10 Is dating and marriage worth it
This section splits "is marriage worth it" into separate accounts for money, time, health, legal risk, and relationship quality, and counts them apart. Each account uses only figures whose source can be checked. Sources are limited to official statistics, or to meta-analyses (pooling data from many studies and recalculating them). There is no moral judgment here, and no conclusion is made for you. The health accounts are counted as death risk, the time accounts as how many minutes a day, and the legal accounts as what the articles say. These three ways of counting are not converted into each other. The method for splitting the accounts, a fill-in checklist, and common mistakes are in docs/结婚划不划算.md.
Items in this section are grouped by topic below, with item numbers in parentheses.
Finding someone and dating: meet more people (item 1), stop after the other person refuses (item 2), judge interest from behaviour (item 3), take turns answering questions that go from light to deep (item 5), a long-distance relationship is not worse than one in the same city (item 6).
Whether the relationship is good: look at how you feel inside it (item 4), argue about the matter not the person (item 17), go to couples therapy together (item 20).
The accounts of whether marriage is worth it: look at the registration figures first (item 7), discount the health benefit because the data are observational (item 8), count the time account as unpaid labour (item 9), count the cost of leaving (item 15), keep a separate account of marrying for your elders (item 16), when divorcing write child support and visitation clearly (item 23).
Registering and the premarital check: registering needs only an identity card (item 13), have one premarital medical check (item 14), go and get the marriage certificate even after the banquet (item 21).
Money and debt: look first at the law's default rules for the money account (item 10), when parents pay for a home write down whether it is a loan or a gift (item 11), a large sum borrowed by one spouse (item 12), a spouse using joint money to tip streamers or transfer to someone outside the marriage (item 22).
Same-sex partners and sexual orientation: same-sex partners should put voluntary guardianship and a will in place (item 18), do not marry by hiding sexual orientation (item 19).
Items in this section (23)
- 10.1 Meet more people instead of fixating on one: you cannot predict whether two people will get along before you meet
- 10.2 Stop after a clear refusal — continued pursuit is a public-order offence, not “sincerity”
- 10.3 To judge whether the other person is interested, watch behaviour not “signals”: who initiates, who arranges, who follows up
- 10.4 Whether a relationship is good depends mainly on how you feel in it, not on the other person’s attributes
- 10.5 To close distance, take turns answering a set of questions that go from light to deep — do not learn scripts
- 10.6 Long-distance relationships are not worse than same-city ones; the real hurdle is the first three months after moving in together
- 10.7 Look at the registration figures before listening to elders: what the marriage rate and divorce rate each mean
- 10.8 Count marriage’s health benefit in, but discount it as observational data
- 10.9 Count the time as “unpaid work” and settle who does what before you register
- 10.10 For marriage’s money account, look first at the law’s default rules, then decide whether to make a written agreement
- 10.11 When parents pay for a home, write down at the transfer whether it is a loan or a gift
- 10.12 A large sum one spouse borrows is not automatically your debt if you did not sign and did not later acknowledge it
- 10.13 Registering needs only an identity card plus a signed statement — no household register, no fee, certificate issued on the spot
- 10.14 Have one premarital medical check before marriage; a serious disease must be truthfully told to the other person before registration
- 10.15 Count the cost of leaving: negotiated divorce has a 30-day cooling-off period; litigated divorce has statutory conditions
- 10.16 Keep a separate account for “marrying for your elders”; do not mix it with your own account
- 10.17 Treat relationship quality as a health account: argue about the matter not the person — no name-calling, no sarcasm
- 10.18 While both of you are still clear-headed, same-sex partners should put in place an authorization of agency, voluntary guardianship, and a will: in law you are not near relatives; without these you have no signing right and no inheritance right
- 10.19 Do not marry by hiding sexual orientation, and do not treat a marriage of convenience as an easy fix: in law it is a real marriage, and the only exit is divorce
- 10.20 When a relationship is stuck in repeated arguments and cold wars, go to couples therapy together: waiting it out almost never fixes itself
- 10.21 Even after the wedding and the banquet, go and get the marriage certificate: without registration you are not spouses in law, and if the other person dies you have no spouse’s right of inheritance
- 10.22 When a spouse, behind your back, uses large amounts of joint marital money to tip streamers or transfer it to someone outside the marriage: you can ask to divide joint property without divorcing, and money sent outside the marriage can be sued for return
- 10.23 When a couple with a minor child divorces, write into the divorce agreement who the child lives with, how much monthly support is, and the form and times of visitation: the more specific the writing, the fewer later lawsuits after divorce
10.1 Meet more people instead of fixating on one: you cannot predict whether two people will get along before you meet
- Money No cost
- Time Hours
- Willpower Some
- Benefit Medium
- Measured in Time
- In plain terms
Two speed-dating studies had people fill out more than 100 partner-preference questionnaires before any meeting. The questionnaires could only show who tends to like others in general and who tends to be popular. They could not show whether these two people would click. Whether you get along is known only after you meet. So meeting more people is a better bet than staking everything on one person.
- Cost
No money. Spend the time meeting several people, not repeatedly turning over the same one. The hard part is resisting fixation.
- Benefit
In two speed-dating studies, participants filled out more than 100 self-report scales related to partner choice before meeting. Researchers used a random-forest model (an algorithm for finding patterns) to calculate. They could calculate “how easily a person likes others overall”; these questionnaires accounted for 4%–18% of the variance. Variance is the difference between people; the questionnaires explain only a small part of it. They could also calculate “how popular a person is overall,” accounting for 7%–27%. But “whether these two specific people click” could not be calculated; no combination of pre-meeting traits and preferences worked. The same researchers earlier ran another speed-dating experiment. Participants reported their own ideal-type preferences beforehand, such as valuing looks or economic prospects. That preference did not predict their interest in a specific person on the spot.
- Notes
The two studies only show that “you cannot calculate it before meeting,” not that “no effort helps.” Whether you get along is known only after you meet, so spending time meeting several people, and really meeting each one, is a better bet than staking everything on one person. The study samples were Western university students. China’s dating and marriage setting is different; discount when applying this to yourself.

