula. Within-province city-to-city transfer is set by each province; ask the local social insurance office. People already drawing a pension no longer transfer records. How years count after a lapse and which entitlements need continuous contributions: Section 7, item 18 (lapsed social insurance). If you do not join an employer and pay social insurance yourself: Section 31, item 11 (flexible employment).

19.20 If the employer still has not signed a written labor contract one month after you start, from the second month you can claim double wages for up to 11 months; after a full year without a contract, it counts as an open-ended contract

  • Money No cost
  • Time Hours
  • Willpower Some
  • Benefit Big
  • Measured in Money
Value: HighEvidence A
In plain terms

If the employer has not signed a written contract one month after you start, from the second month it owes an extra month's wage each month, up to 11 extra months. After a full year without a contract, it counts as if you already signed a contract with no end date. Sign when the employer hands you the contract; if you deliberately stall and refuse to sign, you cannot claim this money.

Cost

No cost. Keep evidence that you worked: wage bank records, attendance, work badge, work-group chat logs. If the employer disputes it, apply for labor arbitration. Arbitration is free; cases close within 45 days after acceptance, extendable by at most 15 days. You can still go to court if you disagree; ordinary first-instance procedure must under the rules finish within 6 months, and may be extended, and you pay your own lawyer. The hard part is still working there while pressing for the money.

Benefit

The Labor Contract Law requires a written labor contract when an employment relationship is established. If it is not signed on the first day of work, it must be signed within one month from that day. If more than one month but less than one year passes without a contract, the employer must pay you double wages each month. The implementing regulations fix the start and end: from the day after one full month of work through the day before the contract is later signed. If a full year passes without a contract, double wages run through the day before the year is complete—at most 11 months. From the day the year is complete, both sides are treated as having signed an open-ended labor contract, and the employer must sign one at once. An open-ended contract is one with no agreed end date. A Supreme People's Court judicial interpretation effective September 2025 provides that double wages are calculated by the month; periods under one month are calculated by actual working days. If the employer proves the lack of a contract was due to force majeure, or to your intentional or grossly negligent refusal to sign, it need not pay. Within the first month of work, if the employer notifies you in writing to sign and you do not, the employer may terminate the employment relationship in writing. In that case it owes no economic compensation, only wages for the days you worked. Courts will not support a further claim for double wages covering the period already treated as an open-ended contract (nationwide)

Notes

How long you have to claim the extra wage portion has no nationwide rule from the Supreme People's Court. A 2023 draft for comments had a limitation rule that the 2025 formal interpretation did not keep. Beijing's practice is that the extra portion uses the 1-year arbitration limitation, counted day by day backward from the day you make the claim. Local methods differ, but the longer you wait, the fewer months you can recover. So apply for arbitration while still employed or soon after leaving. General arbitration limitation rules: Section 8, item 19 (rights have deadlines). If a make-up contract is backdated to the first day of work, Beijing generally no longer supports double wages, unless you can prove the make-up signing was not voluntary. From the employer's side: Section 12, item 16 (sign a written contract within the first month of hiring).

19.21 If the employer does not pay social insurance or underpays it, complain first to force back payment; if you resign for that reason and want economic compensation, the resignation notice must state it is because the employer did not pay social insurance as required by law

  • Money No cost
  • Time Hours
  • Willpower Some
  • Benefit Big
  • Measured in Money
Value: HighEvidence A
In plain terms

If the employer did not enroll you in social insurance or did not pay enough, you can complain and require it to make up the payments, plus late fees. You can also notify the employer in writing that you are ending the contract and claim economic compensation. The notice must state the reason is that the employer did not pay social insurance as required by law; if you write “personal reasons,” you get nothing. An agreement that “the employee voluntarily waives social insurance” does not count.

Cost

No cost. First check your social insurance payment records; screenshot or print and keep them. To force back payment, call 12333 or complain to labor inspection at the human resources and social security bureau. For economic compensation, go to labor arbitration—free, closes within 45 days, extendable by at most 15 days. If you disagree, go to court; ordinary first-instance procedure must under the rules finish within 6 months, and may be extended, and you pay your own lawyer. The hard part is having another source of income after you resign.

Benefit

The Social Insurance Law requires the employer to declare and pay social insurance on time and in full. Except for statutory grounds such as force majeure, it may not defer or reduce payments. If the employer infringes your social insurance rights, you may ask the social insurance administrative agency or the social insurance contribution collection agency to handle it under the law. If the employer fails to pay on time and in full, the collection agency orders it to make up the shortfall within a deadline and adds a daily late fee of 5/10000 from the day payment was due. If it still does not pay after the deadline, it is fined 1 to 3 times the unpaid amount. Labor security inspection covers whether the employer participates in social insurance and pays contributions. After a case is opened, investigation finishes within 60 working days, extendable by 30 working days for complex cases. The Labor Contract Law provides that if the employer does not pay social insurance for you as required by law, you may terminate the labor contract and the employer must pay economic compensation. If you resign with 30 days’ prior notice on your own, the employer owes no economic compensation. So the notice must state that you are terminating because the employer did not pay social insurance as required by law. A Supreme People's Court judicial interpretation effective September 2025 states that agreements with you not to pay social insurance, or your own promise that payment is unnecessary, are both void. If the employer did not pay social insurance as required by law and you terminate and claim economic compensation on that basis, courts support the claim under the law. If the employer never enrolled you, the social insurance agency cannot make it up, and you lose benefits as a result, you may claim damages from the employer. That is a labor dispute the courts accept (nationwide)

