11 Common legal pitfalls for programmers and tech professionals

This section’s metrics are personal freedom and money — what you get back is “don’t get locked up” and “don’t pay damages.” People who write code or do technical work often treat the items below as “just technical problems.” In fact they map to specific criminal offenses, or to a concrete civil sum you may have to pay. Each item gives the numbers in the statutes, plus cases published on the websites of the Supreme People’s Procuratorate and the Supreme People’s Court. Criminal-law citations use the consolidated text “as amended by Amendment (XI) to the Criminal Law” republished by the Beijing Traffic Management Bureau. Item 1 is the general one: how to judge before you act, and what to do first if something goes wrong.

Items in this section are grouped by theme below; numbers in parentheses are item numbers.

Before you act: Before acting, ask whether anyone will file a police report (item 1).

Cheats, scripts, and cracks: Game cheats and aids (item 2); ticket-snatching, fake-order, and coupon-farming scripts (item 3); crawl only public pages that need no login (item 4); tools that auto-skip or block ads in other apps (item 18); crack patches and keygens (item 20).

Touching others’ systems: Do not run your programs on others’ computers (item 8); do not test others’ systems without written authorization (item 9); report vulnerabilities as required (item 10); DDoS traffic attacks (item 21).

Side gigs and client work: Development orders for gambling, fraud, or adult-content apps (item 5); circumvention tools and VPN accounts (item 11); AI relay sites (item 19).

Leaving and ownership: Hand over account access when you leave (item 6); do not take source code when you leave (item 7); non-compete agreements (item 12); code written with company resources belongs to the company (item 13); GPL and other open-source code (item 14).

Shipping a product: Collect only personal information the business needs (item 15); complete ICP filing before launch (item 16); generative-AI security assessment and algorithm filing (item 17).

Items in this section (21)
  1. 11.1 Before acting, ask one question: will the vendor, platform, or company file a police report; if you are pursued, hire a criminal defense lawyer at once
  2. 11.2 Do not make or sell game cheats and aids, including AI aids that “only read the screen and never touch memory,” and do not sell modified builds that add features to software such as WeChat
  3. 11.3 Do not write or sell scripts for ticket snatching, flash sales, fake orders, or coupon farming — even if they merely “automate button clicks”
  4. 11.4 Crawl only public pages that need no login; do not bypass anti-scraping, do not touch personal information, and do not sell the data you crawl
  5. 11.5 Refuse development orders for gambling, fraud, or adult-content apps; do not set up payment gateways or unblock accounts for such “clients”
  6. 11.6 When you leave, hand over all account access; do not delete databases, leave backdoors, or change passwords and lock the system — even if the company owes you money
  7. 11.7 When you leave, do not take source code, client lists, or technical documents; do not upload them to a personal cloud drive; do not reuse them at the next employer
  8. 11.8 Do not run your own programs on others’ computers, servers, or cameras; do not use company machines for mining
  9. 11.9 Do not test others’ systems without written authorization; “good intentions” and “reporting afterward” are not defenses in the statute
  10. 11.10 Report vulnerabilities as required; before a patch, do not publish details, release exploit tools, or hand them to parties abroad
  11. 11.11 No selling of tools for bypassing firewalls or VPN accounts, no setting up such nodes for others
  12. 11.12 If you signed a non-compete, and after leaving the company does not pay monthly compensation, send a written demand; if unpaid for a full 3 months you may terminate; posts that never touched trade secrets may seek a ruling that the clause does not take effect
  13. 11.13 Code written on work time with company resources belongs to the company; do personal open-source projects on your own time and equipment, and do not mix in company code
  14. 11.14 Using open-source code such as GPL in products: Open-source it per the license or switch licenses — don’t treat this as “no one cares”
  15. 11.15 For an App, collect only personal information the business needs; for users under 14 get guardian consent; write the privacy policy clearly
  16. 11.16 Before launching a website or App, complete ICP filing; keep logs for 6 months or more under multilevel protection requirements
  17. 11.17 Before offering generative AI services to the public, complete the required security assessment and algorithm filing, and mark generated content
  18. 11.18 Do not make or distribute tools that automatically skip or block ads in other apps; even free ones may be held to be unfair competition
  19. 11.19 Do not build an “AI relay site” that resells foreign large-model APIs at low prices: a Shanghai site operator has already been criminally detained
  20. 11.20 Do not write, sell, or distribute crack patches, keygens, or cracked software; once sales hit the numbers, it is sentenced as copyright infringement
  21. 11.21 Do not help launch DDoS traffic attacks; do not sell or rent “stress-test” traffic platforms; if you lose a game, do not attack the other side’s servers either

11.1 Before acting, ask one question: will the vendor, platform, or company file a police report; if you are pursued, hire a criminal defense lawyer at once

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Big
  • Measured in Freedom
Value: HighEvidence C
In plain terms

Before you act, ask one question: will the vendor, platform, or company file a police report. Investigating authorities have the power to obtain server logs, payment records, and group-chat records. If you are criminally detained, the decision whether to arrest you comes within at most 37 days. From the first questioning you may hire a lawyer; the lawyer can argue to the procuratorate that arrest should not be approved, and can also apply for bail

Cost

No money spent. Before acting, replace “can this be done technically?” with another question: will the vendor, platform, or company file a police report. The hard part is resisting the thought that “nobody will care about something this small,” because investigating authorities have the power to obtain server logs, payment records, and group-chat records

Benefit

Any unit or individual who discovers facts of a crime has the right to report it. If investigating authorities believe there are facts of a crime, they shall open a case. Courts, procuratorates, and public security “have the power to collect and obtain evidence from relevant units and individuals,” and those units and individuals must provide it truthfully. After criminal detention, public security must apply for arrest approval within 3 days (ask the procuratorate for formal arrest). In special circumstances this may be extended by 1 to 4 days. For circumstances such as crimes committed while roaming across places in series, it may be extended to 30 days. The procuratorate then has another 7 days to decide. Added up, the arrest decision comes within at most 37 days. When the procuratorate reviews arrest approval, “if defense counsel requests it, the defense counsel’s opinions shall be heard.” Counsel also has the right to apply to change compulsory measures — for example, replacing detention with bail pending trial — and the investigating authority must reply within 3 days. From the first interrogation, or from the time a compulsory measure is imposed (detention, arrest, and the like), you may entrust a lawyer. While the case is still being investigated by public security, you may only entrust a lawyer. When counsel requests a meeting, the detention center must arrange it within 48 hours at latest. If the likely sentence is control, criminal detention, or another penalty lighter than imprisonment, or only accessory penalties without a principal penalty, bail pending trial is available. Bail means posting a bond or finding a guarantor and going home while the case proceeds. Bail lasts up to 12 months (nationwide)

Notes

These 37 days count from detention to the procuratorate’s decision whether to approve arrest; they are not the upper limit on how long you can be held. After arrest approval there is still a detention period during investigation, which continues to run. Within these 37 days, what a lawyer can do is see the person, submit to the procuratorate an opinion that arrest should not be approved, and apply for bail pending trial. The author’s view is that waiting until after indictment to hire a lawyer means the arrest-approval stage has already passed. Every other item in this section is about the same thing: whether the other side has grounds to file a report.