- In plain terms
If the other person has clearly refused and you still send messages repeatedly or wait for them, and you interfere with their normal life, from January 2026 that is a public-order offence. You can be detained for up to 5 days, or fined up to 1000 yuan. For more serious cases, detention is 5 to 10 days. Police can also order you not to contact the person; violating that brings another 5 to 10 days of detention.
- Cost
No money and no time. The hard part is stopping: no more messages, no more waiting for the person.
- Benefit
The Public Security Administration Punishments Law, in force from 1 January 2026, lists entanglement and stalking as a separate item. The text covers “repeatedly sending obscene, insulting, or threatening information, or using harassment, entanglement, stalking, or similar methods to interfere with another person’s normal life.” The act is punishable by detention of up to 5 days, or a fine of up to 1000 yuan. For more serious cases, detention of 5 to 10 days, and a fine of up to 1000 yuan may be added. There is a further layer: with approval from a public-security responsible official, the actor can be ordered not to contact the victim for a set period. Violating that order brings another 5 to 10 days of detention.
- Notes
“Chasing to the end will move the other person” has no research support, but detention and no-contact orders are in black and white. Such offence records are to be sealed and not provided or made public to ordinary units and individuals, though relevant units may query them under state rules. The law looks at whether you repeatedly harassed, entangled, or stalked and interfered with the person’s normal life, not at what you meant. Continuing after a clear refusal is the situation most easily treated as interference; that last sentence is the author’s judgment.

10.3 To judge whether the other person is interested, watch behaviour not “signals”: who initiates, who arranges, who follows up
- Money No cost
- Time Minutes
- Willpower Some
- Benefit Medium
- Measured in Time
- In plain terms
When strangers of opposite sex talk for about ten minutes and then judge each other, “the other person was not flirting” is judged fairly accurately, while “the other person was flirting” is hard to see. So do not conclude from faces and tone in one chat alone. People who like someone more are more likely later to message and suggest meeting, but that link is weak.
- Cost
No money, and little time. The hard part is changing the habit: stop reading faces and tone, and start recording facts.
- Benefit
Two studies measured how accurately people spot flirting. The first had 52 pairs of opposite-sex strangers talk for 10 to 12 minutes. Afterward each reported whether they had been flirting and whether they thought the other had. The result was that interactions with no flirting were judged more accurately, and interactions with flirting were judged worse. The second used 26 one-minute videos judged by 261 bystanders, with the same conclusion. People can fairly reliably see “the other person was not flirting,” but struggle to see “the other person was flirting.” A third study looked at behaviour. It pooled three speed-dating sessions, 559 people and more than 6600 dates, then followed up. The more distinctive one person’s liking for a given partner at the meeting, the more they later messaged and asked that person out. The average correlation for such links was about 0.15 (a weak association). That shows interest lands in behaviours like initiating contact and suggesting meetings. But this study did not compare behaviour against faces and tone for accuracy.
- Notes
Disputed: Other research argues it is not that men overestimate women’s sexual intent, but that women under-report their own intent on questionnaires. Who judges more accurately is still unsettled. The first two studies did not measure behavioural cues. The third shows liking lands in messaging and asking someone out. But “behaviour is more accurate than faces and tone” has not been compared head-on in research; that is the author’s inference. The author suggests watching whether the other person initiates, arranges the next meeting, and follows up even when you do not push.

10.4 Whether a relationship is good depends mainly on how you feel in it, not on the other person’s attributes
- Money No cost
- Time Minutes
- Willpower Some
- Benefit Medium
- Measured in Time
- In plain terms
What best shows whether a relationship is good is how you feel, not the other person’s attributes. For example, whether you feel the other person is serious and appreciates you, and how much you argue. Your own feelings are two to four times as useful as what your partner says. But whether the relationship later gets better or worse, basically no questionnaire can calculate.
- Cost
No money, and little time. The hard part is changing the angle: put away the partner checklist and look at how you get along.
- Benefit
A machine-learning analysis of 29 labs and 43 longitudinal paired datasets — longitudinal means following the same couples over time — found that the strongest predictors of relationship quality all came from how each person felt about the relationship: sensed commitment from the other, appreciation, sexual satisfaction, sensing the other’s satisfaction, and conflict. Among person-level items the strongest were life satisfaction, negative emotion, depression, avoidant attachment, and anxious attachment. These relationship items explained at most 45% of the variance at the start of the survey. Variance here is the difference in relationship quality between couples; 45% is the part those items can account for. By the end of the study they explained at most 18%. And the predictive power of “items you report yourself” was two to four times that of “items your partner reports.” Adding individual differences and the partner’s reports on top of your own relationship feelings added no further predictive power. Whether the relationship got better or worse during the study was largely unpredictable from any set of self-report measures; the original wording is “largely unpredictable from any combination of self-report variables.”
- Notes
To judge whether this relationship is good right now, asking how you feel is more accurate than checking the other person’s attribute list, but do not expect to predict how it will go later. The account that links relationship quality to physical health is in item 17 of this section (treat relationship quality as a health account).

10.5 To close distance, take turns answering a set of questions that go from light to deep — do not learn scripts
- Money No cost
- Time Minutes
- Willpower None
- Benefit Small
- Measured in Time
- In plain terms
Two strangers who take turns answering 36 questions that go from light to deep feel closer after 45 minutes than people who only make small talk for the same time. What works is taking turns telling the truth and going deeper layer by layer, not scripts. This only shows greater closeness at the time, not that it becomes a long-term relationship.
- Cost
No money. It takes 45 minutes.
- Benefit
Pair two strangers and have them take turns answering three sets of progressively deeper questions, 36 in all. Questions range from “Who would you most like to invite to dinner” to “When was the last time you cried in front of someone.” Closeness after 45 minutes was significantly higher than in a control group that made small talk for the same time. It was also higher than the average rating university students in that study gave their closest real-life relationships.
- Notes
Only one experiment, with university students, measuring short-term closeness only, not whether it becomes a long-term relationship. The closeness in the experiment came from two people taking turns, layer by layer, saying real things about themselves — not from scripts, routines, or one-sided performance. So what works in conversation is “I say something real, and I ask something equally deep,” taking turns.

