15 Renting and buying a home
Scope: money. When renting, the places money is most easily lost are the deposit and the agent. When buying, the expensive parts are the interest on the loan, and the things the seller knows that you do not. The items near the end of the section are about buying: which account the money should go into, when the earnest money and the purchase price can be asked back, and what to do if handover is late. Also how to stop a seller selling the same home twice, and how to talk the mortgage rate down. The last two items are about after you move in: the property manager must not cut water or power to collect fees, and for a new home that leaks, go to the developer for repairs within the warranty period.
Items in this section (18)
- 15.1 When renting, the deposit amount, refund timing, and grounds for deduction must be written into the contract
- 15.2 When utilities are cut off, locks are changed, or you’re threatened to leave — call the police first and keep records: laws forbid these tactics to force eviction
- 15.3 Agents must not collect or pay rent and deposits; payments go directly to landlords
- 15.4 Check a long-term rental’s escrow account before paying a full year’s rent at once
- 15.5 If the home is sold during the lease, the lease stays valid — you do not have to move
- 15.6 Before you sign a rental contract, check the title certificate and whether the home is mortgaged. Send every payment by transfer and note what it is for
- 15.7 If an agent is to hold the price on a second-hand home, the money must go through the dedicated transaction-funds deposit account the agency opened at a bank
- 15.8 Do not rent subdivided units: the minimum rental unit is the originally designed room; kitchens, bathrooms, and balconies must not be lived in
- 15.9 Urban residents with hukou who want to live in the countryside can only rent rural houses — they must not buy homestead land or houses on it
- 15.10 When you buy an off-plan home, look at the pre-sale permit first. Earnest money, the down payment, and the loan go only into the pre-sale funds supervision account named in the contract
- 15.11 If you paid reservation earnest money or a down payment on a new home, no formal contract was signed or the loan was not approved (for example policy tightened after signing, or the bank stopped lending), and it is not your fault, demand the money back from the developer
- 15.12 Before you sign for a new home, read how an area difference is handled, and photograph the promises on the brochure, the advertisements, and the model
- 15.13 If a developer is late handing over a new home, or late getting the title deed done, send a written demand first and keep the evidence, then claim the penalty in the contract
- 15.14 Before you sign to buy, check for a seal and for mortgages. After you sign, file an advance-notice registration at the real-estate registration office
- 15.15 If you are carrying a floating-rate mortgage, and the rate is a clear step above newly issued mortgages, ask the bank to negotiate a lower rate or apply to replace the loan
- 15.16 If you need a loan for a first home, use a housing provident fund loan first; if the amount is not enough, add a commercial loan as a combined loan — do not put the whole amount on a commercial loan alone
- 15.17 If the property manager cuts water, power, heat, or gas to force you to pay property fees, complain to the local real-estate authority; if you owe the fees, the manager may only demand payment, sue, or apply for arbitration
- 15.18 When taking handover of a new home, inspect on the spot and write problems into the handover record; for leaks and faults in water and power lines, go to the developer for repairs within the warranty period in the Residential Quality Warranty
15.1 When renting, the deposit amount, refund timing, and grounds for deduction must be written into the contract
- Money No cost
- Time Minutes
- Willpower Some
- Benefit Medium
- Measured in Money
- In plain terms
How much the deposit is, when it is returned, and when it may be deducted must go into the contract before you sign. Deduction grounds not written in the contract cannot be used to withhold your deposit when you move out.
- Cost
No monetary cost. Spend an extra ten minutes when signing the contract. The hard part is raising it in front of the landlord.
- Benefit
Administrative regulations state clearly: “Where the lessor collects a deposit, the amount, time of return, and circumstances in which the deposit may be deducted shall be stipulated in the housing lease contract. Except as provided in the contract, the lessor shall not deduct the deposit without proper cause.” Three things must appear in the contract: how much is collected, when it is returned, and when deduction is allowed. Grounds not in the contract cannot be used to take your money.
- Notes
On move-out day, take photos and video together with the landlord. Record water, electricity, and gas meter readings, and photograph walls and floors. If the deposit is withheld without cause, complain first to the housing lease administration (房屋租赁管理部门). For smaller amounts, use small-claims litigation; see Section 8. For a shopfront rented to open a store, and whether catering can get permits, see Section 12, item 27 (renting a shopfront to open a store).

15.2 When utilities are cut off, locks are changed, or you’re threatened to leave — call the police first and keep records: laws forbid these tactics to force eviction
- Money No cost
- Time Minutes
- Willpower None
- Benefit Medium
- Measured in Money
- In plain terms
Landlords must not cut water or power, change locks, or come to the door with threats to force you to end the lease or move out — the regulations forbid it. If it happens, call the police first and keep the evidence. Do not confront them yourself.
- Cost
No cost at all. Just make a phone call to the police — it can be done right away.
- Benefit
Administrative regulations make it clear: “Landlords must not use violence, threats, or any other illegal means to compel tenants to end their housing lease or vacate the rental property.” Eviction means being forced to move out. In such situations, call the police first to secure evidence — never confront the landlord yourself.
- Notes
Calling the police is essential to obtain an official report that can be used as proof when filing a compensation claim later. Also be sure to notify your local housing authority.