11.2 Do not make or sell game cheats and aids, including AI aids that “only read the screen and never touch memory,” and do not sell modified builds that add features to software such as WeChat

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Big
  • Measured in Freedom
Value: HighEvidence A
In plain terms

Selling a cheat to 20 person-times, or earning 5000 yuan, is enough for up to 3 years; especially serious cases get 3 to 7 years. Someone who made wall-hack and aim-assist cheats sold over 80,000 yuan worth of cheats in 3 months, got 1 year suspended for 1 year and a 5000 yuan fine. Someone who took server-side code, ran a private server, and took over 20,000,000 yuan in top-ups got up to 4 years, with fines as high as 10,000,000 yuan

Cost

No money spent. The trade-off is giving up income from such orders and “little tools.” The hard part is that the money comes fast and it is unclear who will pursue you

Benefit

Providing programs or tools specially used to intrude upon or illegally control computer information systems, when circumstances are serious, brings up to 3 years and a fine concurrently or alone. Concurrent means prison plus a fine; alone means fine only. Especially serious circumstances bring 3 to 7 years plus a fine. The threshold for “serious circumstances” is providing the tool to 20 person-times or more, or illegal gains of 5000 yuan or more. Illegal gains means the money earned from this. Intentionally bypassing or destroying technical protection measures set by the rights holder may also constitute copyright infringement, with up to 3 years, or 3 to 10 years in serious cases. Official case: Wang and others made and sold cheats that read and modified game memory for wall hacks and aim assist. In 3 months they sold over 80,000 yuan and profited over 30,000 yuan. Sentence: 1 year suspended for 1 year, fine 5000 yuan. Suspended for 1 year means a 1-year sentence that is not served yet; if you stay clean that year you need not go to prison. Xiang and others sold the “TZ” series of cheats with sales over 200,000 yuan; Xiang got 3 years suspended for 3 years and a 20,000 yuan fine. Liu and others obtained game server programs, changed parameters, ran private servers, and took over 20,000,000 yuan in top-ups. Sentences from 4 years to 2 years 6 months, fines from 10,000,000 to 1,300,000 yuan. Not only games. A Shanghai company made custom ROMs that added dozens of features to WeChat on the phone — auto-forward, like, mass message, and more. Those phones were sold as “marketing phones,” 2381 units. In 2019 the Shanghai Xuhui court convicted the company of copyright infringement, fined it 500,000 yuan, and sentenced the person in charge to 1 year 6 months suspended for 1 year 6 months (nationwide)

Notes

Published cheat rulings all involve reading or writing game memory and bypassing anti-cheat. Aids that “only screenshot or only simulate key presses” have not yet appeared in official rulings. But the ticket-snatching case in item 3 shows that never touching memory and only sending requests can still support a conviction for illegally obtaining data. Whether it is a crime and under which charge is decided by investigating authorities from materials the vendor submits when reporting — not by the author. Selling to 20 person-times already meets “serious circumstances”; that bar is low.

11.3 Do not write or sell scripts for ticket snatching, flash sales, fake orders, or coupon farming — even if they merely “automate button clicks”

  • Money No cost
  • Time Minutes
  • Willpower None
  • Benefit Big
  • Measured in Freedom
Value: Very highEvidence A
In plain terms

Even if a script does not modify memory or crack anything and only sends requests faster than a person, it can still lead to a conviction; earning 5000 yuan or causing the other side 10,000 yuan in losses is enough. Someone used bought 12306 accounts to snatch over 200 tickets, earned over 20,000 yuan, and got 1 year 6 months suspended for 1 year 6 months plus a 5000 yuan fine. Someone who sold ticket-snatching software in an online shop paid 20,000 yuan for unfair competition.

Cost

No expense and no time required

Benefit

Breaking into a computer information system, or using other technical means to obtain the data in it, brings up to 3 years in serious cases, with a fine added or a fine alone; especially serious cases bring 3 to 7 years. The threshold for “serious circumstances” is illegal gains of 5,000 yuan or more, or losses of 10,000 yuan or more. Official case: a person used a bot to bulk-import bought 12306 accounts and submit ticket-purchase requests on many threads. He snatched more than 200 tickets for others and earned over 20,000 yuan. The court convicted him of the crime of illegally obtaining computer information system data and sentenced him to 1 year 6 months suspended for 1 year 6 months and a 5,000 yuan fine. Zheng sold ticket-snatching software for a certain ticketing app in an online shop and was held to have committed unfair competition, ordered to pay 20,000 yuan (nationwide).

Notes

In the ticket-snatching case the script did not alter memory or crack anything and was only “faster than a person,” and the conviction was still under Article 285 of the Criminal Law. Both paid ticket-snatching services and selling such scripts are considered profit-generating activities. No official case was found of someone using such a script once for themselves.

11.4 Crawl only public pages that need no login; do not bypass anti-scraping, do not touch personal information, and do not sell the data you crawl

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Big
  • Measured in Freedom
Value: HighEvidence A
In plain terms

Bypassing login, token, signature, and similar protections to take data, when circumstances are serious, brings up to 3 years, or 3 to 7 years if especially serious. Crawling personal information is worse. Location tracks, communication content, credit, and property-type information at 50 records already counts as serious circumstances. Accommodation, health, and transaction types at 500 records, other types at 5000 records, or earning 5000 yuan, likewise

Cost

No money spent. A crawler is a program that automatically flips through web pages and pulls down the data on them. Before crawling, glance at the robots file and any API authorization notes; robots is the file a site puts in its root directory listing which pages must not be scraped. Data that needs a login, a token (a temporary pass string), or a cracked signature to obtain — do not crawl it. The hard part is that technically these data are one grab away; holding back is all self-discipline

Benefit

Taking system data by bypassing protections has the same sentencing range as item 3 (ticket-snatching, flash-sale, and fake-order scripts): up to 3 years, or 3 to 7 years. Illegally obtaining, selling, or providing citizens’ personal information meets “serious circumstances” at any of the following: location tracks, communication content, credit, or property information of 50 records or more; accommodation, communication records, health, or transaction information of 500 records or more; other personal information of 5000 records or more; illegal gains of 5000 yuan or more. Serious circumstances bring up to 3 years and a fine concurrently or alone; especially serious cases bring 3 to 7 years. Official case: software developer Li disguised a function that stole phone albums as a “looks rating” app and obtained 1751 face photos. He also resold social-engineering database material and got 3 years suspended for 3 years. A social-engineering database is a database that aggregates personal information leaked from various places. A network technology company used a crawler to take store and order data from a food-delivery platform, caused over 40,000 yuan in losses, and was prosecuted for illegally obtaining computer information system data (nationwide)

Notes

A 2017 judicial interpretation provides that “providing to others information lawfully collected, without the person’s consent” also counts as “providing.” Exporting a user table inside a company to an outside partner falls under the same sentence. 5000 records is only the size of a small table.