10.6 Long-distance relationships are not worse than same-city ones; the real hurdle is the first three months after moving in together
- Money High
- Time Daily
- Willpower A lot
- Benefit Medium
- Measured in Time
- In plain terms
While apart, long-distance relationships are actually more stable; research attributes this to idealizing the other person more than reality, and the less you meet the more idealized they become. The real hurdle is after you move in together. In follow-up data about half of long-distance couples reached the same-city step; the other half ended while still apart. Of the half who reunited, one third broke up within 3 months.
- Cost
Travel costs, plus time on the road. You meet less often than same-city couples. The hard part is lasting through not seeing each other.
- Benefit
Two studies reach the same conclusion. Long-distance relationships are more stable while apart than same-city ones. The reason is that idealization of the partner is markedly higher in long-distance relationships; the studies measured idealized distortion, romantic love, relationship memories, and perceived agreement. And the less often you meet, the more idealized the picture. But that stability holds only while both sides remain apart; once they become same-city, former long-distance couples are more likely to break up. The study that tracked long-distance to same-city gave these shares: about half of long-distance couples reached moving in together; the other half ended while still apart. Of the half who reunited, one third broke up within 3 months after reunion. Changes participants reported after reunion included: loss of autonomous space, knowing more of both the good and the bad about the other person, hard-to-arrange time, and more conflict and jealousy. Longer gaps between meetings while apart and stronger idealization meant less stability after reunion.
- Notes
The sample was romantic relationships among US university students, not marriages, and from an earlier period; do not apply the absolute shares directly. Another study surveyed 717 long-distance and 425 same-city people. Quality differences between the two kinds of relationship were small; whether a relationship is good depends mainly on each person’s situation and the relationship itself, not on distance. So when deciding on long distance, do not use “long distance always ends” as the reason. What to prepare for is the months after reunion, when autonomous space shrinks, mutual knowledge grows, and conflict and jealousy also grow.

10.7 Look at the registration figures before listening to elders: what the marriage rate and divorce rate each mean
- Money No cost
- Time Minutes
- Willpower None
- Benefit Small
- Measured in Time
- In plain terms
In 2024 there were 6106000 marriage registrations nationwide, down about one fifth from the year before, and 3513000 divorces. Online claims that the divorce rate is over half take these two numbers and divide them, about 57.5%. But the people divorcing and the people marrying are not the same group, so it cannot be read as half of marriages ending. The bulletin’s marriage rate of 4.3‰ and divorce rate of 2.5‰ are divided by the national population.
- Cost
No money. Read the marriage-registration paragraph in the Ministry of Civil Affairs annual bulletin; a few minutes.
- Benefit
In 2024, 6106000 couples completed marriage registration nationwide under law, down 20.5% from the previous year, with a marriage rate of 4.3‰. In the same year, 3513000 couples completed divorce procedures under law, of which 2622000 were divorce registrations at civil-affairs departments and 891000 were court judgments or mediated divorces. The divorce rate was 2.5‰. The bulletin notes that the marriage (divorce) rate = number of marriage (divorce) couples that year / average total population that year × 1000‰. This is a “crude rate”; the denominator is the whole population, not the married population.
- Notes
The common online claim of a “divorce rate above 50%” divides that year’s divorce couples by that year’s marriage couples, 351.3 / 610.6 ≈ 57.5%. That is a “divorce-to-marriage ratio.” The two numbers are not the same people, and the bulletin has no such indicator, so it cannot be read as “half of marriages end.” To calculate “the probability that a marriage eventually ends in divorce,” you have to follow the same cohort of marriages over time; this section found no official data of that kind.

10.8 Count marriage’s health benefit in, but discount it as observational data
- Money No cost
- Time Minutes
- Willpower None
- Benefit Small
- Measured in Lifespan
- In plain terms
Among older adults, married people’s probability of dying in the same period is about 12% lower than non-married people’s, and never-married people’s is about 24% higher than married people’s. But that is only two things occurring together; you cannot tell whether marriage caused it. These figures are mostly from Europe and North America; for China they are only an order-of-magnitude reference.
- Cost
No money and no time. Just remember one point: these figures say married people have lower mortality in the same period — two things occurring together; you cannot tell whether marriage made you live longer.
- Benefit
A meta-analysis of older adults pooled multiple studies and recalculated them, covering 53 comparisons and more than 250,000 people. All were cohort studies — follow-up only, with no assigned comparison groups. Married versus non-married all-cause mortality RR 0.88, 95% CI 0.85–0.91 (RR is the risk ratio; CI is the credible range), about 12% lower probability of dying in the same period. In the same analysis, widowed 1.11, divorced or separated 1.16, never married 1.11 — about 11%, 16%, and 11% higher respectively. No difference by sex. The most conservative estimate was RR 0.94, only about 6% lower. Another meta-analysis compared never-married versus married, using 95 papers and more than 500,000,000 people. Result HR 1.24 (1.19–1.30), about 24% higher probability of dying in the same period. And the older the age, the smaller the gap. A further meta-analysis split by sex, 21 studies and more than 7,890,000 people: for both sexes, non-married status co-occurred with total mortality, cancer death, and cardiovascular death. On the male side the gaps for cardiovascular death and total mortality were larger. Never-married men versus never-married women had 31% more stroke deaths and 9% more all-cause deaths.
- Notes
Disputed: The controversy is that people who marry may already be selected — for example, healthier people may be more likely to marry. That is the author’s inference from study design; none of the three meta-analyses measured how large selection is. All three used observational data from existing populations — follow-up only, no assigned comparison groups. The authors themselves noted publication bias or method limits. Roelfs also found that the more rigorous the study, the smaller the gap calculated. These figures are mainly from European and North American samples; for China they are only an order-of-magnitude reference.

10.9 Count the time as “unpaid work” and settle who does what before you register
- Money No cost
- Time Hours
- Willpower Some
- Benefit Big
- Measured in Time
- In plain terms
The national time-use survey measured unpaid work such as housework and accompanying or caring for family. Among people who did such work that day, men averaged 1 hour and 52 minutes a day, and women 3 hours and 29 minutes. The survey was not broken down by marital status, so there is no official figure for how much housework increases after marriage; this gender gap can only serve as an upper-bound reference. Division of labor can be negotiated into a different shape before you register.
- Cost
There is no monetary cost. Spend one or two hours before marriage to reach a clear agreement on how household chores, childcare, elder care and whose job gives way — all unpaid work — will be divided between partners, then follow that plan. The real challenge lies in having the conversation, not in avoiding it.
- Benefit
The 2024 National Time Use Survey tracks unpaid labor, which includes housework and family care. On average, people who perform such tasks spend 2 hours and 45 minutes daily on them; men dedicate 1 hour and 52 minutes, women 3 hours and 29 minutes. The proportion of individuals engaging in unpaid labor each day is 67.5% among men and 83.9% among women. Nationwide, residents spend an average of 1 hour and 17 minutes daily on housework; among those who actually do it, the average rises to 1 hour and 59 minutes — a decrease of 28 minutes compared to 2018. Time spent caring for family averages 30 minutes per day; for those involved, it reaches 1 hour and 46 minutes. In 2018, men spent 45 minutes on housework and 17 minutes on childcare, while women spent 2 hours and 6 minutes on housework and 53 minutes on childcare.
- Notes
Both surveys analyzed data only by gender, urban/rural residence, and age; marital status was not considered. Consequently, no official statistics exist on how much housework increases after marriage; the gender disparity can only be used as a rough upper bound. These figures represent national averages, but couples are free to negotiate a division of labor that suits them.

