7 How to get by when you have no money

This section is about money and social safeguards. How much you can receive, what fees you can avoid, what services you can get, and what conditions you must meet are all written here — not converted into years of life. Policies change every year and differ by place, so amounts and thresholds follow what your locality publishes for the current year.

Items in this section are grouped by topic below, with item numbers in parentheses.

Losing a job: Apply online for unemployment insurance benefits (item 1); get recognized as someone facing employment difficulties (item 12); claim vocational training subsidies (item 13).

Unpaid wages: File a complaint with labor inspection first (item 2); apply for legal aid (item 3); when wages are owed, first figure out who hired you (item 22).

Emergency relief: Go to a shelter (item 4); apply for temporary assistance (item 6); apply for dibao (item 7); the two disability subsidies (item 8); replace a lost ID card at once (item 11); when you truly have nowhere to sleep (item 21); when you already cannot repay credit cards or online loans (item 23).

Medical and social insurance: Do not let resident medical insurance lapse (item 9); for serious illness, use medical insurance and medical assistance first (item 10); do not panic if social insurance contributions are interrupted (item 18); add a medical or critical-illness policy (item 20).

Finding work and starting over: Public employment services and gig markets (item 5); use a systematic approach when job hunting (item 14); pay no deposit and surrender no ID (item 15); even after prison or bankruptcy there is a path to start over (item 19).

Housing and food: Queue for public rental housing (item 16); cut housing and food to the minimum (item 17).

  2. 7.2 When wages are owed, complain to labor inspection first, then apply for labor arbitration; both routes are free, and most cases have a result within a few months
  3. 7.3 If you cannot afford a lawsuit, apply for legal aid; cases such as unpaid wages, support for elderly parents (赡养费), and work injury are already covered
  4. 7.4 When you have nowhere else to turn, go to a relief shelter; it provides food, lodging, and a ticket home
  5. 7.5 To find work, first use free public employment services and gig-work markets (零工市场), not fee-charging agents
  6. 7.6 After a sudden setback, apply for temporary assistance first
  7. 7.7 If income is below the local dibao line, apply for dibao; if income is a bit above the line or medical and schooling costs are high, apply for medical, education, housing, and employment assistance
  8. 7.8 With a disability certificate, apply for the two disability subsidies
  9. 7.9 Do not let the annual 400 yuan resident medical insurance lapse; hardship households can get reductions
  10. 7.10 For serious illness, use medical insurance, critical-illness insurance, medical assistance, and cross-region registration first — do not touch online loans
  11. 7.11 Replace a lost ID card immediately; get a temporary one if you need it urgently
  12. 7.12 After registering as unemployed, seek recognition as a person facing employment difficulties to receive social insurance subsidies or access to public welfare jobs
  13. 7.13 Apply for vocational training subsidies, employment internship subsidies, and social insurance subsidies during unemployment — don’t pay for training courses out of pocket
  14. 7.14 Job hunting isn’t just about sending resumes — use a systematic approach: learn skills, set goals, and ask for help
  15. 7.15 No deposits, no ID retention, no “training loans”, no pyramid schemes, no usury
  16. 7.16 If you have housing difficulties, queue for public rental housing first
  17. 7.17 Keep food and housing costs as low as possible: opt for monthly shared housing instead of daily rentals, and cook at home or use senior meal services rather than ordering takeout
  18. 7.18 Do not panic if social insurance contributions are interrupted: pension is cumulative; medical insurance is made up by the rules
  19. 7.19 After prison, bankruptcy, or a dishonest-debtor list, the law still has a path to start over — finish the procedures first
  20. 7.20 Before a serious illness, add a one-year medical or critical illness insurance plan on top of basic medical insurance, and look carefully for the phrase “guaranteed renewal.”
  21. 7.21 When there’s nowhere else to sleep, 24-hour venues can only serve as a temporary overnight refuge; shelters should be the first choice
  22. 7.22 When wages are owed, first figure out who hired you: unlicensed workshops and labor bosses still go to labor inspection; only private work for a household or individual goes to court
  23. 7.23 When you already cannot repay credit cards or online loans, call the bank or platform customer service yourself to apply for a personalized installment or deferral; do not borrow new to pay old, and do not pay intermediaries for “interest freeze,” “credit-report repair,” or “anti-collection”

7.1 After losing a job, apply online for unemployment insurance benefits first

  • Money No cost

Value: Very highEvidence A
In plain terms

If your employer and you have paid for a full 1 year, and you did not resign on your own, then after unemployment registration and if you are willing to look for work, you can receive money. With 1 full year but under 5 years of contributions, you can receive for at most 12 months; with a full 5 years but under 10 years, at most 18 months; with 10 years or more, at most 24 months. While you receive benefits, employee medical insurance is paid for you by unemployment insurance.

Cost

No money spent. You can submit the application on a phone through any of three portals: the "Zhangshang 12333" (掌上12333) App, the electronic social security card mini-program in WeChat or Alipay, or the National Social Insurance Public Service Platform. A social security card or ID card is enough; in most regions you need not go in person. The prerequisite is completing unemployment registration first.