15.3 Agents must not collect or pay rent and deposits; payments go directly to landlords
- Money No cost
- Time Minutes
- Willpower Some
- Benefit Big
- Measured in Money
- In plain terms
By rule, rent and deposits must not be collected or paid through an agent — pay the landlord directly. Every time the money passes through the agent, there is one more chance for them to take it and disappear. Before you pay, check that the payee’s name matches the name on the title certificate.
- Cost
No cost at all. It takes just a few minutes to verify the recipient before paying. The hard part is resisting any pressure from agents to send the money to them instead.
- Benefit
Administrative rules explicitly forbid real estate agencies from collecting or paying rent and deposits on behalf of landlords. This means agents have no legal authority to handle such payments. Every time the money passes through the agent, there is one more chance for them to take it and disappear.
- Notes
Before paying, double-check that the recipient’s name matches the one on the property title. If it does not, ask for a written authorization and keep a copy for your records. Agents are only permitted to charge a commission fee for their intermediary services.

15.4 Check a long-term rental’s escrow account before paying a full year’s rent at once
- Money No cost
- Time Hours
- Willpower Some
- Benefit Big
- Measured in Money
- In plain terms
Paying a full year at once gets you only a small discount. If the company absconds, your deposit and the remaining ten-odd months of rent may all be gone. A rent loan makes it worse: if the rental firm is gone, you still repay the loan monthly. Before signing, check whether it has a publicly disclosed funds supervision account.
- Cost
No cost at all. A check takes a little over ten minutes.
- Benefit
Regulations require any housing rental business that sublets units to set up a dedicated escrow account for rental funds and make it publicly available. Subletting means a company rents entire properties from landlords and then re-rents them to tenants. The tiny discount from upfront annual payments simply does not outweigh the risk of losing both your deposit and all future rent payments if the company folds. For those who also take out rent loans, the risk is even greater.
- Notes
Carefully check whether any loan is tied to your contract. If an installment app pays the full year’s money to the rental company at once and you repay the loan monthly, you will still be obligated to make those payments even if the company disappears. Never sign such a contract.

15.5 If the home is sold during the lease, the lease stays valid — you do not have to move
- Money No cost
- Time Minutes
- Willpower None
- Benefit Medium
- Measured in Money
- In plain terms
If the home is sold during the lease term, your lease remains valid. The new landlord must let you stay under the original contract through expiry. You do not move out and do not renegotiate the rent. The premise is that you already live there lawfully, and you keep the contract, transfer records, and evidence of when you moved in.
- Cost
No monetary cost
- Benefit
The Civil Code has a rule called “sale does not break lease” (买卖不破租赁). The statute reads: a change of ownership of the leased thing during the lease term does not affect the lease contract’s validity. If the owner changes during the term, the signed lease still holds; the new landlord must honor the original contract through expiry.
- Notes
This assumes you already occupy the unit lawfully — the statute calls that lawful possession and use. Keep the contract, transfer records, and evidence of when you moved in.

15.6 Before you sign a rental contract, check the title certificate and whether the home is mortgaged. Send every payment by transfer and note what it is for
- Money No cost
- Time Minutes
- Willpower Some
- Benefit Big
- Measured in Money
- In plain terms
Before you sign, have the landlord produce an identity card and the title certificate. Then take your identity card to the real-estate registration office and check whether the home is mortgaged or has been sealed. You can check before any contract is signed. A home that was already mortgaged or sealed before it was let, and is then auctioned and changes owner, cannot be one you demand to go on living in. Send the money by transfer and note what it is for, so you have a record.
- Cost
No money. Take your identity card to the real-estate registration office once. A check takes half an hour. The hard part is having the landlord produce the title certificate in front of you.
- Benefit
Before you sign, the landlord must show you identity papers and the real-estate title certificate. If there is no title certificate, the landlord must produce other material that shows a right to let the home. The landlord must also cooperate while you inquire into and check the information on this home. That is a duty the administrative regulations put on the lessor. Before any contract is signed, take your identity card to the real-estate registration office of the city or county where the home is, and you can check several things. What you can see is: the basic facts of the home, whether there are co-owners, whether a mortgage or a right of residence is registered, and whether the home has been sealed. After the contract is signed, the lease lets you check the registration result. This step matters because "a sale does not break a lease" has two exceptions. If the home was mortgaged to a bank before it was let, and is later auctioned to pay the debt, you cannot require the new owner to let you stay on under the old contract. The same is true if the home had already been sealed by a court before it was let. When the court auctions, if the lease gets in the way of a mortgage that came first, the court removes the lease and then auctions. The other way around, if the home was let to you first and you had already moved in, and the landlord mortgaged it only later, the mortgage does not affect your lease. If the home is sealed, or the title is in dispute, so that you cannot live there, you can end the contract. If someone else asserts a right and you cannot stay, you can demand to pay less rent or none. Sending all the money by transfer, noted as "rent for such-and-such a home for such-and-such a month," is the author's experience: if there is a dispute, it can show that you paid, and what you paid for.
- Notes
Among the things you can check before a contract is signed, who the owner is is not included. So the name on the title certificate has to be matched, in person, to the landlord's identity card. Have the landlord attend the signing in person. If the landlord cannot come, you need a power of attorney. If a sub-landlord is subletting to you, you need the original landlord's written consent. If the landlord will not accept the right to end the contract or to pay less rent, you have to sue. Ordinary first-instance procedure is to be finished within 6 months by rule, and can be extended. Lawyer fees are generally yours. Noting the purpose on a transfer is not laid down directly in any regulation. It is the author's experience. You can check the same way before signing to buy a second-hand home, and after signing you still file an advance-notice registration. See item 14 (advance-notice registration).