11.5 Refuse development orders for gambling, fraud, or adult-content apps; do not set up payment gateways or unblock accounts for such “clients”

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Big
  • Measured in Freedom
Value: HighEvidence A
In plain terms

If you take a development order knowing it is a gambling app, you are treated as an accomplice in operating a casino. Operating a casino carries up to 5 years, or 5 to 10 years in serious cases — heavier than the at-most 3 years for merely helping. In one e-sports betting app case, 28 people were sentenced under operating a casino to between 1 year and 3 years 6 months. Someone who unblocked QQ accounts for a fraud ring got 1 year 6 months and a 20,000 yuan fine.

Cost

No direct monetary cost. The trade-off is forgoing outsourcing projects that pay well but have vague requirements. The difficulty lies in the fact that these clients often offer significantly higher pay than normal projects.

Benefit

Knowing that someone is using the network to commit a crime, and still giving them help such as technical support or payment settlement, brings up to 3 years in serious cases, with a fine added or a fine alone. If other crimes are also involved, the harsher penalty applies. Operating a casino carries up to 5 years plus a fine; serious cases bring 5 to 10 years. Official examples: The Zhang Sheng group developed gambling games and then sold them as “white-label sites” to others, charging site-building fees and report fees. The case involved nearly 7 billion yuan. Zhang Sheng got 9 years 9 months and a fine of 50,000,000 yuan. Wang Qiang and 78 others, 79 people in all, who handled the outsourced development, got from 6 months to 9 years 9 months. Chen Dong and others developed and ran an e-sports betting app; the technical team wrote code in Hainan, and 28 people were convicted of operating a casino and got from 1 year to 3 years 6 months, plus fines. Zhang, who ran a studio that unblocked banned QQ accounts for a fraud ring, got 1 year 6 months and a fine of 20,000 yuan (nationwide).

Notes

“Knowing” does not require the client to explicitly state the purpose. When a quote is far above market rates, the functions are top-up and cash-out plus odds, or the client will not say what the app is for, investigators use each of these to infer that you knew. Developers of gambling apps are prosecuted as accomplices in operating illegal gambling dens, not under the “Crime of Assisting Information Network Criminal Activities” which caps at 3 years.

11.6 When you leave, hand over all account access; do not delete databases, leave backdoors, or change passwords and lock the system — even if the company owes you money

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Big
  • Measured in Freedom
Value: HighEvidence A
In plain terms

Account passwords the company gave you do not mean you may still use them after you leave. Illegally controlling a system, when circumstances are serious, brings up to 3 years. Deleting data so the system cannot run, with serious consequences, brings up to 5 years, or 5 years or more if especially serious. An engineer who was dismissed logged in with the old admin account, deleted data and logs, caused over 120,000 yuan in losses, and got 3 years suspended for 5 years plus a 30,000 yuan fine

Cost

No money spent. If the company owes you wages, get them back through labor arbitration; do not act yourself (labor arbitration is in Section 7). The hard part is holding back from touching the system while angry

Benefit

Illegally controlling a computer information system, when circumstances are serious, brings up to 3 years and a fine concurrently or alone; especially serious cases bring 3 to 7 years. Deleting or modifying system functions or data so the system cannot run normally, with serious consequences, brings up to 5 years; especially serious cases bring 5 years or more. Official case: senior IT engineer Lü, after being dismissed, logged into the company shared server with the old admin account. He changed the password, deleted data and logs, and caused over 120,000 yuan in losses. Sentence: 3 years suspended for 5 years, fine 30,000 yuan. Software-company employee Bai deliberately inserted faulty code into an upgrade program so the client system could not log in, causing over 40,000 yuan in losses. He was prosecuted for destroying a computer information system (nationwide)

Notes

Account passwords the company gave you do not mean you may still use them after you leave. Logging in with an account beyond the authorized scope counts as intrusion under Prosecutorial Example No. 36; see item 9 (do not test others’ systems without written authorization). In Lü’s case, after logging in he also changed the admin password and deleted data. The procuratorate found the system had not gone down as a result, so it did not charge destroying a computer information system and charged illegal control of a computer information system instead. Losses include necessary costs of restoring data. Under the 2011 joint judicial interpretation, losses of 10,000 yuan or more meet “serious circumstances,” and 50,000 yuan counts as especially serious. Lü’s losses of over 120,000 yuan were found to be especially serious circumstances.

11.7 When you leave, do not take source code, client lists, or technical documents; do not upload them to a personal cloud drive; do not reuse them at the next employer

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Big
  • Measured in Freedom
Value: HighEvidence A
In plain terms

Copyright in code written on the job generally belongs to the company; client lists may also count as trade secrets — taking them is taking the company’s things. A former employee who took security-screening system source code to a new company got 5 years and a 500,000 yuan fine; the new company was fined 4,000,000 yuan. Someone who exploited a system flaw to download over 33000 design files got 1 year 10 months. The company can also sue you separately for damages

Cost

No money spent. Before leaving, delete company materials from your personal computer and cloud drives. The hard part is that some files are ones you wrote line by line, and you hate to let them go

Benefit

Violating confidentiality duties by disclosing trade secrets or using them yourself, when circumstances are serious, brings up to 3 years and a fine concurrently or alone; especially serious cases bring 3 to 10 years plus a fine. The Anti-Unfair Competition Law also lists two acts as infringement: obtaining trade secrets by “electronic intrusion” (technical intrusion into a system); and inducing or helping others to breach confidentiality. Official case: Sun and other former employees took security-screening system source code and core algorithms and used them in a new company’s product. Sun got 5 years and a 500,000 yuan fine; the new company was fined 4,000,000 yuan. Tian exploited a system flaw to download over 33000 design files and got 1 year 10 months plus a 100,000 yuan fine. Engineer Yang stored App module source code on a personal computer and in the cloud, then built a similar App after switching jobs, and was prosecuted for infringing trade secrets (nationwide)

Notes

Even “code you wrote yourself” generally has copyright belonging to the company; see item 13 (code written with company resources belongs to the company). Taking it is taking the company’s things. Client lists are business information and may also constitute trade secrets. Besides a criminal sentence, the company can bring a separate civil claim for damages.

11.8 Do not run your own programs on others’ computers, servers, or cameras; do not use company machines for mining

  • Money No cost
  • Time Minutes
  • Willpower None
  • Benefit Big
  • Measured in Freedom
Value: Very highEvidence A
In plain terms

Controlling others’ computers, servers, or cameras without permission reaches up to 3 years at 20 devices, or 3 to 7 years if especially serious. Even below the criminal threshold, detention of up to 5 days still applies, and a fine of 50,000 to 500,000 yuan is also possible. Anyone who has received a criminal penalty is barred for life from key posts in cybersecurity management and network operations.