Benefit

All three conditions must be met. First, your employer and you must have paid unemployment insurance for a cumulative full 1 year. Second, you did not resign on your own (the legal term is “employment interrupted not due to the person’s own will”). Third, you have completed unemployment registration and are willing to seek work. How long you can receive depends on contribution years. Cumulative full 1 year but under 5 years: at most 12 months. Full 5 years but under 10 years: at most 18 months. 10 years or more: at most 24 months. The monthly amount is set by the provincial government and differs by province. It is below the local minimum wage and above urban dibao. The national goal is to raise it gradually to 90% of the minimum wage. While receiving unemployment benefits, you still participate in employee basic medical insurance and enjoy its benefits. The basic medical insurance premiums due are paid from the unemployment insurance fund; you pay nothing personally (nationwide; the regulations have been in force since 1999)

Notes

Resigning on your own does not count as “not due to the person’s own will,” so you cannot receive benefits. When leaving a job, do not sign “voluntary resignation for personal reasons” — see Section 19, item 7. Unemployment benefits are counted from the day you complete unemployment registration; register late and you get money late. The first thing after leaving is to register. Registration needs the termination certificate issued by the employer — see Section 19, item 17 (termination certificate). Whether to keep a non-compete and what to do if the company pays no compensation — see Section 11, item 12 (signed a non-compete). While you receive benefits, employee medical insurance is paid for you by unemployment insurance. Amounts differ a lot by province; follow what the place where you are insured publishes. The “90% of minimum wage” wording comes from a 2017 guidance opinion of the Ministry of Human Resources and Social Security and the Ministry of Finance (人社部发〔2017〕71 号); the original text says “gradually raise the unemployment insurance benefit standard to 90% of the minimum wage standard.” That is a goal, not the amount paid today. The original page on the ministry site could not be opened locally; this sentence was checked against a citation in a Liaoning provincial human resources and social security department document.

7.2 When wages are owed, complain to labor inspection first, then apply for labor arbitration; both routes are free, and most cases have a result within a few months

  • Money No cost
  • Time Hours
  • Willpower Some
  • Benefit Big
  • Measured in Money
Value: HighEvidence A
In plain terms

First call 12333 or complain to labor inspection at the human resources and social security bureau; after a case is filed, the investigation finishes within 60 working days. If confirmed, the company can be ordered to pay by a deadline; if it still does not pay, it must add another 50% to 100% as compensation. If that fails, apply for labor arbitration; the case is closed within 45 days. But “case closed” is not “money in hand”: if the company has no assets or the boss has fled, you may win and still get nothing.

Cost

No money spent; complaints and arbitration both charge nothing. Gather the labor contract, pay stubs, attendance records, transfer records, and chat logs, and visit the human resources and social security bureau or the arbitration commission 1 to 3 times. Arbitration has a 1-year deadline (the legal term is the arbitration limitation period). If you are still working at the unit and wages are being delayed, that 1-year limit does not apply. If you have already left, you must file within 1 year from the day you left. The hard part is the repeated trips and hunting for evidence piece by piece; it is easy to lose heart in the middle.

Benefit

The first step is to complain. Call 12333, or complain to labor inspection at the local human resources and social security bureau. By law the investigation finishes within 60 working days after filing; complex cases may be extended by another 30 working days. If confirmed, the company can be ordered to pay by a deadline. If it still does not pay after the deadline, it must add compensation of 50% to 100% of the amount due. In 2024, inspection agencies nationwide handled 137,000 cases and recovered 8.65 billion yuan (86.5 yi) in wages for 654,000 people. If you have an IOU or a wage sheet and the facts of the unpaid wages are clear, you may also apply directly to a grassroots court for a payment order. A payment order is a court order telling the company to pay; the court issues it within 15 days of accepting the case. The second step is to apply for arbitration. By law the case is closed within 45 days of acceptance, extendable by another 15 days. For unpaid wages you may apply for advance enforcement: part of the award can be enforced before the whole case is finished. If the amount owed does not exceed 12 times the local monthly minimum wage, it is final in one arbitration: after the award the company cannot sue again. In 2024, 4,257,000 cases were handled nationwide and 4,156,000 were closed. The closed amount was 93.47 billion yuan. The mediation success rate was 79.6%, the arbitration closure rate 98.2%, and the arbitration termination rate 73.7%. Some people say this takes “half a year to a year”; that refers to cases that go on to court after arbitration. Those cases take 6 months at first instance (3 months under the summary procedure), plus 3 months for a second instance. In 2024 courts closed 88,000 cases seeking labor remuneration and recovered 28.54 billion yuan; 998 people were sentenced for the crime of refusing to pay labor remuneration (nationwide)