15.7 If an agent is to hold the price on a second-hand home, the money must go through the dedicated transaction-funds deposit account the agency opened at a bank
- Money No cost
- Time Minutes
- Willpower Some
- Benefit Big
- Measured in Money
- In plain terms
When an agent collects the purchase price, the rules say it must go through the dedicated account the agency opened at a bank. That account is supervised; the money must not go into the agency’s own account, and must not be transferred to an individual broker.
- Cost
No monetary cost. The hard part is insisting on the dedicated account; you may have to argue with the agent a few more times.
- Benefit
The regulation is plain: where the parties agree that a real-estate brokerage will collect and pay the transaction funds, the funds shall be transferred through the dedicated client transaction-settlement deposit account that the brokerage has opened at a bank. The purchase price goes into a supervised dedicated account, not the agency’s own account, and not some broker’s private account.
- Notes
The purchase price is from several hundred thousand to several million yuan — the largest single sum in this book. Do not WeChat it to the broker. There are two other common ways of charging extra. One is two agencies jointly doing the same deal; that can be charged as only one commission. The other is handling a loan or a title transfer for you; those are further services, need a separate contract, and the fee must be stated in advance. Send every payment by transfer and note what it is for; see item 6 (check the title certificate and the mortgage before signing). Where the money for an off-plan home goes is in item 10 (the pre-sale funds supervision account).

15.8 Do not rent subdivided units: the minimum rental unit is the originally designed room; kitchens, bathrooms, and balconies must not be lived in
- Money No cost
- Time Minutes
- Willpower None
- Benefit Medium
- Measured in Money
- In plain terms
By rule, the smallest unit you may rent is the room as originally designed. Kitchens, bathrooms, balconies, and basement storage must not be lived in. During the lease the landlord also cannot raise rent unilaterally on a whim.
- Cost
No monetary cost. The trade-off is that on the same budget you live farther out or in a smaller place.
- Benefit
The rules state clearly that the minimum rental unit is the originally designed room; one room must not be partitioned into several units rented separately. Per-person living floor area must not fall below the local minimum. Kitchens, bathrooms, balconies, and basement storage must not be rented for people to live in. During the lease the lessor may not unilaterally raise rent at will. For violations of Article 8, the competent authority shall order the lessor to correct within a time limit; if the lessor fails to correct on time, a fine of 5000 yuan to 30,000 yuan may be imposed.
- Notes
When an illegal subdivision is enforced, the fine falls on the lessor. But correction means tearing out the partitions, so tenants living there have to move — that follows from this rule. Deposit and rent already paid are often not recovered; that is the author’s experience. Safety is worse too: partition walls often block escape routes, and many people in one unit share one circuit. When viewing, check three things: whether walls were added later, whether the room has a window, and whether the meter can handle that many people.

15.9 Urban residents with hukou who want to live in the countryside can only rent rural houses — they must not buy homestead land or houses on it
- Money No cost
- Time Minutes
- Willpower Some
- Benefit Big
- Measured in Money
- In plain terms
People with urban hukou must not go to the countryside to buy homestead land (宅基地), farmers’ houses, or “small-property-rights houses” (小产权房) — national documents expressly forbid it. A villager saying “a written contract is enough” does not make it work either. To live long-term in the countryside, sign a lease, at most 20 years per term, and renew when it ends.
- Cost
No monetary cost. The trade-off is that the house is not yours; the maximum single lease term is 20 years, and when it ends you renegotiate with the landlord.
- Benefit
A State Council General Office document states clearly: “Urban residents must not purchase rural homestead land, farmer housing, or ‘small-property-rights houses.’” The same document also provides that after a farmer sells or leases out housing, a further application for homestead land will not be approved. A 2019 document from the Central Rural Work Leading Group Office and the Ministry of Agriculture and Rural Affairs repeats it: “It is strictly forbidden for urban residents to purchase rural homestead land.” The same document gives the lawful path: urban residents may rent rural houses for residence or business. The lease term must not exceed 20 years; when it ends the parties may agree again.
- Notes
Homestead land is land the village allocates to its own villagers to build housing; it can only go to people of that village. When renting a rural house, sign a written contract with the farming household that rents it out, stating the term, the rent, whether renovation or alteration is allowed, and how renovation costs are settled at the end. The documents cap the term at 20 years; do not sign “lease for 50 years” or “lease for 70 years,” and do not pay many years of rent in one lump sum. The documents also forbid going to the countryside to build villas, large compounds, and private clubs on homestead land; do not put up money for villagers to “co-build.”