10.10 For marriage’s money account, look first at the law’s default rules, then decide whether to make a written agreement
- Money No cost
- Time Hours
- Willpower Some
- Benefit Big
- Measured in Money
- In plain terms
Without a written agreement, the law’s default is that wages and bonuses earned after marriage, business and investment returns, and inherited or gifted property are jointly owned. Premarital property, and property a will or gift contract says is for one side only, is personal. The two of you can agree in writing that each keeps their own; once signed it binds. The side that put in more for raising children or caring for elders can claim compensation at divorce.
- Cost
No money. Read the Civil Code marriage-and-family book articles on property. If needed, the two of you sign a written property agreement; the law only requires it in writing, not notarization. The hard part is talking about money in advance.
- Benefit
The default rules without a separate agreement are: wages, bonuses, and labor remuneration earned after marriage, returns from production, business, and investment, intellectual-property returns, and inherited or gifted property belong to both spouses jointly (Article 1062). Premarital property, personal-injury compensation, property a will or gift contract clearly gives to one side only, and articles for one person’s exclusive daily use are personal property (Article 1063). The two sides may agree in writing that premarital and postmarital property belongs to each separately, to both jointly, or partly separately and partly jointly. That agreement binds both sides in law (Article 1065). A side that bears more duty because of raising children, caring for elders, or assisting the other side’s work has the right to claim compensation at divorce (Article 1088).
- Notes
There are no official statistics for betrothal gifts, weddings, or marital homes; this item does not write figures. How much compensation under Article 1088 is first negotiated by the two sides; if they cannot agree the court decides; there is no fixed formula. A written property agreement helps both sides: the higher earner can use it, and so can the side that does more unpaid housework and care.

10.11 When parents pay for a home, write down at the transfer whether it is a loan or a gift
- Money No cost
- Time Minutes
- Willpower None
- Benefit Big
- Measured in Money
- In plain terms
Money parents put toward a home before marriage is, by default, only for their own child. Money put in after marriage with no agreement is treated as joint marital property. From February 2025, if one side’s parents paid the full amount during the marriage and did not write that it was only for their own child, at divorce the court may award the home to that child and then decide whether to compensate the other side. To treat it as a loan, write it clearly that day and have both sides sign.
- Cost
No money. On the day of the payment write one page stating whether the money is a gift to whom or a loan to whom, signed by the contributing parents and the child. If it is a loan, have both spouses sign, and put the same wording in the transfer note.
- Benefit
Parents’ contribution toward a home for the couple before marriage is treated as a gift to their own child personally, unless the parents clearly say it is a gift to both. Contributions after marriage follow any agreement. With no agreement or an unclear one, they are handled under joint marital property. From 1 February 2025 there is a further rule. Where during the marriage one side’s parents paid the full amount and the gift contract did not say it was only for their own child, at divorce division the court may award the home to the contributing parents’ child. After that award it weighs several facts to decide whether to compensate the other side and how much: cohabitation and birth of common children, divorce fault, contribution to the family, and the home’s market price at divorce. Where one side’s parents paid part, or both sides’ parents paid, award to one side is based on the source and share of funds, with reasonable compensation (nationwide).
- Notes
Writing it clearly helps both sides. Contributing parents need no longer count on adding a loan note at divorce to protect the contribution. After Interpretation (II) took effect, who paid the money is itself a basis for dividing the home, not only whose name is on the title. The side receiving the money also need not wait until divorce to learn what the money counts as. If you mean a loan, treat it as a loan: both sides agree it is a loan, agree how to repay, write it on the transfer, and keep repayment records when needed. Missing any of these means explaining in court.

10.12 A large sum one spouse borrows is not automatically your debt if you did not sign and did not later acknowledge it
- Money No cost
- Time Minutes
- Willpower Some
- Benefit Big
- Measured in Money
- In plain terms
Money a spouse borrowed behind your back is not automatically your debt if it clearly exceeds ordinary household spending and you did not sign and did not later acknowledge it. The creditor must prove the money went to joint life or joint business. But for home-purchase money that really became a home you live in together or own jointly, the other side can often prove that layer.
- Cost
No money. Do not sign a spouse’s loan note or guarantee as “co-borrower” or “guarantor.” Also do not write in chat “we will repay this” or similar; that can be treated as you later acknowledging the debt. The hard part is not answering when pressed.
- Benefit
Debt in the following situations is joint marital debt. First, both spouses signed. Second, one side later acknowledged it — both accept the debt. Third, one side during the marriage borrowed in their own name for ordinary family daily needs. Money one side borrowed in their own name that clearly exceeds ordinary household spending is not joint marital debt. The exception is when the creditor (the party seeking repayment) can prove the money was used for the couple’s joint life, joint production or business, or was acknowledged by both. Home-purchase money clearly exceeds ordinary daily family needs; the burden of proof is on the side asserting the claim — the creditor must produce evidence. But if that money really became a home the couple live in together or own jointly, the creditor can often prove the “used for joint life” layer. So what actually helps is the step in item 11 (when parents contribute, write whether it is a loan or a gift) (nationwide, from 2021).
- Notes
When dividing property at divorce, if the other side’s parents suddenly produce a loan agreement signed only by your spouse, look at two steps. First, whether the loan really happened. If you say the money was never handed over and can make the reason hold, the court will weigh several facts together: the loan amount, how the money was delivered, both sides’ means, how they usually transact, whether property moved accordingly, and what witnesses say. If the other side only has a transfer voucher, they still must prove the loan was established. Second, after the loan is established, whether it is joint debt. General rules for loan notes and guarantees are in Section 8, item 18.