Notes

Complaints and arbitration help, but distinguish “case closed” from “money received.” The 98.2% closure rate only means the procedure finished. If the company has no assets or the boss has fled, you may still get nothing after winning. The Supreme People’s Court only publishes the total amount enforced (2.3 trillion yuan in 2024) and that the “enforcement completion rate stayed high”; there is no official figure for how much of wage cases actually reached the workers’ pockets. The term “arbitration termination rate” is not defined in the bulletin; this item treats it as “no further court case after the award.” Unpaid wages at certain amounts are enough for a criminal case. One type is owing one person for 3 months or more, with an amount of 5,000 to 20,000 yuan or more. Another is owing 10 or more people, totaling 30,000 to 100,000 yuan or more. In either case, if payment is still refused after an order to pay, that is enough to open a case. Provincial high courts and procuratorates set the exact amount within that range and publish it; check your province before complaining, and raise it face to face when you complain. Migrant workers on construction sites also have dedicated wage accounts and a rule that the general contractor pays first; going after the general contractor works better than going after the labor boss. Both routes assume there is an employing unit. An unlicensed workshop or shop still counts; you can complain and arbitrate. Private work for a household or individual, such as being a nanny, is not a labor relationship — go to court; see item 22 (first figure out who hired you). Rural migrant workers applying for legal aid to recover wages are not checked for financial hardship. The original text of the Labor Contract Law (劳动合同法) and the Civil Procedure Law (民事诉讼法) is cited from republications by the State Taxation Administration and the Guizhou provincial market regulation bureau (both gov.cn), because the NPC site pages would not open. The Criminal Law Amendment (VIII) (刑法修正案(八)) failed to fetch from the NPC site and was checked by opening it with curl

7.3 If you cannot afford a lawsuit, apply for legal aid; cases such as unpaid wages, support for elderly parents (赡养费), and work injury are already covered

  • Money No cost
  • Time Minutes
  • Willpower None
  • Benefit Big
  • Measured in Money
Value: Very highEvidence A
In plain terms

Anyone seeking unpaid wages, support for elderly parents, social insurance benefits, dibao payments, or redress for losses from an act of bravery can apply for free legal assistance. Simply call 12348 or visit your local legal aid center. You no longer need to obtain proof of financial hardship from your hometown — just describe your situation honestly. For defendants who may face the death penalty, or those who are blind, deaf, mute, or minors, a lawyer is assigned regardless of their financial status.

Cost

No cost at all. Legal aid does not charge the person it helps a single cent.

Benefit

A State Council regulation states that civil legal aid covers six kinds of matters: claims for state compensation; requests for social insurance or dibao benefits; applications for survivor benefits or relief funds; demands for support for elderly parents, child support, or spousal maintenance; wage recovery claims; and civil claims arising from acts of bravery. In criminal cases, defendants who may face capital punishment or those who are blind, deaf, mute, or minors are guaranteed legal representation irrespective of their financial circumstances.

Notes

The Legal Aid Law took effect on 1 January 2022, introducing one key change: applicants no longer need to submit official proof of financial hardship. A truthful statement of one’s own financial situation now suffices, with no need to go back to one’s hometown for a certificate. Legal aid can be accessed via local legal aid centers, public legal service hubs, or by calling 12348.

7.4 When you have nowhere else to turn, go to a relief shelter; it provides food, lodging, and a ticket home

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Medium
  • Measured in Money
Value: OrdinaryEvidence A
In plain terms

Shelters cover meals and lodging, send you to a hospital if you fall ill, help you contact family, and issue a ticket home if you cannot afford one. Stays generally do not exceed 10 days. Coming and leaving are voluntary — this is not detention, and no cash is handed out. Tickets are issued for the hukou place or the place of residence, so decide where you want to go before you arrive.

Cost

There is no cost. You can go to the local relief shelter on your own, or tell police or civil affairs officials and have them take you there. Upon arrival, you must truthfully provide your name and list any personal belongings. The hard part is simply admitting that you have no money and nowhere to stay.

Benefit

Shelters supply food and lodging that meet basic hygiene standards. Should you suffer a medical emergency while there, they send you to hospital for treatment. They also assist in reaching out to relatives or employers. For those unable to pay for travel back to their registered home or current residence, a travel voucher for a vehicle or boat – that is, a ticket – is provided. “Household registration” refers to your hometown, while “current residence” is wherever you currently live. Generally, stays are capped at 10 days; stays may be extended for people waiting for family to collect them, waiting for treatment, or waiting for placement. Police and other government officials encountering homeless individuals in the course of their duties must inform them of this assistance option. Special care is given to disabled persons, minors, the elderly, and anyone with mobility issues – they are guided and escorted to shelters (nationwide, since 2003).

Notes

Entry and departure are entirely voluntary; this is not a detention facility. Basic food and lodging are provided, but no cash is given. Transport vouchers are issued based on household registration or current residence – be sure to decide where you wish to go before seeking help. For shelter arrangements at night or during winter, see item 21 (when there truly is nowhere else to sleep).

7.5 To find work, first use free public employment services and gig-work markets (零工市场), not fee-charging agents

  • Money No cost
  • Time Minutes
  • Willpower None
  • Benefit Medium
  • Measured in Money
Value: HighEvidence A
In plain terms

Public agencies like employment service centers and human resources markets provide job referrals, career guidance, policy advice, and both employment and unemployment registration — all completely free of charge. The law also explicitly forbids them from making money from these services. Registration and posting information at gig-work markets is likewise free. It’s a good idea to complete your unemployment registration at the same time, since it’s required to receive unemployment benefits and qualify for assistance as someone facing employment difficulties.