15.10 When you buy an off-plan home, look at the pre-sale permit first. Earnest money, the down payment, and the loan go only into the pre-sale funds supervision account named in the contract
- Money No cost
- Time Minutes
- Willpower Some
- Benefit Big
- Measured in Money
- In plain terms
An off-plan home is a home put on sale before it is finished. Without a pre-sale permit, the developer cannot sell it and cannot take earnest money. The down payment and the loan you pay are, under the rules, to go in full into the supervision account; supervision is lifted only when the home can be handed over. Money sent to some other account is outside that protection.
- Cost
No monetary cost. Look at the pre-sale permit before you sign, and check the account before you pay — a few minutes. The hard part is refusing when the salesperson tells you to transfer to some other account.
- Benefit
An off-plan home is called a commercial-housing pre-sale in the regulations — the developer selling you a home that is still being built. In August 2026 the Ministry of Housing and Urban-Rural Development, the Ministry of Natural Resources, and the National Financial Regulatory Administration issued a document: “The down payment, the personal housing loan, and other purchase funds paid by the buyer shall all be deposited into the funds supervision account.” Supervision is lifted only after the home has passed completion inspection and water, electricity, gas, and heat are ready for handover. The developer must write into the purchase contract the rights and duties of depositing the purchase funds into the supervision account. If the developer is in breach and cannot hand the home over on time, you may end the contract as the contract provides. The developer must return the money as the contract says and bear liability for the breach. The People’s Bank of China and the National Financial Regulatory Administration at the same time provided that a personal housing loan for a pre-sale home is paid by the bank directly into the project’s pre-sale funds supervision account. A 2022 document from three departments already stated that earnest money, the down payment, and the mortgage loan “shall all be deposited directly into the supervision account.” A project that has not received a pre-sale permit must not be pre-sold, and the developer must not take earnest money by subscription, reservation, queue numbers, or VIP cards. A pre-sale contract signed without a pre-sale permit is held invalid by the court. If the permit is obtained before the suit is filed, it may be held valid. Money paid somewhere other than the supervision account is outside this supervision. The same 2026 document also provides that for a project sold as a finished home, after the construction permit is obtained the developer may first take a “small amount of earnest money.” That earnest money is supervised by the housing-funds supervision body, held in an “earnest-money supervision account” opened at the project’s lead bank, and supervision is lifted only when the home is ready for handover.
- Notes
For a project that had already received its construction-project planning permit before 28 August 2026, the pre-sale conditions and the funds supervision follow each place’s old rules. That the down payment and the loan go into the supervision account was already required by the 2010 and 2022 documents. For a project sold as a finished home where the developer takes a small amount of earnest money while still building, the new rules require the earnest money to go into an earnest-money supervision account. The account name and number of the supervision account are whatever the purchase contract writes; check them once before you pay. If the contract is held invalid and the developer still does not return the money, you have to sue. Ordinary first-instance procedure is to be finished within 6 months by rule, and can be extended. Lawyer fees are generally yours. How the price of a second-hand home is paid is in item 7 (the dedicated transaction-funds deposit account).

15.11 If you paid reservation earnest money or a down payment on a new home, no formal contract was signed or the loan was not approved (for example policy tightened after signing, or the bank stopped lending), and it is not your fault, demand the money back from the developer
- Money No cost
- Time Minutes
- Willpower Some
- Benefit Big
- Measured in Money
- In plain terms
If you paid reservation earnest money but no formal contract was signed, or the loan was not approved, look first at whose fault it is. If the cause is neither yours nor the developer’s, the developer must return the earnest money, or return the purchase money plus interest. Policy tightening after signing or the bank stopping lending generally counts as neither side’s fault. Overdue items on your own credit report or income that is not enough count as your cause, and you may not get the earnest money back.
- Cost
No money. When you sign the reservation and the formal contract, read two more clauses. If the developer will not return the money, you have to sue.
- Benefit
The Supreme People's Court's judicial interpretation states: if a developer takes earnest money through a subscription, an order, or a reservation, and no formal sale contract is signed because of one side's cause, the earnest-money rules apply. The earnest-money rules are: if the side that paid breaks the deal, the earnest money is not returned; if the side that received it breaks the deal, it is returned double. See Section 12, item 15 (write “earnest money” when you take money). If no contract is signed for a cause that cannot be laid on either side, "the seller shall return the earnest money to the buyer." Another article covers the loan. If the sale contract agrees payment by loan, and no loan contract is signed because of one side's cause, so that the sale contract cannot be performed, the other side can end the contract and demand compensation. If no loan contract is signed for a cause that cannot be laid on either side, either side can end the contract. The developer must return the principal and interest of the purchase money it received, or return the earnest money. The articles only state the principle of what counts as a cause that cannot be laid on either side. The examples below are the author's. Policy on housing loans tightening locally after you sign, or the bank stopping lending, is generally a cause that cannot be laid on either side. Overdue entries on your own credit report, or income records that are not enough, count as your cause. Incomplete papers on the project, so that the bank will not lend on it, counts as the developer's cause. These two articles cover only commercial housing bought from a developer. They do not apply to buying a second-hand home.
- Notes
When it is disputed what counts as "cannot be laid on either side," the court decides on the facts. So the formal contract should state that payment is by loan, and it is better if it also states what happens if the loan is not approved. If the reservation already writes out the main contents of a sale contract, and the developer has also taken the price, the court will treat it as a formal sale contract. It then does not count as "never signed." If the developer will not return the money, you have to sue. Ordinary first-instance procedure is to be finished within 6 months by rule, and can be extended. Summary procedure is 3 months. Lawyer fees are generally yours.