10.13 Registering needs only an identity card plus a signed statement — no household register, no fee, certificate issued on the spot
- Money No cost
- Time Minutes
- Willpower None
- Benefit Small
- Measured in Money
- In plain terms
From May 2025, registering needs two things: your own identity card, plus a signed statement. The statement says you have no spouse, and that you and the other person are not lineal blood relatives or collateral blood relatives within three generations. You do not bring the household register, and you need not go back to one person’s place of household registration. Registration costs nothing; if you meet the conditions, the certificate is issued on the spot.
- Cost
No money. Both people must appear in person. It usually takes a few tens of minutes.
- Benefit
The new marriage-registration regulation, in force from 10 May 2025, changed the materials inland residents must produce to marry. The text says only two things need be produced: “(1) the person’s resident identity card; (2) a signed statement that the person has no spouse and has no lineal blood relationship and no collateral blood relationship within three generations with the other party.” The household register is no longer required. The registration authority is “the civil-affairs department of the county-level people’s government, or a township (town) people’s government designated on the principle of convenience by the people’s government of the province, autonomous region, or municipality directly under the central government.” The old regulation’s limit of going “to the place of permanent household registration of one of the parties” has been removed. The regulation also says “the marriage-registration authority shall not charge a fee for handling marriage registration,” and “where the parties meet the conditions for marriage, registration shall be made on the spot and a marriage certificate issued.” The situations for refusing registration are four: “(1) not yet of statutory marriage age; (2) not the complete voluntary will of both the man and the woman; (3) one or both already have a spouse; (4) lineal blood relatives or collateral blood relatives within three generations.”
- Notes
The registration authority refuses only in four situations: not yet of statutory marriage age, not both completely voluntary, one or both already have a spouse, or the two are lineal blood relatives or collateral blood relatives within three generations. The only possible charges are peripheral services such as photos and copies. Registration itself costs nothing; if you meet “document fees” or “expedite fees,” refuse and complain. The 30-day cooling-off period for divorce registration is in item 15 of this section (cost of leaving). Consequences of holding only a wedding without registering are in item 21 of this section (go and get the marriage certificate even after the banquet).

10.14 Have one premarital medical check before marriage; a serious disease must be truthfully told to the other person before registration
- Money Low
- Time Minutes
- Willpower None
- Benefit Medium
- Measured in Lifespan
- In plain terms
If you have a serious disease and did not truthfully tell the other person before registration, the other person can ask a court to revoke the marriage. The request must be made within one year of knowing. The premarital check itself has not been a precondition for registering since 2003; going is voluntary. Fees follow local policy; it takes half a day.
- Cost
In most places free or reduced for people of eligible age. Self-pay is only a few hundred yuan. It takes half a day.
- Benefit
The legal consequence of concealment is clear. The new marriage-registration regulation provides that “where one party has a serious disease, that party shall truthfully inform the other party before marriage registration; where that is not done truthfully, the other party may, under Article 1053 of the Civil Code, ask a people’s court to revoke the marriage.” The state treats the premarital check as the first gate in preventing birth defects. The current targets are that “the premarital medical examination rate and the coverage rate of the target population for pre-pregnancy eugenic health checks remain above 70% and 80% respectively.” The document also requires “promoting premarital medical examination institutions and marriage-registration places being sited near each other for public convenience,” and promoting “one-stop” service for “marriage registration, premarital medical examination, and fertility guidance.” The Civil Code provides that a party with a serious disease shall truthfully inform before marriage registration; if not, the other party may ask a people’s court to revoke the marriage. A request to revoke must be made within one year of the day the person knew or should have known the ground for revocation. The premarital check is not a precondition for registering. A 2022 reply by the Tai’an Municipal Health Commission to a CPPCC proposal stated: “While the 2003 Marriage Registration Regulation cancelled ‘mandatory premarital checks,’ it also made clear that marriage-registration authorities must not attach other duties when handling registration.” Article 8 of the current regulation’s list of marriage-registration materials also has no premarital-check certificate.
- Notes
Since 2003 the premarital check has not been a required step before registering; going is voluntary. But “having a serious disease and not saying so truthfully” does give the other person the right to ask a court to revoke the marriage, within one year of knowing. There is no nationwide uniform rule that the check is free. A 2020 notice from the National Health Commission and four other departments only said “actively advocate that localities, in light of their situation, promote free premarital checks.” So whether it is free and which items are checked are set locally; ask at the local maternal-and-child health institution or the one-stop window at the marriage-registration office.

10.15 Count the cost of leaving: negotiated divorce has a 30-day cooling-off period; litigated divorce has statutory conditions
- Money No cost
- Time Hours
- Willpower Some
- Benefit Big
- Measured in Money
- In plain terms
Negotiated divorce is not finished when you sign. Within 30 days after filing the application, either side can withdraw. After that period both must still appear in person within 30 days to collect the divorce certificate; not going counts as withdrawal. If the other side disagrees, you can only sue. The court mediates first; with domestic violence, bigamy, living apart for two full years, and similar situations, if mediation fails the court shall grant divorce.
- Cost
No money. Before marriage spend a little time reading: if you ever leave, how long it takes and what procedure. The hard part is thinking about breaking up before you marry.
- Benefit
Negotiated divorce requires a written divorce agreement and a personal application at the marriage-registration authority (Article 1076). Within 30 days from the day the registration authority receives the application, either side may withdraw. Within 30 days after that period ends, both must personally apply for the divorce certificate; not applying counts as withdrawal (Article 1077). When one side disagrees, go to litigation; the court should mediate first. With bigamy or cohabitation with another person, domestic violence or abuse or abandonment, gambling or drug use that is repeatedly unreformed, living apart for two full years because of emotional breakdown, and similar situations, if mediation fails divorce shall be granted. If divorce was refused and they then live apart for one full year, a new suit shall be granted (Article 1079). In 2024 there were 3513000 divorces nationwide, of which 891000 went through court judgment or mediation.
- Notes
The cooling-off period applies only to negotiated divorce. Litigated divorce has no cooling-off period, but the cycle is longer. Litigation fees and lawyer fees differ by place; this item does not write figures. A high cost of leaving does not mean you should not marry, but you should know these facts before marrying. If there are children, how to write support and visitation is in item 23 of this section (child support and visitation).

10.16 Keep a separate account for “marrying for your elders”; do not mix it with your own account
- Money No cost
- Time Minutes
- Willpower Some
- Benefit Medium
- Measured in Time
- In plain terms
The elders’ share of benefit — peace of mind, face, and an end to pressure — is real. But it does not automatically become your health benefit or relationship quality. The time account, the money account, and the cost of leaving are all borne by you. On paper split two columns for which benefits are yours and which are the elders’; whether the deal is worth it is then visible at a glance.
- Cost
No money. On paper write two columns. One column is which benefits in this marriage are yours — earlier items in this section can calculate them. The other is which benefits are the elders’: peace of mind, face, and the end of marriage pressure. The hard part is leaving the elders’ column alone and not merging it into yours.
- Benefit
The elders’ benefit is real. But it does not automatically convert into your health benefit (item 8) or relationship quality (item 4 — whether a relationship is good depends on how you feel). The time account (item 9), the money account (items 10 to 12), and the cost of leaving (item 15) are all borne by the parties. After you keep the accounts separate, whether “task-style marriage” has high or low cost-effectiveness is something you can see yourself.
- Notes
The elders’ column can also be counted as a very heavy line; how you weigh it is up to you. The fill-in checklist is in docs/结婚划不划算.md.