Cost

No cost at all. You can register at any public employment service agency at the county level or higher — such as employment service centers or human resources markets. You can also register at the local gig-work market. If you don’t know the exact location, call 12333 for help.

Benefit

The law guarantees that the following services must be provided at no cost: advice on employment policies; information about current job openings and labor shortages; career guidance and job matching; processing of both employment and unemployment registration; and targeted employment support for individuals facing employment difficulties. These agencies are prohibited from engaging in any commercial activities or profiting off these services. Registering and publishing job-seeking and hiring information for gig work is also offered to the public free of charge, as part of the broader public employment information system. Support is also to be stepped up for gig workers in hardship, such as those who have waited a long time for work (that is, who cannot get jobs for long periods) and those from low-income households (nationwide).

Notes

Unemployment registration is a prerequisite for receiving unemployment benefits and qualifying as someone facing employment difficulties — so it’s worth completing at the same time. For gig workers paid on a daily basis, always verify your earnings on the spot, and be sure to collect the employer’s contact details and a record of the work performed.

7.6 After a sudden setback, apply for temporary assistance first

  • Money No cost
  • Time Hours
  • Willpower None
  • Benefit Medium
  • Measured in Money
Value: OrdinaryEvidence B
In plain terms

When something sudden hits at home — a fire, a car crash, a family member’s sudden serious illness — and basic living is temporarily crushed, you can apply for temporary assistance at the township government or subdistrict office where it happened; you need not already be on dibao. This kind of urgent hardship is generally finished within 3 days, for at most 1 month of the local dibao standard. Other situations pay at most 6 months of the dibao standard.

Cost

No money spent. Apply to the township government or subdistrict office where the incident happened, and explain what happened at home — for example a fire, a traffic accident, a family member’s sudden major illness, or a sudden rise in daily expenses that cannot be skipped. Sudden urgent hardship uses “small-amount fast aid”: no means test, no public notice, generally finished within 3 days. Sudden rises in medical or schooling costs are approved after public notice. Prepare materials from the local checklist; usually 1 to 2 trips.

Benefit

Two kinds of households can receive temporary assistance. One is households that, because of accidents, a family member’s sudden major illness, or similar reasons, temporarily cannot cover the most basic costs such as food, lodging, and medical care. The other is dibao households whose unavoidable expenses suddenly rise beyond what they can bear. Which events are covered and how much is paid are set and published by local governments at county level or above (national system; amounts set locally; since 2014). The Social Assistance Law (社会救助法), in force from July 1, 2026, describes the targets as “persons whose basic living is temporarily in serious difficulty because of sudden, urgent, catastrophic, or similar hardship,” with cash or in-kind aid. Apply for temporary assistance at the township government or subdistrict office of the “place where the urgent hardship occurred.” When the situation is urgent and the amount is small, aid should be given first and paperwork completed afterward. A late-2025 document of the Ministry of Civil Affairs and the Ministry of Finance sets how to pay. Sudden setbacks, accidental injury, major illness, and similar urgent hardship use “small-amount fast aid”: household finances are not checked again, there is no public notice, processing generally takes no more than 3 days, and the top tier is no more than 1 month of the local dibao standard. Dibao-edge households and rigid-expenditure hardship households that fall into difficulty because medical or schooling costs suddenly rise are aided after public notice, in principle with “one approval, phased payment.” Temporary assistance outside small-amount fast aid has a top tier of no more than 6 times the local monthly dibao standard (nationwide, from 2026; concrete standards set locally)

Notes

You need not already be a dibao household. Concrete amounts differ a lot by place; follow what the locality publishes for the year. After the Social Assistance Law (社会救助法) took effect, the Interim Measures for Social Assistance (社会救助暂行办法) were not expressly repealed; as of October 2026 the national laws and regulations database still marks them as in force. Where the two texts disagree, follow the law.

7.7 If income is below the local dibao line, apply for dibao; if income is a bit above the line or medical and schooling costs are high, apply for medical, education, housing, and employment assistance

  • Money No cost
  • Time Hours
  • Willpower Some
  • Benefit Big
  • Measured in Money
Value: HighEvidence A
In plain terms

If household per-person income is below the local dibao line and assets also meet the rules, you can apply. At the end of 2024, the national urban dibao line averaged 798.1 yuan per person per month, and the rural line 593.9 yuan. Money is paid as the gap, or in fixed tiers. If income is a bit above the dibao line, or medical and schooling costs are too high, you may still apply for medical, schooling, and housing assistance even without dibao.

Cost

No money spent. Household members who live together submit a written application to the township government or subdistrict office of the hukou place. If that is hard to do yourself, you may ask the villagers’ committee or residents’ committee to apply on your behalf. You must accept checks of household income and assets. Usually 2 to 3 trips, with ID cards, hukou booklets, and proof of income and assets. The hard part is laying household finances open for inspection and waiting through public notice. If you do not qualify for dibao, applying for medical, housing, or employment assistance is also done at the hukou township government or subdistrict office. Education assistance is applied for at the school the child attends.