15.12 Before you sign for a new home, read how an area difference is handled, and photograph the promises on the brochure, the advertisements, and the model
- Money No cost
- Time Minutes
- Willpower None
- Benefit Medium
- Measured in Money
- In plain terms
If the contract does not agree otherwise, and the area registered after handover differs from the contract by 3% or less, the price is settled on the actual area, with the extra returned or the shortfall paid. If the difference is over 3%, you can return the home, and the developer returns the money plus interest within 30 days. A promise in an advertisement that is specific about the homes and the facilities in the compound, and that affects whether you buy, counts even if it was not written into the contract.
- Cost
No money. Read two more clauses before you sign, and take photographs and screenshots while you are at it.
- Benefit
The ministry regulation states that where the price is by area, the contract must say how an area difference is handled. If the contract does not say, the following applies. "Where the absolute value of the area-difference ratio is within 3% (including 3%), the price is settled on the actual area." Over 3%, you have the right to return the home. If you return it, the developer must, within 30 days of the day you ask, return the price already paid, and pay interest at the same time. If you do not return it and the registered area is larger than the contract, you pay for the part within 3%, the developer bears the part over 3%, and the property right is yours. If the registered area is smaller than the contract, the developer returns the part within 3%, and returns double the part over 3%. On advertisements, the Supreme People's Court's judicial interpretation states: sales advertisements and promotional material are generally only an invitation to negotiate. They are not a contract. But a statement by the developer about homes and supporting facilities inside the scope of the development plan, if it is specific and definite, and if it has a major effect on whether you sign and on the price, counts as contract content. "That statement and promise, even if not written into the commercial-housing sale contract, shall still be contract content," and breaking it means liability for breach.
- Notes
3% is the default when the contract says nothing. If the contract writes something else, the contract governs, so when you sign, read whether that clause widens the band. An off-plan home priced by the unit must have a floor plan attached to the contract, stating the tolerance on the dimensions. The advertising rule covers only homes and facilities inside the scope of the development plan. Things outside that scope are not in this rule. When the judicial interpretation was amended in 2020, the old article on area difference was deleted. The basis now is this ministry regulation. If the developer will not accept it, you have to sue. Ordinary first-instance procedure is to be finished within 6 months by rule, and can be extended. Lawyer fees are generally yours.

15.13 If a developer is late handing over a new home, or late getting the title deed done, send a written demand first and keep the evidence, then claim the penalty in the contract
- Money No cost
- Time Hours
- Willpower Some
- Benefit Medium
- Measured in Money
- In plain terms
If the developer hands over late, send a written demand first. If it still has not handed over within three months, you can return the home. If the contract states no penalty, it pays you the rent of a similar home in the same area. If you cannot get the title deed because of the developer, it also pays; if the delay runs more than a year past the deed deadline, you can also return the home. The right to return the home has a time limit — do not keep putting off saying what you will do.
- Cost
No money. Write a demand, send it by courier, and keep a copy. If you actually want to return the home or claim compensation, it will most likely mean a lawsuit.
- Benefit
The Supreme People's Court's judicial interpretation states: if the developer is late handing the home over, and still has not handed it over within 3 months after you demand it, you can end the contract, unless the contract agrees otherwise. The right to end the contract has a time limit. If the developer demands that you say what you will do, you must decide within 3 months. If the developer does not demand that, you must use the right within one year of the day you knew you could end the contract. After that it is gone. If the contract agrees neither a penalty nor how compensation is calculated, late handover is counted as the rent, over the period of the delay, of a similar home in the same area. If, because of the developer, you still have no title deed by one of the following deadlines, the developer bears liability for breach. There are three deadlines: the deed deadline agreed in the contract; for an off-plan home, 90 days from the day of handover; for a finished home, 90 days from the day the contract was signed. If the contract agrees no penalty, it is calculated on the total purchase money you have paid, by reference to the standard for overdue-loan interest set by the People's Bank of China. If, more than one year after the deed deadline, registration still cannot be done because of the developer, you can end the contract and demand compensation. If the agreed penalty is too high and the developer asks for it to be reduced, the court adjusts it on the standard of exceeding the actual loss by 30%.
- Notes
Make the demand in writing. Courier it to the developer's address written in the contract, and keep the mailing receipt and the record of receipt. The judicial interpretation only says "after a demand." It does not specify the form. Writing it and sending it by courier is the author's experience. If the contract already agrees a penalty for late handover, calculate from the contract first. After you return the home, the loan contract can be ended together with it. The developer returns the loan to the bank, and returns to you the price you paid and the interest. If the developer will not accept it, you have to sue. Ordinary first-instance procedure is to be finished within 6 months by rule, and can be extended. Lawyer fees are generally yours.