10.17 Treat relationship quality as a health account: argue about the matter not the person — no name-calling, no sarcasm
- Money No cost
- Time Minutes
- Willpower Some
- Benefit Small
- Measured in Lifespan
- In plain terms
Couples with a better relationship tend to have somewhat better health and somewhat lower death risk. The association is not large — about as large as diet’s link to health. In one experiment, couples who kept hostility in arguments had experimentally made small wounds heal at only about 60% the speed of calmer couples.
- Cost
No money. When arguing, speak only about the matter at hand — no name-calling, no sarcasm, no dredging up old scores. The hard part is holding your tongue when angry.
- Benefit
Pooling 126 studies and more than 72,000 people (a meta-analysis). Higher marital quality went with better physical health; the correlation r was between .07 and .21. A correlation of 0 is no relationship; 1 is perfect lockstep. The correlation with lower death risk was r = .11. Smaller cardiovascular reaction when arguing was r = -.13. The authors said these effects are all small — about as large as the link between habits such as diet and health. In another crossover experiment, 42 healthy couples each stayed in hospital twice for 24 hours. Once they had a mutually supportive talk; once they discussed a disagreement. After arguing, experimentally made blister wounds healed more slowly. Couples who showed more hostility in both sessions had wound healing at only 60% the speed of low-hostility couples. On the morning after arguing, their blood inflammation markers (IL-6, tumor necrosis factor) also rose more.
- Notes
Grade B because most pooled studies were follow-up only, with no assigned comparison groups. So you cannot tell whether a bad relationship makes people ill, or poor health makes the relationship worse. Some studies still found the association after subtracting age and income. Robles’s original text also notes publication bias in some results. Studies that clearly compared men and women mostly found no sex difference. This section found no pooled analysis that directly compared mortality for “a bad marriage” versus “not marrying.” So “a bad marriage hurts more than not marrying” is only an inference. The wound experiment had only 42 couples. “Argue about the matter not the person — no name-calling, no sarcasm” is the author’s practice inferred from “hostile behaviour” in the experiment; no study compared it head-on. If you argue fiercely and cannot change, go to couples therapy together — see item 20 of this section (couples therapy). If arguing turns to hitting, or long-term insults and threats, it is no longer a communication problem; it is domestic violence — see Section 8, item 43 (when you are subjected to domestic violence). To think through whether to leave, the cost of leaving is in item 15 of this section (cost of leaving).

10.18 While both of you are still clear-headed, same-sex partners should put in place an authorization of agency, voluntary guardianship, and a will: in law you are not near relatives; without these you have no signing right and no inheritance right
- Money Low
- Time Hours
- Willpower Some
- Benefit Big
- Measured in Freedom
- In plain terms
Near relatives in law are spouses, parents, children, siblings, and similar; a partner does not count. Without documents in advance, when one side is critically ill the other cannot decide for them. When one side dies, the other inherits none of the estate. Three documents each cover a stage: while clear-headed, an authorization of agency; after losing judgment, voluntary guardianship; after death, a will.
- Cost
Voluntary guardianship and a will are done at a notary office; notary fees differ by place, from a few hundred yuan up. A handwritten will costs nothing. It takes one or two half-days in all. The hard part is sitting down to talk about illness and death.
- Benefit
Article 1045 of the Civil Code lists near relatives as spouses, parents, children, siblings, grandparents, maternal grandparents, grandchildren, and maternal grandchildren. Article 1127’s statutory heirs are first spouses, children, and parents, then siblings, grandparents, and maternal grandparents. A partner is in neither list. Article 1219 covers surgery, special examinations, and special treatment. When the patient cannot or should not be told, medical staff must explain to the patient’s “near relatives” and obtain consent. Three paths can fill the gap. First, Article 33 allows an adult and “another individual willing to serve as guardian” to agree in writing in advance who the guardian will be. After the person loses or partly loses civil capacity, that person becomes the guardian, and the guardian is the statutory agent. Second, Article 165 provides that a written authorization of agency must state the agent’s name, the matter, the scope, and the term, signed or sealed by the principal. When the principal dies or loses civil capacity, the agency ends. Third, Article 1133 allows a will that gifts personal property to an individual outside the statutory heirs. An article by the Yichang Municipal Justice Bureau on the Hubei Provincial Justice Department website states that same-sex partners can notarize a voluntary-guardianship agreement naming the other as future guardian (nationwide).
- Notes
A partner takes the estate as a “legatee,” not as an heir. Within 60 days of knowing of the bequest, they must clearly accept it; silence counts as waiver. The partner and anyone with an interest tied to them cannot be will witnesses. When there are several wills, the last one prevails — see Section 17, item 2 (a later will overrides an earlier one). Whether a voluntary guardian can directly sign surgical consent differs by hospital; ask the hospital you usually use in advance. If family refuse to recognize the documents, you have to sue: ordinary first-instance procedure is to be finished within 6 months by rule, and can be extended; lawyer fees are yours. So do the documents at a notary office when you can. Homes bought together and money saved together should have a separate written agreement by real contribution. How to set up voluntary guardianship is in Section 17, item 1 (name a future guardian in writing). The beneficiaries are you and your partner.