Benefit

Divide household income by the number of people; if that is below the local dibao standard and household assets are within the rules, you can receive dibao. At the end of 2024, the national average urban dibao standard was 798.1 yuan per person per month, and the rural standard 593.9 yuan per person per month. Urban dibao covered 6,250,000 people, rural 33615000. Dibao money is paid monthly as the gap: local dibao standard minus household per-person income. For example, if the local standard is 798.1 yuan and household income is 500 yuan per person per month, each person receives 298.1 yuan per month, not 798.1 yuan. The Social Assistance Law (社会救助法) in force from July 2026 also allows fixed-tier payments: dibao “may be paid as the actual gap by which household per-person income falls below the local minimum living standard, or in fixed tiers.” The dibao standard is set by taking local per-person consumption expenditure for the prior year, multiplying by a quantified ratio, and adjusting at intervals — in plain terms, last year’s average spending per person, discounted (national averages; localities differ). There are two further tiers for those who do not qualify for dibao. The first is dibao-edge households: assets meet the rules, and household per-person income is below 1.5 times the local dibao standard (2023 national document). From July 2026 the Social Assistance Law (社会救助法) leaves the uplift ratio above the dibao standard to the province. The second is rigid-expenditure hardship households. The condition is that household per-person income is below local prior-year per-person disposable income, and assets meet the rules. Unavoidable costs such as medical care and schooling must also exceed a local share of household income. Both tiers can receive medical assistance, education assistance, and housing assistance. Education assistance means fee reductions, grants and living subsidies, and student loans. Housing assistance in cities means priority public rental housing or rental subsidies. Unemployed people with work capacity in dibao-edge and rigid-expenditure hardship households can also receive employment assistance. Severely disabled persons and patients with serious illness in dibao-edge households may be brought into dibao individually and receive monthly dibao payments (nationwide, from 2023; ratios and recognition methods set locally)

Notes

Dibao is the last safety net; apply back at the hukou place. If household housing, cars, or savings exceed local standards, or children are able to support you, approval may fail. Once approved there are other benefits: help paying resident medical insurance (resident medical insurance, item 9), medical assistance when seeking care (medical assistance, item 10), and legal aid without a means test (legal aid, item 3).

7.8 With a disability certificate, apply for the two disability subsidies

  • Money No cost
  • Time Minutes
  • Willpower None
  • Benefit Medium
  • Measured in Money
Value: HighEvidence A
In plain terms

Disabled persons in dibao households can receive a living subsidy. Those rated disability level 1 or 2 who also need long-term care can receive a care subsidy; both can be received at the same time. Standards are set by each province and differ a lot — ask the subdistrict for the local figure. Bring a second-generation disability certificate and apply once at the subdistrict or township.

Cost

No money spent. Bring the disability certificate and submit one application at the subdistrict or township.

Benefit

The State Council set two subsidies. The first is the living subsidy for disabled persons in difficulty; the document’s targets are “disabled persons in dibao households; places with the means may gradually expand to low-income disabled persons and other disabled persons in difficulty.” That means dibao households’ disabled members first, with expansion where local finances allow. The second is the care subsidy for severely disabled persons; the document’s targets are “severely disabled persons rated disability level 1 or 2 who need long-term care.” Both can be received at the same time

Notes

Standards are set by provincial governments and differ a lot by place. Applications require a second-generation disability certificate. If you cannot apply yourself, a family member may apply on your behalf

7.9 Do not let the annual 400 yuan resident medical insurance lapse; hardship households can get reductions

  • Money Low
  • Time Minutes
  • Willpower None
  • Benefit Big
  • Measured in Money
Value: HighEvidence A
In plain terms

Individuals pay from 400 yuan a year; in 2025 finance adds no less than 700 yuan per person. Extremely poor persons get full funding; dibao recipients get a fixed subsidy. Lapsing has a cost: if you did not enroll in the concentrated window, or did not keep continuous payments, after you pay there are 3 months when medical care is not reimbursed, and each extra year interrupted adds another 1 month in principle.

Cost

The individual share is no less than 400 yuan per person per year. That is the national standard for 2024 and 2025; localities may set it higher. Pay during the fixed annual concentrated enrollment window. Extremely poor persons receive full funding — the government pays the whole amount. Dibao recipients receive a fixed subsidy — the government pays a set part.

Benefit

Besides the individual share, finance adds a further amount per person. In 2024 it was no less than 670 yuan. In 2025 it rose 30 yuan from the prior year to no less than 700 yuan; the individual contribution remains no less than 400 yuan (医保发〔2025〕22 号, as restated in provincial documents). The 2026 Government Work Report said it would rise another 24 yuan. For dibao recipients and extremely poor persons, qualifying medical costs still left after medical insurance reimbursement can be reimbursed again through medical assistance at a rate of no less than 70%. The cost of a lapse is a waiting period. If you did not enroll in the concentrated window, or did not keep continuous payments, after you pay there is a fixed 3-month benefit waiting period when medical care is not reimbursed. Each extra year interrupted adds another 1 month in principle (from 2025, nationwide)

Notes

The 2025 National Healthcare Security Administration notice (医保发〔2025〕22 号) is not posted publicly on the administration site or the Chinese government site. The figures 700 yuan and 400 yuan match documents from Hebei and Anhui; the Anhui document states it follows that notice. While you receive unemployment benefits, employee medical insurance is paid for you by unemployment insurance, so you need not enroll twice.