15.14 Before you sign to buy, check for a seal and for mortgages. After you sign, file an advance-notice registration at the real-estate registration office
- Money Low
- Time Hours
- Willpower Some
- Benefit Big
- Measured in Money
- In plain terms
Before signing, take your identity card to the real-estate registration office and check whether this home is mortgaged or sealed, and whether it was registered to someone else first. Agree in the contract to file an advance-notice registration, and file it as soon as you have signed. After it is filed, if the seller sells again or mortgages again without your consent, the registration office will not process it. Once formal transfer is possible, you must go complete the transfer within 90 days; after that the advance-notice registration lapses.
- Cost
Before you sign, take your identity card and check once. Half an hour. After you sign, you and the seller take the papers to the registration office. Pay the registration fee at the local rate.
- Benefit
The Civil Code states: once a purchase agreement is signed, to secure getting the home later, you may apply to the registration office for an advance-notice registration as agreed. "After the advance-notice registration, a disposal of the real estate without the consent of the right-holder under that registration does not take effect in property law." The advance-notice registration has a time limit. It lapses if the contract is ended, or in similar situations, or if no application for formal registration is made within 90 days of the day formal registration became possible. The implementing rules of the Ministry of Natural Resources put that onto the registration office: both pre-sale commercial housing and the sale of a second-hand home can be filed. While the advance-notice registration is in effect, if the seller applies to register this home without your written consent, the registration office will not handle it. If you are buying an off-plan home and the developer does not apply together with you as agreed, you can apply alone. What you can check before signing: if you intend to buy, your identity card alone lets you check whether this home has a mortgage, an advance-notice registration, or an objection registration, and whether it has been sealed. An online filing of the contract does not control whether the contract is effective. The Supreme People's Court's judicial interpretation states that a pre-sale contract that was not filed does not, for that reason, fail to be valid, unless the two sides agreed that it takes effect only once filed.
- Notes
How to check before signing, and what to bring, is in item 6 (check the title certificate and the mortgage before signing). Before a contract is signed you cannot see who the owner is. The name on the title certificate has to be matched, in person, to the seller's identity card. An advance-notice registration has to be agreed by both sides in advance, so write it into the sale contract. If the seller colludes with someone else, signs another contract, and hands the home over, you can ask a court to confirm that other contract is invalid. That means a lawsuit. Ordinary first-instance procedure is to be finished within 6 months by rule, and can be extended. Lawyer fees are generally yours. The advance-notice registration closes that path beforehand.

15.15 If you are carrying a floating-rate mortgage, and the rate is a clear step above newly issued mortgages, ask the bank to negotiate a lower rate or apply to replace the loan
- Money No cost
- Time Minutes
- Willpower Some
- Benefit Big
- Measured in Money
- In plain terms
A mortgage rate is a benchmark rate plus a few points. The points added used to be locked for the life of the contract; from 2024 you are allowed to discuss changing them with the bank. If your rate is a clear step above newly issued mortgages nationwide, you can ask the bank to lower it, or apply for a new loan to replace the old one. On a loan of 1,000,000 yuan over 30 years, a rate half a percentage point lower means about 100,000 yuan less interest.
- Cost
No monetary cost. Call the bank’s service line, or apply in the mobile bank — a few tens of minutes once. The bank may not agree.
- Benefit
A 2024 announcement of the People’s Bank of China allows the borrower and the lender to negotiate a change in the points added to, or taken off, the LPR in the mortgage rate. The LPR is the loan prime rate; a mortgage rate is that rate plus or minus points. In a press briefing, the responsible person at the People’s Bank of China said that the points written in the old contract were fixed for the whole term of the loan, and that this change alters that. In August 2026 the People’s Bank of China and the National Financial Regulatory Administration wrote into a document: for floating-rate mortgages already issued, when the rate has diverged by a certain margin from the rate on newly issued mortgages nationwide, “the borrower may negotiate with the banking institution to change the interest rate agreed in the contract, or apply for a newly issued floating-rate personal housing loan to replace the existing loan. The method shall be chosen by the borrower.” The new loan must not be larger than the principal left on the old loan. How much you can save, worked by the equal-payment formula as an example: a loan of 1,000,000 yuan over 30 years, at an annual rate of 4.0%, has a monthly payment of about 4774 yuan, and at 3.5% about 4490 yuan. That is about 284 yuan less a month, and about 100,000 yuan less interest over 30 years.
- Notes
How wide the divergence has to be before you can talk is not given as a figure in the document. Use the announcement of the bank that made your loan. This item covers floating-rate mortgages issued by banks. If the bank will not lower the rate, and you have spare cash, you can compare it with the method in Section 5, item 28 (paying a mortgage off early). A replacement cannot borrow more. The new loan cannot exceed the principal left on the old loan.