10.19 Do not marry by hiding sexual orientation, and do not treat a marriage of convenience as an easy fix: in law it is a real marriage, and the only exit is divorce
- Money No cost
- Time Minutes
- Willpower A lot
- Benefit Medium
- Measured in Money
- In plain terms
Marrying while hiding sexual orientation is not invalid in law and cannot be revoked; the only exit is divorce. A marriage of convenience is also a real marriage; money earned after marriage counts as joint marital property, and debts both signed and debts for ordinary household spending count as both people’s. The deceived side can ask at divorce for a larger share of property and compensation for mental harm, but whether courts support that is still unsettled.
- Cost
No money. The hard part is withstanding family pressure to marry; that may last many years.
- Benefit
Article 1051 of the Civil Code provides that a marriage is invalid only in three situations: bigamy, a prohibited kinship for marriage, and not yet of statutory marriage age. Articles 1052 and 1053 provide that revocation is available only in two situations: marriage under coercion, and concealing a serious disease before marriage. Article 17 of Interpretation (I) of the Marriage and Family Book provides that a request to confirm invalidity on grounds outside those three is rejected by judgment. So the only exit is divorce. A registered marriage of convenience is also a lawful marriage. Article 1062 provides that wages, bonuses, and labor remuneration after marriage are joint marital property. Article 1064 provides that debts both signed and debts one side borrowed for ordinary family daily life are joint marital debt. Divorce damages are in Article 1091. Situations that support damages are limited to bigamy, cohabitation with another person, domestic violence, abuse or abandonment of a family member, and “other major fault.” Article 2 of Interpretation (I) limits “cohabitation with another person” to cohabitation with an “opposite-sex person outside the marriage.” So a same-sex relationship can only be argued under “other major fault.” Damages include mental-harm damages; the deceived side must raise them together when suing for divorce; if divorce is refused they are not supported. After the Civil Code took effect, no published court judgments of this kind were found. Under the old law, a 2013 article on the Jiangsu Higher People’s Court website discussed a case of a wife suing for divorce because the husband hid homosexuality. The article listed two views. One held that homosexuality was not among the statutory faults then, so neither a larger property share nor mental compensation should be supported. The author favored the other: treat the deceived side as the “fault-free party,” care for her in dividing property, and also award mental consolation money (nationwide).
- Notes
A larger property share and mental compensation appear in only one analysis article, which did not say how the case was finally decided, so whether you can obtain them depends on the specific court. The Civil Code added “other major fault,” giving the deceived side an opening to argue. The statutory text itself is grade A. When both sides in a marriage of convenience each have a same-sex partner, those partners have no protection under marriage law; property must be written separately — see item 18 of this section (same-sex partners put voluntary guardianship and a will in place). Divorce for a marriage of convenience still goes through the 30-day cooling-off period or litigation — see item 15 of this section (negotiated divorce has a 30-day cooling-off period). If a negotiated divorce agreement waives damages, a later suit will not be supported. The first beneficiary is the spouse who would be deceived; next is you: once concealment is discovered, divorce, property division, and child-raising land together.

10.20 When a relationship is stuck in repeated arguments and cold wars, go to couples therapy together: waiting it out almost never fixes itself
- Money High
- Time Hours
- Willpower A lot
- Benefit Medium
- Measured in Time
- In plain terms
Couples stuck in a relationship who finish couples therapy together are clearly more satisfied with the relationship; about seven tenths improve. Couples who only wait in line show basically no change. But effects fade: by year 5, about half are still clearly better, and about one quarter have already separated or divorced.
- Cost
Costs money. Charged per session; fees differ by place and hospital; this item does not write figures. Studies usually go once a week; one trial ran about 8 months end to end. The hard part is that both must go and finish.
- Benefit
A 2020 meta-analysis pooled 58 studies and 2092 couples. After couples therapy, the before–after change in relationship satisfaction was g = 1.12 (credible range 0.92–1.31); the authors called it a large effect. g is an effect size; see the README glossary. For couples assigned to wait, over the same period g = 0.12 (−0.04 to 0.29), with no clear improvement. Couples who started worse improved more. A 2012 review wrote that couples therapy brought improvement for 70% of treated couples. Another randomized trial took 134 couples in long-term, serious discord through about 8 months of two kinds of behavioral couples therapy. At completion, satisfaction change was d = 0.90 and 0.71. By year 5, 50.0% and 45.9% of couples in the two approaches still had clear improvement. The authors call that clear improvement “clinically meaningful improvement.” At the same time, 25.7% and 27.9% had already separated or divorced.
- Notes
Disputed: The controversy is how long effects last. Another meta-analysis that took only randomized trials had g = 0.60 at completion and 0.44 at six months. By 12 months only behavioral couples therapy still had data, g = 0.06 — almost none retained. Another review pooling 20 meta-analyses said clinically meaningful effects appeared in 40% to 50% of people. “Seven tenths improve” and “four to five tenths clearly improve” use different standards; do not mix them. The 5-year trial had no no-treatment control, so you cannot tell whether divorce rose or fell. The 2020 pool was all opposite-sex couples, and no domestic randomized trial was found; discount when applying this to yourself. Where to go in China: the Mental Health Law requires psychotherapy to be done in medical institutions; counseling staff may not provide psychotherapy. Ask hospital psychiatry or psychology departments whether they offer couples therapy. Outside hospitals, first ask about credentials and training. With domestic violence, do not start together. A 2016 meta-analysis said its conclusions apply only to mild-to-moderate situations where both sides hit because of conflict. Violence marked by control of the other person and serious harm is outside its scope. The field also worries about retaliation after going home from a session. If you have been hit, see Section 8, item 43 first (when you are subjected to domestic violence). How to speak when arguing is in item 17 of this section (argue about the matter not the person); thinking through whether to leave is in item 15 of this section (cost of leaving). The beneficiaries are you and your spouse.

10.21 Even after the wedding and the banquet, go and get the marriage certificate: without registration you are not spouses in law, and if the other person dies you have no spouse’s right of inheritance
- Money No cost
- Time Minutes
- Willpower None
- Benefit Big
- Measured in Money
- In plain terms
After February 1994, holding only a wedding without registering is not marriage in law; it only counts as cohabitation. If the other person dies, you cannot inherit the estate as a spouse. If you want to separate, the court does not handle it as divorce. Making up the registration fixes it, and the effect can be counted back.
- Cost
No money. The two of you go to the marriage-registration office together; a few tens of minutes.
- Benefit
The Civil Code provides that “upon completion of marriage registration, the marriage relationship is established. Where marriage registration has not been handled, it shall be made up.” The Supreme People’s Court’s interpretation splits people who have not registered but live in the name of spouses into two kinds. Those who already met the conditions for marriage before 1 February 1994 are treated as a de facto marriage. After that date, the court “shall inform them to make up the marriage registration.” If they do not make it up, it is handled as cohabitation. If one side dies and the other wants to inherit as a spouse, the same principle applies. A spouse is a first-order heir, so the side that never registered is not in that line. For the cohabitation itself, the court does not accept a request to “dissolve” it. It only accepts disputes over dividing property and raising children. After the registration is made up, the marriage takes effect “from the time both parties met the substantive requirements for marriage provided in the Civil Code.” Children are not affected. “Children” in the Civil Code inheritance book expressly includes children born outside marriage, who are first-order heirs the same as children born in marriage.
- Notes
If the other person dies before you have registered, you are not an heir, but you do not get nothing. The Civil Code provides that a person who “provided more support” to the person who died “may be given an appropriate share of the estate.” You have to take evidence and argue for that yourself. If you cannot agree, you have to sue. Ordinary first-instance procedure is to be finished within 6 months by rule, and can be extended; lawyer fees are yours; how much is allotted is set by the judge. So while both of you are still here, go and make up the registration. Making it up is the same as a first registration: both must appear in person; materials are in item 13 of this section (registering needs only an identity card). Betrothal money can be demanded back when there is no registration — see Section 8, item 24 (send betrothal money by transfer). The beneficiaries are you and your spouse.