Cost

No expense and no time loss

Benefit

Illegally controlling a computer information system: serious cases bring up to 3 years, with a fine added or a fine alone; especially serious cases bring 3 to 7 years. Controlling 20 or more devices is deemed “serious.” Those not meeting criminal thresholds still face confiscation of illegal gains, up to 5 days of detention, and a possible fine of 50,000 to 500,000 yuan. More serious violations bring 5 to 15 days of detention and a possible fine of 100,000 to 1,000,000 yuan. Anyone with a prior public security penalty is barred for 5 years, while those with a criminal record are barred for life from critical cybersecurity and network operation roles. Official case: Li bought the IPs of network cameras and used software to control 105 of them to spy on people’s privacy, and got 3 years suspended for 5 years and a fine of 20,000 yuan. Wu and others implanted a trojan into phone motherboards, controlled over 3.3 million phones to send back verification codes, and got from 2 years to 4 years 6 months (nationwide).

Notes

No case published by the Supreme People’s Procuratorate or Supreme People’s Court was found on mining on company servers; this entry is written under the legal provision concerning unauthorized system control. The lifelong ban from key roles is an additional consequence under China’s Cybersecurity Law, carrying heavier weight for tech professionals than monetary fines alone.

11.9 Do not test others’ systems without written authorization; “good intentions” and “reporting afterward” are not defenses in the statute

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Big
  • Measured in Freedom
Value: HighEvidence A
In plain terms

The statute looks at whether you had authorization and how much you obtained — not at what you meant. Obtaining 500 sets of ordinary account passwords, or earning 5000 yuan or causing the other side 10,000 yuan in losses, is enough for up to 3 years. Exporting one user table “to prove the bug” often crosses 500 sets in a single pass. Having account passwords and using them outside the authorized scope also counts as intrusion

Cost

No money spent. Before joining a vendor SRC or a public bug-bounty test, first obtain a document that states the authorized scope, target list, and allowed testing window. An SRC is a vendor-run security response center that receives externally reported vulnerabilities. Stop once you have verified the vulnerability exists. The hard part is giving up the “quick try” impulse

Benefit

Systems of ordinary companies and individuals are computer information systems outside the fields of state affairs, national defense construction, and cutting-edge science and technology. Intruding into such systems, or using other technical means to obtain data stored, processed, or transmitted in them, when circumstances are serious, brings up to 3 years of fixed-term imprisonment or criminal detention, and a fine concurrently or alone. Especially serious cases bring 3 to 7 years plus a fine. “Serious circumstances” has several standards: obtaining 10 or more sets of identity-authentication information (account passwords and the like) for online financial services such as payment settlement, securities trading, or futures trading; obtaining 500 or more sets of other identity-authentication information; illegally controlling 20 or more computer information systems; illegal gains of 5000 yuan or more, or economic losses of 10,000 yuan or more. Five times or more of those figures is “especially serious circumstances.” Official case: Prosecutorial Example No. 36 established one sentence — “using an account and password to log into a computer information system beyond the authorized scope is an act of intruding into a computer information system.” Meaning: you already have the account and password, but using them outside the authorized scope itself counts as intrusion. In that case three people used accounts, passwords, and tokens obtained at work to log into the company’s internal system from another place. They downloaded data outside their work scope, sold it online, and had illegal gains of 37,000 yuan. They were sentenced to 4 years, 3 years 9 months, and 4 years respectively, each fined 40,000 yuan (nationwide)

Notes

Prosecutorial Example No. 36 itself was a case of selling data for profit. It is cited only for the sentence that logging in beyond authorized scope counts as intrusion — not to say that good-faith testing will be sentenced the same way. Article 285 of the Criminal Law and the 2011 interpretation do not list good intentions or reporting afterward as reasons that it is not a crime. The author infers from that: what you meant to do, and whether you reported afterward, cannot cancel the offense; they may only affect how heavy the sentence is or whether to prosecute. A vendor thanking you first and filing a report later are not contradictory; thanks are not authorization. In 2016, a security researcher commonly called a “white hat” submitted a vulnerability in the Jiayuan site to a third-party vulnerability platform. Jiayuan later reported to police and he was arrested. Jiayuan told reporters the report was because data had been taken, and at the time they did not know the person who took the data was the one who submitted the vulnerability. This case has only media reports, no judgment and no official bulletin; there is no official account of how it ended. No good-faith testing case that can be checked word for word was found on the Supreme People’s Court or Supreme People’s Procuratorate websites, so this item is graded only from the statute and penalty standards. If you test, go through the vendor’s public SRC, or a written engagement, and put scope, targets, and time window in the document. Prove the bug exists with the least evidence; do not bulk-extract data. Conduct below the criminal threshold still faces public-security penalties and occupational bans; fine amounts and years match item 8 (do not run your programs on others’ machines). What to do after finding a vulnerability is in item 10 (report vulnerabilities as required).

11.10 Report vulnerabilities as required; before a patch, do not publish details, release exploit tools, or hand them to parties abroad

  • Money No cost
  • Time Minutes
  • Willpower None
  • Benefit Medium
  • Measured in Freedom
Value: HighEvidence A
In plain terms

Individuals are also covered by the Regulations on the Management of Network Product Security Vulnerabilities (网络产品安全漏洞管理规定). Before the vendor has a fix, you must not publish the vulnerability, and must not publish vulnerability details for systems currently in use. You must not release programs and tools made to exploit the vulnerability, and when you publish you must also explain how to fix it. Unpublished vulnerabilities must not be given to organizations or individuals abroad other than the vendor

Cost

No money spent. Report the vulnerability to the product provider, or to an official platform. Until the vendor has fixed it, do not publish details or proof-of-concept code

Benefit

This regulation covers three kinds of subjects: domestic network product providers, network operators, and organizations or individuals engaged in discovering, collecting, publishing, and similar activities involving vulnerabilities. No organization or individual may use vulnerabilities for activities that harm cybersecurity, or illegally collect, sell, or publish vulnerability information. Publishing vulnerability information to the public must follow five rules. First, do not publish before the product provider offers a remediation measure. Second, do not publish details of vulnerabilities in networks, information systems, and equipment currently used by network operators. Third, do not deliberately exaggerate harm and risk, and do not use vulnerability information for malicious hype or fraud. Fourth, do not publish or provide programs and tools specially used to exploit vulnerabilities for activities that harm cybersecurity. Fifth, when publishing, publish remediation or prevention measures at the same time. Also, unpublished vulnerability information must not be provided to organizations or individuals abroad other than the product provider. The regulation encourages reporting vulnerabilities to four official platforms. One is the MIIT cybersecurity threat and vulnerability information sharing platform. Two is the National Cyber and Information Security Information Notification Center vulnerability platform. Three is the CNCERT/CC vulnerability platform. Four is the China Information Technology Security Evaluation Center vulnerability database. Collecting or publishing vulnerability information in violation is handled by MIIT and the Ministry of Public Security according to their duties. Conduct that meets circumstances under the Cybersecurity Law (网络安全法) is punished under that law. Publishing system vulnerabilities and other cybersecurity information to the public shall comply with relevant state rules. Violations bring orders to correct and warnings from the competent authority, and may bring a fine of 10,000 yuan or more and 100,000 yuan or less. Refusal to correct or serious circumstances bring a fine of 100,000 yuan or more and 1,000,000 yuan or less. The authority may also order suspension of related business, shutdown for rectification, or closure of the website or application. It may also revoke related business permits or the business license. Persons directly in charge and other persons directly responsible are fined 10,000 yuan or more and 100,000 yuan or less (nationwide)