7.10 For serious illness, use medical insurance, critical-illness insurance, medical assistance, and cross-region registration first — do not touch online loans

  • Money No cost
  • Time Hours
  • Willpower Some
  • Benefit Big
  • Measured in Money
Value: HighEvidence A
In plain terms

The order is fixed: before cross-province hospitalization, register in the “National Healthcare Security Administration” official account; settle directly at discharge without advancing the full bill first. If after reimbursement you still cannot pay, apply for medical assistance at the township or subdistrict. If employed, you have a medical treatment period of 3 to 24 months by length of service; the company cannot dismiss you during that time. Do not touch online loans or high-interest private borrowing.

Cost

No money spent. The order is fixed; go step by step. First, before cross-province hospitalization, register through the “National Cross-Region Medical Care Filing” mini-program in the “National Healthcare Security Administration” WeChat official account. Second, settle directly at discharge. Third, if what you still owe after reimbursement is too heavy, apply for medical assistance at the township government or subdistrict office. Fourth, if still employed, take sick leave for the medical treatment period — the time you stop work for illness and cannot be dismissed; work injuries go through work-injury insurance. Fifth, if you cannot repay a credit card, proactively negotiate installment plans with the bank. Sixth, if that is still not enough, raise funds on a personal assistance platform designated by the Ministry of Civil Affairs. Main materials are the diagnosis certificate, itemized costs, and settlement sheet; 2 to 4 trips. The hard part is running procedures while you are ill.

Benefit

The state bundles basic medical insurance, critical-illness insurance, and medical assistance as the “triple system,” each layer catching what the one above leaves. For dibao recipients and extremely poor persons, qualifying medical costs are assisted at no less than 70%. Patients with serious illness who were not poor but became poor from treatment may apply for further assistance. If you registered before cross-province hospitalization, you can settle directly at discharge without advancing the full bill and returning to the insured place to claim. Stopping work for illness has a medical treatment period of 3 to 24 months, set by length of service. During that time the company may not end the labor contract, and sick-leave pay may not be below 80% of the local minimum wage. Injured workers have a work-stoppage with pay period — time off to recover — with original wages and benefits paid monthly by the employer, generally no more than 12 months. If credit-card debt exceeds repayment capacity but you are still willing to repay, you may negotiate a personalized installment plan with the bank for up to 5 years. Once the agreement is signed, the bank must stop collection. Personal assistance platforms that raise money online for someone must be designated by the civil affairs department under the State Council. Platforms must verify that the appeal is true. Donated money may only be paid to the person seeking help, or to an account they provide (nationwide)

Notes

How large a share medical assistance reimburses, and the yearly cap, are set by the place where you are insured. The medical treatment period has six tiers, based on total years worked and years at this employer. Once the medical treatment period ends, the company may lawfully end the contract — know which tier you are in early. People receiving emergency rescue are also on the list that needs registration. The medical insurance bureau page does not say whether emergencies count as automatic registration or can be made up afterward; call the insured place. Do not touch online loans or high-interest private borrowing. Courts only protect up to 4 times the one-year LPR (see item 15 on not borrowing usury). Amounts above that line are unprotected, but the principal is still owed. Lying in a hospital bed, you have no energy for that kind of lawsuit. Acute severe injury or illness is different: call 120 even without money; hospitals may not refuse, shift, or delay treatment. Emergency fees for that stretch are paid by the disease emergency assistance fund — see Section 24, item 8 (emergency care must treat first). The original page of (劳部发〔1995〕309号) would not open on the ministry site; content is from a provincial human resources and social security republication. How to negotiate credit-card installments with a bank when you cannot repay — see item 23 (already cannot repay credit cards or online loans).

7.11 Replace a lost ID card immediately; get a temporary one if you need it urgently

  • Money Low
  • Time Minutes
  • Willpower None
  • Benefit Small
  • Measured in Money
Value: OrdinaryEvidence A
In plain terms

For standard replacements, the new ID card is issued within 60 days of submitting the application. If you need it right away, you can also request a temporary ID card on the spot; it is issued within 3 days and is valid for 3 months. Without an ID card, you cannot apply for jobs, get lodging, open bank accounts, or claim benefits — it is a prerequisite for all such procedures.

Cost

There is a fee for issuing the ID card. This is a legally mandated charge set by the state; the exact amount is posted locally. Apply at the police station where your permanent hukou is registered — one trip.

Benefit

Once you submit the application form for a resident ID card, authorities must issue the card within 60 days. During this period, if you urgently need identification, you may apply for a temporary resident ID card, which is issued within 3 days of the application and is valid for 3 months (nationwide).