10.22 When a spouse, behind your back, uses large amounts of joint marital money to tip streamers or transfer it to someone outside the marriage: you can ask to divide joint property without divorcing, and money sent outside the marriage can be sued for return
- Money High
- Time Hours
- Willpower Some
- Benefit Big
- Measured in Money
- In plain terms
If a spouse, without consulting you, uses joint money for large tips to streamers, you can ask a court to divide the joint property without divorcing. At divorce you can also have that side get less or nothing. Money transferred to someone outside the marriage can be sued for return from the recipient; even if they say it was spent, they still must return it. But all of this means suing; lawyer fees are yours; first instance takes several months.
- Cost
You have to sue. Lawyer fees are yours; they are not among the litigation costs the losing side must bear. Ordinary first-instance procedure is to be finished within 6 months by rule, and can be extended; summary procedure is 3 months. You also have to dig up transfer records and tipping records one by one yourself.
- Benefit
The Civil Code provides that spouses have “equal disposal rights” over joint property. Where during the marriage one side hides, transfers, sells, damages, or squanders joint property, the other side may ask a court to divide joint property without divorcing first. When dividing property at divorce, the side that did so may get less or nothing. If discovered only after divorce, you can sue again for another division. Interpretation (II), in force from 1 February 2025, spells out two situations. Article 6 covers tipping. Where one side, without the other’s consent, tips on a livestream platform with joint property in an amount clearly beyond ordinary household spending, that counts as “squandering.” If the other side asks for division during the marriage, or at divorce for the tipping side to get less or nothing, the court shall support it. Article 7 covers gifts outside the marriage. Where one side, for bigamy, cohabitation with another person, or another purpose that breaches the duty of fidelity, gifts joint property to someone else, and the other side asserts the gift is void, the court shall support it. Once void, the recipient must return the money. You can also on that basis ask for division during the marriage, or at divorce for the other side to get less or nothing. In a typical case released with the Supreme People’s Court’s interpretation, one side during the marriage transferred 730,000 yuan over more than 4 years to a person in an improper relationship; that person transferred 170,000 yuan back. The court ordered return of the 560,000 yuan actually received; the claim that “part of the money had been spent” was not supported (nationwide).
- Notes
The tipping rule has a threshold: without your consent, an amount clearly beyond ordinary household spending, seriously harming joint property. Occasional small tips do not qualify. Interpretation (II)’s path for tipping is dividing property and getting less; it does not say you can reclaim from the streamer or the platform. For transfers outside the marriage, what you reclaim is what the other person actually received; amounts they transferred back to your spouse are deducted. You prepare the evidence yourself: bank and payment-app records, tipping records, and chat records that show the relationship. Procedures for dividing property and divorce are in item 15 of this section (cost of leaving). Which money counts as joint property is in item 10 of this section (look first at the law’s default rules for the money account). A spouse borrowing outside is in item 12 of this section (a large sum one spouse borrows). Tipping less yourself is in Section 5, item 8 (do not tip streamers). The beneficiary is you. Conversely, if you are the recipient outside the marriage, the money received must be returned — even if spent.

10.23 When a couple with a minor child divorces, write into the divorce agreement who the child lives with, how much monthly support is, and the form and times of visitation: the more specific the writing, the fewer later lawsuits after divorce
- Money No cost
- Time Hours
- Willpower Some
- Benefit Medium
- Measured in Money
For Child under 3 at home / Child 3 to 18 at home
- In plain terms
Who the child lives with, how much is paid each month, and when you can see the child can be written into the agreement by negotiation. If you cannot agree the court decides; with fixed income, support is generally 20% to 30% of the paying side’s monthly income. If written amounts are not paid, you can sue to recover them. If the other side blocks visitation, the court can fine or detain them, but it will not forcibly take the child to see you.
- Cost
Writing it into the agreement at negotiated divorce costs no money. The hard part is sitting down to work out details — which day of the month to pay, which account, which weekend to pick up the child, how to split winter and summer holidays. If you cannot agree you have to sue. The divorce-case acceptance fee is 50 to 300 yuan per case. Lawyer fees are yours; they are not among the litigation costs the losing side must bear. Ordinary first-instance procedure is to be finished within 6 months by rule, and can be extended; summary procedure is 3 months. Disputes over support or visitation after divorce require a separate suit.
- Benefit
The Civil Code provides that how much support is paid and for how long, and the form and times of visitation, are first agreed by both sides; if agreement fails the court decides. A child under two years old in principle lives with the mother. From age two, judgment follows “the principle most favorable to the minor child.” From age eight, the child’s own wishes are to be respected. From February 2025, where one side has domestic violence, gambling or drug use, an affair or cohabitation, or has seized or hidden the child, the court preferentially considers letting the other side raise the child. The support amount looks at the child’s actual needs, the parents’ means, and local living standards. With fixed income, it is generally 20% to 30% of total monthly income. With two or more children the share may rise, but generally not above 50% of total monthly income. Without fixed income, refer to that year’s total income or the industry average at that share. For example, monthly income of 8000 yuan at that share is 1600 to 2400 yuan a month (self-calculated). Support generally runs to age 18. After an agreement or judgment sets the amount, the child may still when necessary claim reasonable costs above the original amount — for example illness or schooling that exceeds it. An agreement that one side pays no support is also valid. But if the custodial side’s living standard falls markedly, or the child’s necessary costs rise markedly, the child may still ask the other side to pay. Support not paid as agreed after divorce can be sued for as arrears. After a judgment or mediation document takes effect, if the other side does not perform, you can apply for compulsory enforcement. A person who refuses to assist visitation may be detained or fined, but “compulsory enforcement cannot be carried out against the child’s person or the visitation act” (nationwide).
- Notes
20% to 30% is the court’s reference line for judgment, not a floor for agreements; the two of you can agree another figure. When writing the agreement, put payment day, account, and end date clearly, and write visitation to which weekday, what time for pickup and drop-off, and how holidays are split, so there is evidence later. If a parent or relative seizes or hides the child, you can apply to a court for a personal-safety protection order — see Section 8, item 43 (personal-safety protection order). Divorce procedure and the cooling-off period are in item 15 of this section (cost of leaving). The first beneficiary is the child; next is you.