Notes

The regulation expressly includes individuals among those covered; “I’m only an amateur” is not an exception. Submitting a bug in a domestic system to a foreign bug-bounty platform falls squarely under “unpublished vulnerabilities must not be provided abroad.” Whether you are allowed to test is in item 9 (do not test others’ systems without written authorization); that is separate from how you handle a vulnerability once you have it. A lawfully found vulnerability can still draw a penalty for unlawful publication; a vulnerability found without authorization has problems on both the testing and the publishing sides. The regulation does not specially address “the vendor was notified but does not fix.” The author’s advice is to keep records of negotiation and reporting, and also report to the four official platforms above.

11.11 No selling of tools for bypassing firewalls or VPN accounts, no setting up such nodes for others

  • Money No cost
  • Time Minutes
  • Willpower None
  • Benefit Big
  • Measured in Freedom
Value: Very highEvidence B
In plain terms

Any individual or entity that builds their own outbound network connections or uses international channels outside of state-provided public telecom services may be ordered by police to cease internet access, receive a warning, and face fines up to 15,000 yuan plus confiscation of any illegal earnings. Those running businesses based on such services may be charged with illegal business operations; in severe cases, imprisonment of up to five years applies. This rule specifically addresses selling or setting up such nodes. For personal use only, the maximum penalty remains limited to a warning and fine.

Cost

No expense or time required

Benefit

Direct international internet connectivity must be facilitated via international gateway channels supplied by the national public telecom network. No organization or individual may independently establish or utilize any other channels, meaning neither private outbound connections nor third-party nodes are permitted. Violators face police orders to disconnect from the internet, warnings, and possible fines up to 15,000 yuan plus confiscation of illicit profits. Commercial operators violating this rule may be prosecuted for illegal business operations; severe violations incur up to five years imprisonment plus a fine of one to five times the illegal earnings, or that fine alone. Especially serious cases bring five years or more (nationwide).

Notes

At the time of drafting, no publicly documented court rulings regarding firewall circumvention were found on Supreme People’s Court or Supreme People’s Procuratorate websites, and regional enforcement practices vary widely; hence this B rating was assigned. For personal usage alone, the maximum penalty remains limited to warnings and fines as outlined in Article 14 of the provisional regulations.

11.12 If you signed a non-compete, and after leaving the company does not pay monthly compensation, send a written demand; if unpaid for a full 3 months you may terminate; posts that never touched trade secrets may seek a ruling that the clause does not take effect

  • Money No cost
  • Time Minutes
  • Willpower None
  • Benefit Medium
  • Measured in Money
Value: HighEvidence A
In plain terms

A non-compete means for a period after leaving you may not work for a competitor — up to 2 years — and the company must pay compensation monthly. If no amount was agreed, pay 30% of average wages over the 12 months before leaving, not below the local minimum wage. If for the company’s reasons nothing is paid for 3 months, you may request termination. From 2025, posts that never touched trade secrets may request a ruling that the clause does not take effect

Cost

No money spent. When you leave, keep the original non-compete agreement and evidence that the company did not pay monthly

Benefit

Non-competes may only bind senior managers, senior technical staff, and others with confidentiality duties. The term is at most 2 years. The company must pay economic compensation monthly during that term. If no compensation amount was agreed, pay 30% of average wages over the 12 months before leaving, and not below the local minimum wage. If for the company’s own reasons nothing is paid for 3 months, the worker may request termination of the non-compete. If the company terminates on its own initiative, it must pay an extra 3 months of compensation. From 2025, workers whose posts never knew or touched trade secrets may request a ruling that the clause does not take effect. If the agreed scope exceeds the secrets they actually knew, the excess is void. Official case: a pharmaceutical company sued CTO Zheng for 7,100,000 yuan in liquidated damages. The court found the new employer’s products were not substitutes for the former company’s, that the non-compete scope should be limited to secrets he actually knew, and dismissed the claim in full (nationwide)

Notes

The statute looks only at whether, for the company’s reasons, nothing was paid for a full 3 months; a written demand is the author’s suggested way to keep evidence. Conversely, if the agreement is valid and the company paid monthly, and you still join a competitor, you must pay the agreed liquidated damages. After paying, you may still be required to finish the remaining non-compete term. Agreements with senior managers, senior technical staff, and similar people with confidentiality duties that also ban competing work while employed are valid even if the company pays no extra money. Aside from non-competes and special training service periods, the company may not agree that you pay liquidated damages; see Section 19, item 22 (being asked for liquidated damages when leaving).

11.13 Code written on work time with company resources belongs to the company; do personal open-source projects on your own time and equipment, and do not mix in company code

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Medium
  • Measured in Money
Value: OrdinaryEvidence A
In plain terms

Software written mainly with company equipment, intranet, or business data, for which the company bears responsibility, has copyright belonging to the company; you keep only the right of authorship — and the same if the contract so provides. Code written after hours may still count as the company’s if you used a company computer or business data. Inventions made mainly with company resources also have patents belonging to the company

Cost

No money spent. When you join, read the intellectual-property clauses in the labor contract carefully. The hard part is that personal projects and company work often share one computer and must be kept apart

Benefit

Works created to complete the unit’s work tasks are works for hire (things made while doing the job). In the ordinary case copyright belongs to the author; the unit has priority to use them within its business scope, and for 2 years the author may not license third parties to use them in the same way. But two kinds of cases differ. One is engineering designs, software, and similar works created mainly with the unit’s material and technical conditions, for which the unit bears responsibility. The other is works the contract assigns to the unit. In both, the author keeps only the right of authorship. The unit’s material and technical conditions means company equipment, intranet, business data, and the like. Inventions completed while performing the unit’s tasks, or mainly using the unit’s material and technical conditions, are service inventions. The right to apply for a patent and the patent obtained both belong to the unit (nationwide)

Notes

Software is written directly into the “copyright belongs to the unit” category, so programmers almost never fall into the “copyright belongs to the author, unit has two-year priority use” tier. “Written after hours” can still be treated as mainly made with the unit’s equipment and materials if you used a company computer, intranet, or company business data. To keep a personal project clean, use your own machine, do not touch company repositories, and do not overlap company business.

11.14 Using open-source code such as GPL in products: Open-source it per the license or switch licenses — don’t treat this as “no one cares”

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Medium
  • Measured in Money
Value: OrdinaryEvidence B
In plain terms

Copyright infringement requires you to compensate the copyright holder based on their actual losses or the profits you earned from the infringement. If you commit infringement intentionally and under aggravating circumstances, you may be ordered to pay damages ranging from 1 to 5 times the original amount. One company hired a former employee of a competitor and developed software that was substantially similar to the competitor’s product. The company argued that since the competitor’s software used GPLv2, it was required to be open-source anyway. The Supreme People’s Court ruled that whether a developer complies with GPLv2 or not has no bearing on their copyright rights, and ordered the company to cease infringement and pay 500,000 yuan in damages.