Notes

Without an ID card, it is impossible to secure employment, get lodging, open bank accounts, or receive benefits — it is a mandatory prerequisite for all such actions. The ID Card Law was amended in 2011; the text cited here is the version published in 2003, and current provisions apply. Whether applications can be submitted outside your home region depends on the local police notice.

7.12 After registering as unemployed, seek recognition as a person facing employment difficulties to receive social insurance subsidies or access to public welfare jobs

  • Money No cost
  • Time Hours
  • Willpower Some
  • Benefit Big
  • Measured in Money
Value: HighEvidence B
In plain terms

Once recognized, paying social insurance yourself qualifies for a subsidy, in principle no more than two-thirds of what you actually pay, for at most 3 years. If a unit hires you or you are placed in a public-welfare post, that unit’s share of social insurance is also subsidized. Subsidies for public-welfare posts refer to the local minimum wage; the pay is modest but includes social insurance, so they suit a transition. Social insurance subsidies are often paid after you contribute, so you must advance the money first.

Cost

There is no cost involved. You simply apply for recognition at a local public employment service center in your neighborhood or community. Eligibility criteria vary by region, but typically include being of advanced age, unemployed for a long time, a member of a dibao-receiving household, disabled, or part of a zero-employment household. First, you must complete unemployment registration before applying. The main difficulty lies in verifying whether you meet each individual criterion, and you must pay social insurance premiums upfront.

Benefit

After receiving this recognition, individuals who are not employed and pay their own social insurance premiums — known as flexible workers — become eligible for subsidies. These subsidies generally cover up to two-thirds of actual payments, for a maximum duration of three years. Employers hiring such individuals or placing them in public welfare jobs also receive subsidies covering their contributions toward pension, medical, and unemployment insurance. Public welfare jobs are positions created and funded by the government; their subsidy refers to the local minimum wage. Priority goes to people facing employment difficulties. Additionally, one-time job-seeking subsidies are available for recent college graduates from dibao-receiving households, zero-employment households, or extremely poor families; disabled graduates and those who have taken national student loans also qualify. These subsidies are collected during the academic year of graduation (national framework; specific eligibility criteria and amounts are determined locally).

Notes

Public welfare jobs do not pay high wages but include social insurance, so they suit a transition period. Most social insurance subsidies are paid after the fact, requiring upfront payment of premiums. For detailed eligibility requirements, contact 12333 or your local neighborhood office.

7.13 Apply for vocational training subsidies, employment internship subsidies, and social insurance subsidies during unemployment — don’t pay for training courses out of pocket

  • Money No cost
  • Time Hours
  • Willpower Some
  • Benefit Medium
  • Measured in Money
Value: OrdinaryEvidence A
In plain terms

Complete training and obtain the required certificate, and you get a vocational training subsidy — at most 3 times per person. College graduates who have not found work within two years of graduation, and unemployed youth aged 16 to 24, may join employment internships and receive a basic living allowance during the internship. First check the “vocational training subsidy directory” on the local human resources and social security bureau site; do not pay for a course yourself.

Cost

There is no direct cost. However, training takes up a lot of your time. The real challenge is completing all required classes and earning the necessary certificates before you can receive any subsidies.

Benefit

Regulations issued by the Ministry of Finance and the Ministry of Human Resources and Social Security outline several employment assistance programs funded specifically to support job seekers. Eligible individuals can receive vocational training subsidies up to three times per person after completing approved training and earning the required certificates. Those facing employment difficulties who pay for their own social insurance (flexible employment) can get subsidies for up to three years; this period extends until retirement for anyone within five years of reaching the statutory retirement age. Recent college graduates can receive similar social insurance subsidies for up to two years, while those hired by employers qualify for up to one year of support. Additionally, college graduates who have not found work within 2 years of graduation and unemployed youth aged 16–24 can join employment internships and receive basic living allowances during that period.

Notes

Exact subsidy amounts and eligible programs vary by province; always check the “Vocational Training Subsidy Directory” on your local Human Resources and Social Security Bureau website. Extra one-time job-seeking and entrepreneurship subsidies are available for college graduates in their graduation year from dibao families or zero-employment households, and for those graduates with outstanding student loans or with disabilities.

7.14 Job hunting isn’t just about sending resumes — use a systematic approach: learn skills, set goals, and ask for help

  • Money No cost
  • Time Hours
  • Willpower A lot
  • Benefit Big
  • Measured in Money
Value: OrdinaryEvidence A
In plain terms

People who have taken job-seeking coaching have 2.67 times the odds of finding work of those who have not. What works is these pieces: learn concrete job-seeking skills, explain yourself clearly, set clear goals, take the initiative, and ask others for help.

Cost

There’s no monetary cost. You’ll need to spend 1–2 hours each day for several weeks. You can skip paid courses and use free career guidance from public employment services instead. The real challenge is staying consistent day after day without anyone watching over you, and actually reaching out to ask for help.

Benefit

A combined analysis of 47 controlled job-hunting coaching studies, all of which used experimental or quasi-experimental designs with control groups, shows that the coached group had 2.67 times the odds of finding work of the group not coached (OR 2.67, a ratio of odds). The key components of effective coaching are: teaching job-hunting skills, improving self-presentation, boosting self-efficacy, encouraging proactive behavior, setting clear goals, and fostering social support through asking for help. Programs that combine skill training with motivation-building tactics deliver the best results.