15.16 If you need a loan for a first home, use a housing provident fund loan first; if the amount is not enough, add a commercial loan as a combined loan — do not put the whole amount on a commercial loan alone
- Money No cost
- Time Hours
- Willpower None
- Benefit Big
- Measured in Money
- In plain terms
For a first home, a housing provident fund loan of more than 5 years is at 2.6%; the rate on newly issued bank mortgages around June 2026 was about 3.1%. On a loan of 1,000,000 yuan over 30 years, using the fund for the whole amount costs about 96,000 yuan less interest than a commercial loan for the whole amount. The fund has a loan ceiling; what it cannot cover can be topped up with a commercial loan — that is a combined loan.
- Cost
No monetary cost. You may have to go to the housing provident fund center or the entrusted bank one or two more times, and disbursement may be a few days later than a commercial loan alone. The premise is that you have already paid into the fund continuously for a period.
- Benefit
On 7 May 2025 the People’s Bank of China issued a document lowering housing provident fund loan rates, effective from 8 May. For a first-home fund loan of more than 5 years the rate is 2.6%; for 5 years or less it is 2.1%. For a second home, more than 5 years is not below 3.075%, and 5 years or less is not below 2.525%. As of October 2026 this was still the latest adjustment. Commercial mortgage rates are set as LPR plus or minus points; the LPR is the loan prime rate. On 20 September 2026 the LPR for terms of 5 years or more was 3.5%. The People’s Bank of China’s monetary policy report for the second quarter of 2026 states that in June “the rate on newly issued personal housing loans was about 3.1%.” How much you can save, worked by the equal-payment formula as an example: a loan of 1,000,000 yuan over 30 years, at 2.6%, has a monthly payment of about 4003 yuan, and at 3.1% about 4270 yuan. That is about 267 yuan less a month, and about 96,000 yuan less interest over 30 years. Even if the fund ceiling covers only 600,000 yuan and the other 400,000 yuan goes commercial, it still beats putting the whole amount on a commercial loan: about 160 yuan less a month, and about 58,000 yuan less interest over 30 years. The second-home fund rate floor of 3.075% is close to the commercial 3.1%, so little is saved.
- Notes
A housing provident fund loan has four thresholds. First you must have paid in enough. A 2014 document from the Ministry of Housing and Urban-Rural Development and two other departments states that you must have paid in continuously and in full for 6 months or more before you can apply; payments made elsewhere can be combined. Caps and terms differ by place; the maximum is set by the local housing provident fund management committee. For example in Beijing a first-home loan for one contributor tops out at 1,200,000 yuan, with 200,000 yuan of loan capacity per year of contributions. In Guangzhou one person tops out at 1,000,000 yuan, the term must not exceed 30 years, and for a second-hand home the building age plus the loan term must not exceed 50 years. When buying a second-hand home, the price used is the lower of the online-signed price and the appraisal; a low appraisal means less you can borrow. Finally there is more paperwork. The regulations require the fund center to decide within 10 days of accepting the application, and then mortgage registration still has to be done. Slower disbursement than a commercial loan is the author’s experience; if the seller is in a hurry for the money, say before signing that you will use a fund loan. The down-payment ratio on a combined loan must meet both the fund side and the commercial side. Fund balances can also be withdrawn to repay a loan; see Section 5, item 3 (the housing provident fund is not only for buying a home). If you already put everything on a commercial loan, you can ask the bank to lower the rate; see item 15 of this section (negotiating a lower rate).