Cost

There is no cost involved. Before using someone else’s open-source code, check its license for any stated usage terms. The GPL family of licenses requires that any product built using it must also have its source code released, which conflicts with selling the product as closed-source software for profit. If there is a conflict, use a different one. The hard part is giving up a library you’ve already grown comfortable using.

Benefit

Copyright infringement demands compensation based on the rights holder’s actual losses or the infringer’s profits. If neither of these can be accurately calculated, damages are determined by how much it would cost to obtain a proper license for the same software. Intentional and aggravated infringement can also result in 1 to 5 times the standard compensation amount. If the infringement harms public interests, any illegal profits may be confiscated and fines imposed. A relevant official case is (2021) 最高法知民终 51 号 (Supreme People’s Court, Civil Appeal No. 51 of 2021). In this case, a defendant hired a former employee of a plaintiff and developed gateway software that was substantially similar to the plaintiff’s product. The defendant claimed the plaintiff’s software used GPLv2 and thus should have been open-source. The Supreme People’s Court held that “whether the developer itself violates the GPLv2 agreement and whether it enjoys software copyright are two independent questions,” and ordered the defendant to cease infringement and pay 500,000 yuan in damages (nationwide).

Notes

This case makes it clear that “the other party used GPL code” cannot serve as justification for copying their software. Conversely, there are already effective court rulings in China on GPL authors suing commercial entities that fail to release source code. No original text of these rulings could be found on the Supreme People’s Court website, so they are not cited here. This item is graded B because compliance with open-source licenses is governed only by general contract and copyright laws, without any specific legal provisions dedicated to this area.

11.15 For an App, collect only personal information the business needs; for users under 14 get guardian consent; write the privacy policy clearly

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Medium
  • Measured in Freedom
Value: OrdinaryEvidence B
In plain terms

Collect only information the business needs; for users under 14 get guardian consent. For violations, first an order to correct; the App may be stopped. Refusal to correct brings a fine of 1,000,000 yuan or less, and persons in charge 10000 to 100,000 yuan. Serious cases bring a fine of 50,000,000 yuan or less or 5% or less of the prior year’s revenue, and persons in charge 100000 to 1,000,000 yuan

Cost

No money spent. Before launch, check the App’s permission list against the privacy policy and drop permissions you can do without. The hard part is product always wanting to keep some data that “might be useful later”

Benefit

Processing personal information shall have a clear and reasonable purpose, be directly related to that purpose, and use the method with the least impact on individuals’ rights and interests. Processing personal information requires the individual’s consent, or a statutory basis. For those under 14 years of age, consent of a parent or guardian is required. Violations bring orders to correct, warnings, and confiscation of illegal gains from the regulator, and orders to suspend or terminate the offending App’s services. Refusal to correct brings a fine of 1,000,000 yuan or less, and persons directly in charge and other persons directly responsible 10000 to 100,000 yuan. Serious circumstances bring a fine of 50,000,000 yuan or less, or 5% or less of the prior year’s revenue. Responsible persons are fined 100000 to 1,000,000 yuan. Those people may also be barred for a period from serving as directors, supervisors, or senior managers of related enterprises. Selling or providing personal information that constitutes a crime is in item 4 (nationwide)

Notes

The statute does not say which posts count as “other persons directly responsible.” The author infers that people who write code and build the product may also be counted; this book found no case that can be checked word for word. MIIT periodically announces Apps taken down for violations; this section did not verify which specific bulletin, so none is cited.

11.16 Before launching a website or App, complete ICP filing; keep logs for 6 months or more under multilevel protection requirements

  • Money Low
  • Time Hours
  • Willpower None
  • Benefit Medium
  • Measured in Freedom
Value: OrdinaryEvidence A
In plain terms

Filing costs nothing; domestic servers without filing that refuse to correct will be shut down. Filing as not charging while actually charging brings a fine of 3 to 5 times illegal gains, or 100000 to 1,000,000 yuan. Logs must be kept for a full 6 months; refusal to correct or causing consequences brings a fine of 10000 to 100,000 yuan

Cost

Filing is free; use the cloud provider’s process — in the author’s experience a few days to a few weeks. Multilevel protection assessment is charged by level. Multilevel protection, or dengbao for short, is a set of national security-management actions that grade systems by importance and require websites and systems to meet them

Benefit

Commercial internet information services require a license; non-commercial ones require filing. Without a license or filing, you may not operate. Without filing, telecom authorities order correction; refusal brings an order to close the site. Operating without a license brings confiscation of illegal gains plus a fine of 3 to 5 times those gains, or a fine of 100000 to 1,000,000 yuan. Not displaying the filing number on the homepage brings a fine of 5000 to 50,000 yuan. Network operators must, under the multilevel protection system (dengbao), set security management rules, defend against attacks, retain network logs for no less than 6 months, and classify, back up, and encrypt data. Failure brings orders to correct and warnings. Refusal to correct or causing consequences brings a fine of 10000 to 100,000 yuan, and persons in charge 5000 to 50,000 yuan (nationwide)

Notes

Without filing, access providers must not connect domestic servers for you. How to file, how much the fine is for not posting the filing number, and how to check whether a provider is licensed are in Section 26, item 4 (servers in China need filing). The real traps are two: filing as personal non-commercial while actually charging; and changing domain or entity without updating the filing. The author’s view is that keeping logs for 6 months is both a duty and self-protection — when something happens you can show it was not you. Apps and mini programs also need filing before listing; the method is in the same item.

11.17 Before offering generative AI services to the public, complete the required security assessment and algorithm filing, and mark generated content

  • Money No cost
  • Time Hours
  • Willpower None
  • Benefit Medium
  • Measured in Freedom
Value: OrdinaryEvidence B
In plain terms

Generative AI services aimed at the public that can shape opinion or mobilize people need a security assessment and algorithm filing before launch; changes or shutdown also need amendment or cancellation filings. Generated images and video must be marked. Small tools for yourself that are not open to the public need none of this. Violations are punished under the Cybersecurity Law and other laws.

Cost

No money spent, but you must go through the cyberspace authority’s process, which takes some time. Tools that do not provide services to the domestic public are outside this measure

Benefit

Providing generative artificial-intelligence services with public-opinion attributes or social-mobilization capacity shall conduct a security assessment per state rules. Algorithm filing under the algorithm-recommendation management rules is also required, plus later amendment and cancellation procedures. Public-opinion attributes or social-mobilization capacity means the ability to affect public views or to organize and mobilize people. Providers shall mark generated content such as images and video. The measure states that when enterprises, research institutions, and others develop or apply generative AI technology and “do not provide generative AI services to the domestic public, this measure does not apply.” Violations of the measure are “punished in accordance with the Cybersecurity Law, the Data Security Law, the Personal Information Protection Law, the Law on Progress of Science and Technology, and other laws and administrative regulations.” The measure took effect on 15 August 2023 (nationwide)

Notes

This measure itself does not state fine amounts. Violations go back to the Cybersecurity Law, the Data Security Law, and the Personal Information Protection Law for penalties, which is why the grade is B. Civil cases of AI-generated content infringing others’ copyright or portrait rights were not verified against original text on the Supreme People’s Court site for this section and are not cited. Low-price resale of foreign large-model APIs via relay sites is in item 19 of this section (AI relay sites).