Notes

To force back payment, use the complaint route. Beijing High Court and arbitration commission practice is that a bare claim for back payment is not a labor dispute; go to the labor administration. Do not delay the complaint: if a violation is not discovered and no one complains within 2 years, labor security authorities will not investigate further. For ongoing non-payment, the 2 years run from the day the arrears stop. Whether underpaying the contribution base counts as “not paying as required by law,” and whether that alone supports economic compensation, is not stated by the Supreme People's Court. Beijing lists only two situations: no social insurance account opened in the year before termination, or incomplete coverage of insurance types. There is no nationwide uniform rule on underpaid bases; ask the local arbitration commission first. If the employer previously paid you the social insurance amount in cash and later made up the contributions, it may demand you return that cash. Work injury when work-injury insurance was never paid: Item 13 of this section (no work-injury insurance enrollment). How years count after a lapse: Section 7, item 18 (lapsed social insurance).

19.22 If the company demands liquidated damages when you leave, first see which kind: only a service period after special training, and non-compete, may agree liquidated damages; other labels are not allowed by law

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Medium
  • Measured in Money
Value: OrdinaryEvidence A
In plain terms

A contract line that “leaving early means you pay” is allowed by law in only two situations: the company paid for specialized technical training for you, or non-compete. Where there really was special training, damages cannot exceed training costs, and must be prorated for the unfinished service period.

Cost

No cost. Pull out the labor contract, training agreement, and non-compete agreement and check them against each other—a few minutes. If the company deducts wages to cover liquidated damages, recover them through labor arbitration. Arbitration is free; cases close within 45 days, extendable by at most 15 days. If you disagree, go to court; ordinary first-instance procedure must under the rules finish within 6 months, and may be extended, and you pay your own lawyer.

Benefit

The Labor Contract Law provides that except for a service period after special training and non-compete, the employer may not agree that the worker bears liquidated damages. The first is when the employer pays special training expenses to send you for specialized technical training and may agree a service period with you. If you leave early in breach of the service period, you pay liquidated damages as agreed. Liquidated damages must not exceed the training expenses the employer paid. What the employer can actually claim must not exceed the training expenses allocated to the unfinished part of the service period. Example: training costs 30,000 yuan, service period 3 years; leave after 2 years, at most 10,000 yuan. Training expenses need vouchers, including training fees, travel during training, and other direct costs caused by the training. If you lawfully terminate because of employer faults such as unpaid social insurance or unpaid wages, that is not a breach of the service period, and the employer may not claim liquidated damages. The second is non-compete; rules are in Section 11, item 12 (non-compete agreement). Also, contract clauses that exempt the employer from statutory duties or exclude the worker’s rights are void (nationwide)

Notes

No liquidated damages does not mean leaving costs nothing. If you leave without 30 days’ written notice, or breach confidentiality or non-compete and cause the employer loss, you must compensate the loss. How much loss is for the employer to prove. If the employer provided special benefits such as hukou (户口) and agreed a service period, and you leave early, a court may order you to compensate. How much depends on actual loss, fault on both sides, and how long you already worked. Beijing practice is that liquidated damages tied only to the employer helping with hukou are not supported, but you still compensate loss you caused the employer by breaking good faith. If the employer terminates you for serious misconduct, serious dereliction, or criminal liability, service-period liquidated damages are still owed. If the contract ends while the service period is unfinished, the contract extends to the end of the service period unless the parties agree otherwise. How to recover deducted wages: Section 7, item 2 (complain to labor inspection first for unpaid wages). Benefit graded medium by judgment: liquidated-damage amounts are written into each contract; there is no uniform figure.

19.23 If the employer wants to reassign you or cut your pay and you disagree, say so in writing on the spot; do not stay silent and work under the new arrangement for more than a month

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Medium
  • Measured in Money
Value: OrdinaryEvidence B
In plain terms

Changing post or wage is changing the contract; both sides must agree, and it must be in writing. But if you stay silent and work at the new post and wage for more than a month, courts generally will not void the change just because it was not in writing. If you disagree, say so in writing on the spot; WeChat and email both count.

Cost

No cost. After a reassignment or pay-cut notice, send a written message stating you disagree, screenshot and keep it—a few minutes. The hard part is still working there while facing a confrontation. If the employer then fires you or docks pay, go to labor arbitration. Arbitration is free; after acceptance, cases close within 45 days, extendable by at most 15 days. If you disagree, go to court; ordinary first-instance procedure must under the rules finish within 6 months, and may be extended, and you pay your own lawyer.