15.17 If the property manager cuts water, power, heat, or gas to force you to pay property fees, complain to the local real-estate authority; if you owe the fees, the manager may only demand payment, sue, or apply for arbitration
- Money No cost
- Time Minutes
- Willpower Some
- Benefit Medium
- Measured in Money
- In plain terms
The property manager must not cut water, power, heat, or gas to force you to pay property fees; if it happens, complain to the local real-estate authority. If the manager provided the contracted services, you cannot refuse to pay on the ground that you “did not use them”; if you still do not pay, it can sue. Unauthorized extra or duplicate charges you may refuse, and what you already paid you can get back.
- Cost
No monetary cost. A phone call or a written complaint takes a few tens of minutes. If the manager does not change and you want damages, you have to sue.
- Benefit
Article 944 of the Civil Code has three layers. The first is: “A property service provider must not collect property fees by cutting off electricity, water, heat, or gas.” The second: if the manager provided services as agreed, an owner must not refuse to pay on the ground of “not having accepted or not needing to accept” the services. The third: if an owner is overdue, the manager may demand payment within a reasonable period; if still unpaid when that period ends, the manager may sue or apply for arbitration. The Property Management Regulations also state that when an owner is overdue on property fees, the owners’ committee shall urge payment within a time limit; if still unpaid, the property service enterprise may sue. Complaints go to the real-estate administration of the people’s government at or above the county level; the regulations require them to handle owners’ complaints promptly. A Supreme People’s Court judicial interpretation states that if the manager unilaterally expands the fee scope, raises the fee standard, or charges twice, you may raise that as a defense against payment. Unauthorized fees already paid may be demanded back.
- Notes
What the law forbids is using a water or power cut as a way to collect property fees. If what you owe is the water, electricity, or gas bill itself, the situation differs. After a power supplier demands payment and you still do not pay within a reasonable period, it may suspend supply under the national procedure, and it must notify you in advance. Water, gas, and heat follow the same idea. The regulations also require water, power, gas, and heat suppliers to bill the end user. If a water or power cut by the manager caused you losses and you want damages, you have to sue. Ordinary first-instance procedure is to be finished within 6 months by rule, and can be extended; summary procedure is 3 months; lawyer fees are generally yours. If a landlord cuts water or power to force you out of a rental, see item 2 (cutting water or power, changing locks). Benefit set to medium by judgment: property fees are a few hundred to a few thousand yuan a year, and there is no uniform statistic for losses from heat or water cuts.

15.18 When taking handover of a new home, inspect on the spot and write problems into the handover record; for leaks and faults in water and power lines, go to the developer for repairs within the warranty period in the Residential Quality Warranty
- Money No cost
- Time Hours
- Willpower None
- Benefit Medium
- Measured in Money
- In plain terms
When the developer hands over, it must give you a Residential Quality Warranty. The contractor’s statutory minimum warranty periods are 5 years for leaks in bathrooms, roofs, and exterior walls, and 2 years for water and power lines and fit-out, all counted from completion acceptance. The warranty the developer gives you must not be shorter than what remains of the contractor’s warranty. If within the warranty period it will not repair or keeps delaying, you may hire someone yourself and the developer pays.
- Cost
No monetary cost. Spend two or three extra hours on handover day checking walls, floors, doors, windows, and utilities room by room, and photograph for the record. Hiring someone to help inspect costs extra.
- Benefit
Ministry of Housing and Urban-Rural Development rules state that when selling commercial housing, the developer must provide the buyer with a Residential Quality Warranty and Residential Use Instructions. The developer bears quality warranty liability for homes it sells; the warranty period runs from the day of handover. The commercial-housing warranty must not be shorter than what remains under the quality warranty the contractor gave the developer. For quality problems within the warranty scope during the period, the developer must repair and also compensate for losses caused. Damage from force majeure or improper use is not the developer’s responsibility. The contractor’s minimum warranty periods are set by a State Council regulation, counted from the day of passing completion acceptance. Roof waterproofing, and seepage prevention for bathrooms, rooms, and exterior walls that require waterproofing, is 5 years. Heating and cooling systems are 2 heating seasons and cooling seasons. Electrical lines, water-supply and drainage pipes, equipment installation, and fit-out works are 2 years. Foundations and the main structure last for the reasonable service life stated in the design documents. A Supreme People’s Court judicial interpretation states that during the warranty period the developer bears the duty to repair. “If the seller refuses to repair or delays repair beyond a reasonable period, the buyer may repair personally or through others. The repair cost and other losses caused during the repair period are borne by the seller.” If a quality problem seriously affects normal residence and use, you may end the contract and demand compensation. If the main structure fails inspection as unqualified, you may also end the contract and demand compensation. Checking room by room on handover day, writing problems into the handover record, and photographing them is the author’s experience. Improper use is outside the warranty, so problems noted at handover are hard for the developer to blame on your later renovation.
- Notes
Warranty scope and term must be agreed with you in the contract; the contract and the Residential Quality Warranty govern. If what is written is longer than the statutory minimum, the longer term applies. The sales administration measures also mention the 1998 quality-warranty system rules; the original minimum periods in that text were not retrieved here, so no figures are given. When a problem appears within the warranty period, first notify the developer in writing and keep a copy — the author’s experience. If the developer will neither repair nor accept responsibility, you have to sue. Ordinary first-instance procedure is to be finished within 6 months by rule, and can be extended; summary procedure is 3 months; lawyer fees are generally yours. Area and advertising promises that do not match: see item 12 (area difference). Late handover or late title deed: see item 13 (late handover). Benefit set to medium by judgment: repair costs vary widely by home and problem, with no uniform statistic.