11.18 Do not make or distribute tools that automatically skip or block ads in other apps; even free ones may be held to be unfair competition

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Big
  • Measured in Money
Value: HighEvidence A
In plain terms

Making software that skips or blocks ads in other apps for users may get you sued for unfair competition. Not charging money may still count; the law’s “operators” include individuals who provide services. A browser that by default blocked Mango TV’s pre-roll ads paid 800,000 yuan. An App that let people jump past Mango TV’s splash ads paid 80,000 yuan in losses

Cost

No money spent. The trade-off is dropping a popular little tool. The hard part is feeling you made no money and only clicked “skip” for the user

Benefit

The law provides that operators must not use technical means to obstruct or disrupt the normal operation of network products or services lawfully provided by other operators. Operators here means natural persons, legal persons, and unincorporated organizations that provide goods or services. Harm to the other side is compensated by the other’s actual losses, or by the benefit you gained, plus reasonable expenses the other side spent to stop the infringement. Market regulators may also fine 100,000 to 1,000,000 yuan, or 1,000,000 to 5,000,000 yuan in serious cases. Official case: 720 Browser’s built-in feature by default intercepted Mango TV’s site pre-roll and pause ads. First instance dismissed Mango TV’s claim. Guangzhou Intellectual Property Court on appeal reversed, found unfair competition, and awarded 800,000 yuan in economic losses and reasonable expenses. In 2021 the Supreme People’s Court listed it as a model case. The “Lan Jingling” App let users jump past Mango TV’s splash ads. First instance ordered it to stop and pay 80,000 yuan in economic losses and 10,000 yuan in reasonable expenses. In April 2024, Beijing Intellectual Property Court affirmed on appeal. The appeal court held it had in substance blocked the splash ad, not merely clicked “skip” for the user (nationwide)

Notes

Both judgments used the pre-amendment text. After the 2025 revision this provision moved to Article 13 and also covers data, algorithms, and platform rules. The appeal courts said the finding was about blocking; users clicking “skip” themselves are unaffected. In August 2023, the free Android ad-skip tool “Li Tiaotiao” received a lawyer’s letter from Tencent. The letter said it blocked ads in Tencent Browser, constituted unfair competition, and demanded takedown within 48 hours. The developer said it was public-interest and non-profit; reports said it only took occasional tips. It still announced an indefinite pause in updates, and several similar apps stopped too. This matter has only media reports, no lawsuit and no judgment. An individual developer who gets a lawyer’s letter either stops or pays for a lawyer to defend. First-instance ordinary procedure is to be finished within 6 months by rule, and can be extended; lawyer fees are generally paid by yourself. Writing a script only for yourself — no pursued cases found. Selling ticket-snatching software and paying for unfair competition is in item 3 of this section (ticket-snatching and flash-sale scripts). The beneficiary is you yourself.

11.19 Do not build an “AI relay site” that resells foreign large-model APIs at low prices: a Shanghai site operator has already been criminally detained

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Big
  • Measured in Freedom
Value: HighEvidence C
In plain terms

An AI relay site is a website that resells foreign large-model APIs at low prices. A Shanghai site operator said he was criminally detained for 37 days for this, is now on bail, will definitely be sentenced, and has already returned illicit gains. The Ministry of State Security has also issued a warning that some relay sites lack operating qualifications and some privately send user data abroad

Cost

No money spent. The trade-off is dropping a low-barrier side business that looks good on paper. If you truly want model aggregation, go the proper route — get operating permits and connect officially authorized models; that costs both money and time

Benefit

In June 2026 the Ministry of State Security issued a risk warning. It said AI relay sites are a proxy layer between users and model vendors’ official services. Some relay sites lack operating qualifications. Some, without data-export compliance credentials and without the statutory security-assessment process, send user-input data to servers abroad. Some also let users bypass network-access, official-authorization, and cross-border transmission limits. China Newsweek reported a case in June 2026. In May 2026, a Shanghai relay-site operator posted a shutdown notice in a tech community. He said that for illegally obtaining large-model APIs he had been criminally detained by Shanghai police for 37 days and was now on bail. He said he “will definitely be sentenced,” had already returned illicit gains, and would still pay a fine. The report said such relay sites bulk-register or buy foreign large-model subscriptions, host overseas servers as jump hosts, and resell to domestic users at low prices (nationwide / Shanghai)

Notes

This case has only media reports and the party’s own account — no judgment and no police bulletin — so there is no official statement of the charge. Specific charges and sentences circulating online come from lawyers’ articles and are not cited here. So one cannot say “running a relay site is always a crime,” only that someone has already been criminally detained for it. Doing model aggregation properly requires an operating permit to charge fees; see Section 26, item 2 (fee-charging sites need a license). Offering generative AI to the public needs filing; see item 17 of this section (generative-AI security assessment). Sending user data abroad has statutory conditions; see Section 26, item 10 (user information leaving the country). Users of relay sites have separate risks; see Section 14, item 10 (AI relay sites). The beneficiary is you yourself.

11.20 Do not write, sell, or distribute crack patches, keygens, or cracked software; once sales hit the numbers, it is sentenced as copyright infringement

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Big
  • Measured in Freedom
Value: HighEvidence A
In plain terms

Registration-code checks, dongles, and similar verification are a software’s technical measures; bypassing them without permission is infringement, and you must pay even if you charge nothing. Cracking or selling crack tools for profit — earning 30,000 yuan or selling 50,000 yuan — is enough for a criminal sentence, up to 10 years. Someone who made cracked dongles paired with pirated software for sale saw three co-defendants get between 1 year and 3 years 2 months

Cost

No money spent. The trade-off is dropping fast money from selling cracks, registration codes, or cracked dongles. Do not post crack patches to forums or cloud drives either. The hard part is that cracking looks like technical work, not like theft