Benefit

The Labor Contract Law provides that only when the employer and worker agree through consultation may the agreed contents of the labor contract be changed. Changes must use written form. A Supreme People's Court judicial interpretation adds another rule. If both sides orally agreed to change the contract and then actually worked under the new terms for more than one month, the change is still valid. At that point, arguing the change is void for lack of written form is not supported by courts. The premise is that the changed content is lawful and does not violate public order and good morals. Beijing High Court and Beijing arbitration commission practice is as follows. If the contract does not state a post or states it unclearly, and the employer has proper reasons and reassigns reasonably for business needs, that counts as the employer’s staffing autonomy. Reasonableness looks at four things: whether there is business necessity, whether the purpose is proper, whether you can do the new post, and whether pay and benefits worsened. If the contract clearly states the post and has no reassignment clause, a unilateral reassignment by the employer is a breach, and the shortfall versus original-post wages must be made up. If the contract writes the work location as a broad range such as “nationwide” or “Beijing,” that counts as unclear, and the place you actually work controls. Without proper reasons, the employer may not change that place. If the employer fails to pay wages in full and on time, you may terminate the labor contract and the employer must pay economic compensation (nationwide; Beijing practice applies only in Beijing)

Notes

Graded B because “silence while working counts as consent” is not written directly in the statute. It is inferred from Article 43 of the judicial interpretation and local adjudication practice. There is no nationwide uniform standard for “reasonable reassignment”; the points above are Beijing practice. After objecting in writing, best to keep reporting for work and state that you reserve your position, because refusing to show up may be treated as absenteeism and lead to dismissal. If the reassignment is later found unreasonable, that dismissal is unlawful termination, calculated under Item 6 of this section (damages for unlawful termination). If found reasonable, you do not get that money. If objective circumstances at signing changed substantially and renegotiation of terms fails, the employer may terminate the contract. Then pay follows Item 5 of this section (no 30-day prior notice). How to recover wages underpaid after a cut: Section 7, item 2 (complain to labor inspection first for unpaid wages). Benefit graded medium by judgment: pay-cut size varies by employer; there is no uniform figure.

19.24 If you are labor-dispatched to work at another company, wages must be calculated the same way as for regular staff in the same type of post, and if you are harmed at the host workplace both companies pay together

  • Money No cost
  • Time Minutes
  • Willpower None
  • Benefit Medium
  • Measured in Money
Value: HighEvidence A
In plain terms

A dispatched worker’s contract is with the dispatch company, and the host workplace where you work each day also has statutory duties. Wages must be calculated the same way as for people in the same type of post at that host; overtime pay and performance bonuses are also paid by it. If you are harmed at that host, both companies pay together; you may claim the full amount from either one. In months with no assignment after you are returned, the dispatch company must still pay the minimum wage.

Cost

No cost. Check the labor contract for which company’s seal is on it—a few minutes. Then ask the dispatch company what wage and social insurance the dispatch agreement states; it must tell you. Real disputes go to labor arbitration—free; after acceptance, cases close within 45 days, extendable by at most 15 days. If you disagree, go to court; ordinary first-instance procedure must under the rules finish within 6 months, and may be extended, and you pay your own lawyer.

Benefit

The Labor Contract Law provides that the labor dispatch company is your employer; it must sign a fixed-term contract of 2 years or more with you and pay wages monthly. During periods with no assignment, it pays the local minimum wage monthly. The dispatch company must tell you the contents of the dispatch agreement and must not deduct wages the host workplace (legally, the using unit) pays you. Neither company may charge you fees. Dispatched workers have the right to equal pay for equal work with employees of the host. The host must use the same labor-remuneration distribution method for the same type of post. With no same-type post, set pay by reference to the same or similar local posts. The host must pay overtime and performance bonuses, provide post-related benefits, and must not discriminate against dispatched workers. For continuous assignment, wages must be adjusted normally. Dispatch may only be used for temporary, auxiliary, or substitute posts; temporary posts are those lasting no more than 6 months. Dispatched workers at the host must not exceed 10% of total staffing. If the host harms a dispatched worker, the dispatch company and the host bear joint and several liability. Joint and several means you may claim the full amount from either one, or from both. If you have a labor dispute with either, both are joint parties in arbitration. If you are injured at work at the host, the dispatch company applies for work-injury recognition and bears work-injury insurance liability; the host must assist the investigation. The host may return you only in the legally listed situations. Arrangements labeled contracting or outsourcing that in substance use people as dispatch are handled under the dispatch rules (nationwide; interim provisions effective 1 March 2014)

Notes

Equal pay for equal work compares whether the same type of post uses the same distribution method; it does not guarantee every person receives exactly the same amount. After you are returned, if the dispatch company lowers the original contract terms to reassign you and you disagree, it may not terminate the contract for that reason. If the dispatch company terminates or ends the contract with you on statutory grounds, it must pay economic compensation; the formula is in Item 4 of this section (calculate N when laid off). If you are injured at the host, have the dispatch company file for work injury first. If it will not, file yourself—see Item 11 of this section (apply for work-injury recognition). For deducted or unpaid wages: Section 7, item 2 (complain to labor inspection first for unpaid wages). Benefit graded medium by judgment: equal-pay gaps and harm size vary by person; there is no uniform figure.