Benefit

Civil side first. The Copyright Law allows rights holders to add technical measures to works. Technical measures are effective technology, devices, or components that prevent or restrict others from using a work without permission. Without the rights holder’s permission, no one may intentionally bypass or destroy technical measures. No one may manufacture, import, or provide to the public related devices or components for bypassing technical measures. No one may intentionally provide technical services to others for bypassing technical measures. Computer software is a work; doing any of these is infringement and requires stopping the infringement and paying damages. Damages are by the rights holder’s actual losses or what you earned. If that cannot be calculated, refer to what a normal license would cost. Intentional infringement with serious circumstances brings 1 to 5 times. If public interest is also harmed, the copyright authority may confiscate illegal gains. Illegal business volume of 50,000 yuan or more may be fined 1 to 5 times that amount. Below 50,000 yuan or if the amount cannot be calculated, a fine of 250,000 yuan or less is possible. Criminal side next. Amendment (XI) to the Criminal Law wrote “intentionally bypassing or destroying technical measures” into the crime of copyright infringement, on the premise of profit. Illegal gains of 30,000 yuan or more, or illegal business volume of 50,000 yuan or more, bring up to 3 years, with a fine concurrently or alone. At 10 times those figures, the sentence is 3 to 10 years plus a fine. Someone who knows another person is committing copyright infringement and still provides devices, components, or technical services mainly used to bypass or destroy technical measures faces the same crime once the same thresholds are met. Official case 1: From March 2019 to July 2022, Liu made “dongles” that could bypass software technical measures for profit. He also copied pirated software and sold it together with the dongles. His illegal business volume was over 1,060,000 yuan. Shanghai No. 3 Intermediate People’s Court found especially serious circumstances and sentenced him for copyright infringement. The Supreme People’s Procuratorate said this was the first nationwide “intentionally bypassing or destroying technical measures” copyright-infringement case after Amendment (XI) took effect. In April 2023, Shanghai courts sentenced the three defendants in this string of cases to between 3 years 2 months and 1 year, some suspended, with fines from 700,000 to 80,000 yuan. Official case 2: Medical-equipment repair worker Liu spent 80,000 yuan in a QQ group to buy 50 cracked dongles, then resold them online for a few thousand yuan each. Plugging one in bypassed the medical equipment’s identity check and entered the maintenance software. Shanghai Putuo court sentenced him to 1 year 2 months, suspended, plus an 80,000 yuan fine. Official case 3: From May 2021, Li and others in Xuzhou had crack programs made for game machines and produced crack devices to sell. Illegal business volume was over 39,000,000 yuan. In November 2024, 10 people were sentenced to between 3 years 6 months and 2 years 6 months, some suspended, with fines from 11,000,000 to 1,500,000 yuan (nationwide)

Notes

The beneficiary is you yourself. The Copyright Law leaves a few openings: testing the security of computer systems and networks, and doing encryption research or software reverse-engineering research, may bypass technical measures. But the same article says you must not provide the bypassing technology, devices, or components to others. So your own research is fine; distributing or selling is not. Free distribution of crack patches does not meet the crime of copyright infringement, because that crime requires profit. Civil infringement still stands; the software company can send a lawyer’s letter and sue for damages. Litigation first-instance ordinary procedure is to be finished within 6 months by rule, and can be extended; lawyer fees are generally paid by yourself. Putting a whole cracked software package online for download counts as disseminating a work without permission; the criminal threshold is in Section 9, item 24 (sharing cloud-drive resources). Game cheats that bypass anti-cheat are in item 2 of this section (game cheats and aids).

11.21 Do not help launch DDoS traffic attacks; do not sell or rent “stress-test” traffic platforms; if you lose a game, do not attack the other side’s servers either

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Big
  • Measured in Freedom
Value: HighEvidence A
In plain terms

Using DDoS so others’ websites, servers, or games cannot open is the crime of destroying a computer information system. Serious consequences bring up to 5 years; especially serious consequences bring 5 years or more. People who pay a platform to attack are also joint offenders. Someone who ran a DDoS site collecting membership fees and taking orders got between 10 months and 5 years 6 months

Cost

No money spent. DDoS means controlling many machines to send requests at a target at once until the server is unusable. The trade-off is dropping a per-hit or packaged traffic business, and also holding back a moment of anger. When conflict arises in a game or in business, use reports, complaints, and police reports — do not pay someone to attack

Benefit

Interfering with the functions of a computer information system so it cannot run normally, with serious consequences, brings up to 5 years of fixed-term imprisonment or criminal detention. Especially serious consequences bring 5 years or more. Courts treat DDoS as the “interference” here. “Serious consequences” has several standards. One is that the main software or hardware of 10 or more computer information systems cannot run normally. One is illegal gains of 5000 yuan or more, or economic losses of 10,000 yuan or more. Another is that a system serving 10000 or more users cannot run normally for a cumulative 1 hour or more. Machine counts or money amounts at 5 times those figures count as especially serious consequences. Knowing someone is committing such destruction and still providing programs or tools for destruction is punished as joint crime. The threshold is illegal gains of 5000 yuan or more, or providing to 10 person-times or more. Providing server hosting, technical support, and similar help with illegal gains of 5000 yuan or more is the same. Providing programs or tools specially used to intrude upon or illegally control computer information systems — at 20 person-times or more, or illegal gains of 5000 yuan or more — brings up to 3 years and a fine concurrently or alone. Below the criminal threshold, interfering with computer information system functions or providing such tools, when harm results, brings detention of up to 5 days, or 5 to 15 days if more serious. Official case 1 (Prosecutorial Example No. 69): In early 2017, Yao Xiaojie and others were hired to form the “Dark Night Group” abroad. They bought large amounts of server resources and used malware to launch DDoS. They attacked three times the IPs of three game companies on a cloud of an internet company; games could not log in and users dropped frequently. The victim company spent over 40,000 yuan on emergency repair. In June 2018, Shenzhen Nanshan court sentenced 11 people to 1 to 2 years for destroying a computer information system. Official case 2: In March 2017 Tang and Wang built a DDoS website that could top up membership and submit attack tasks. They took orders and launched traffic attacks on over 80 target IPs. Nantong Haimen court sentenced Tang and others to between 10 months and 5 years 6 months for destroying a computer information system. Zhang, who ordered attacks on that site to suppress competitors, submitted over 100 attack tasks against 11 IPs or domains of rival companies. The court found the orderers and the site operators were joint offenders. The orderer was the one who initiated and was a principal offender. Official case 3: Wang built a DDoS platform and sold attacks under clear “bronze,” “silver,” “gold,” and “diamond” packages. Beijing Haidian procuratorate charged him with illegally using information networks; in 2020 first instance he got 1 year and a 50,000 yuan fine (nationwide)

Notes

The beneficiary is you yourself. These platforms wear a “stress test” label. Testing your own system, or a system the other side has authorized you in writing to test, is a stress test. Hitting others’ servers is the same idea as item 9 (do not test others’ systems without written authorization). Which charge applies to running a platform that takes orders is not uniform across places. The Haimen case used destroying a computer information system, with a top of 5 years 6 months; the Haidian case used illegally using information networks and got 1 year. A People’s Court Daily commentary said practice is not entirely consistent, and the case library treats it as destroying a computer information system. In Prosecutorial Example No. 69, the attacked internet company filed a report. Public security sent the electronic data it provided to the Guangdong branch of CNCERT/CC for analysis, which found 14 control-end servers. Chat logs and bank records confirmed the purchase of control over those servers. Selling malware that controls others’ computers is in item 8 of this section (do not run your programs on others’ machines).