Notes

Most of these studies were conducted in Europe and North America, and used structured group-based coaching programs. The findings here are extrapolations from those results, not data collected in China itself. Asking for social support means reaching out to acquaintances for introductions and referrals — so don’t hesitate to ask for their help.

7.15 No deposits, no ID retention, no “training loans”, no pyramid schemes, no usury

  • Money No cost
  • Time Minutes
  • Willpower Some
  • Benefit Big
  • Measured in Money
Value: HighEvidence A
In plain terms

Employers cannot keep your ID or demand a deposit, nor can they charge you under any other pretext. If a job placement agency fails to find you a job, it must refund the placement fee. “Training loans” that require upfront fees, as well as pyramid schemes that pay out based on recruitment, are all scams that officials have named. Any interest on a loan exceeding four times the one-year LPR is not legally enforceable by courts, though the principal amount must still be repaid.

Cost

Zero expense. If an employer or agency suggests “pay first, then get a job”, “train first, job assigned later”, or “recruit others to earn money”, refuse immediately. Keep all chat logs and proof of any payments. The difficulty lies in the fact that when money is scarce, people may be tempted to take risks — saying “no” on the spot is not easy.

Benefit

Employers are prohibited from withholding IDs and similar documents, from requiring you to find a guarantor, and from taking your money or goods under any other name. Violations result in mandatory refunds and fines ranging from 500 to 2,000 RMB per worker. Job placement agencies likewise cannot retain IDs or collect deposits; if they fail to place you, they must return all fees. Schemes that demand training fees or loans under the guise of employment are flagged by the Ministry of Human Resources and Social Security and four other departments as “recruit-to-train” and “training loan” scams. Schemes where commission depends on recruiting others and you must pay to join are pyramid schemes; participants face fines up to 2,000 RMB. The part of interest on private loans above four times the one-year LPR at the time the contract was signed is not supported by courts. This regulation replaced the previous tiered limits of 24% and 36% (nationwide, effective August 2020).

Notes

The four-times-LPR threshold represents the maximum legally protected interest rate; it does not mean the principal can be forgiven. This judicial interpretation was revised in December 2020, so current article numbers may differ from earlier versions. For guidance on converting installment and online loan fees into annualized rates, see Section 5, item 7. Financial desperation makes individuals especially vulnerable to these schemes; instead, rely on legitimate resources such as unemployment benefits, labor inspection complaints, legal aid, shelters, or temporary assistance outlined earlier in this section.

To qualify, you must meet three criteria simultaneously: you must have no property in the area, or your living space must fall below the required standard; your income and assets must also be below the set limits; and migrant workers must have maintained stable employment in the area for a specified period. The exact waiting queue period is announced locally. While this option cannot provide immediate relief, signing up costs nothing, and the earlier you sign up, the sooner your turn comes.

Cost

There is no fee to apply. You must submit documents to the local housing authority and provide written consent for them to verify the information you provide. If any documents are missing, they will tell you everything that needs to be added in one go. The waiting period for housing assignment is known as the “waiting queue period,” which generally does not exceed 5 years.

Benefit

Meeting all three conditions qualifies you to apply. First, you must have no property locally, or your living area must be smaller than the required minimum. Second, your income and assets must stay below the prescribed limits. Third, migrant workers must have held steady employment in the area for the mandated duration. Specific eligibility criteria are determined and released by housing authorities in municipalities and counties. Those who register for the queue are referred to as “waiting queue candidates,” and housing authorities are required to assign them a unit within the waiting queue period. (National framework; local areas set individual thresholds and rental rates; implemented since 2012.)

Notes

While this option cannot provide immediate relief, signing up costs nothing, and the earlier you sign up, the sooner your turn comes. Various other forms of subsidized housing exist locally, each with its own rules; please consult your local housing authority’s website for details.

7.17 Keep food and housing costs as low as possible: opt for monthly shared housing instead of daily rentals, and cook at home or use senior meal services rather than ordering takeout

  • Money No cost
  • Time Hours
  • Willpower Some
  • Benefit Big
  • Measured in Money
Value: HighEvidence B
In plain terms

In 2025, food accounted for 29.3% and housing for 21.7% of average national per-capita spending — together they make up over half of all expenses. Therefore, cutting costs in these two areas yields the biggest savings. Based on the author’s experience, daily rentals and hourly rooms end up costing more per month than shared housing; cooking at home is also cheaper than ordering takeout. When job hunting, ask whether housing and meals are provided — such offers effectively eliminate both major expense categories.

Cost

Finding a place to live takes 1–3 days. The security deposit is usually equal to one month’s rent (a rough estimate by the author). Cooking at home requires 30–60 minutes each day. The real challenge is staying disciplined enough to cook daily rather than ordering takeout.

Benefit

In 2025, the average national per-capita annual expenditure was 29,476 yuan. Of that amount, 8,631 yuan went toward food, tobacco, and alcohol, representing 29.3%. Housing costs totaled 6,397 yuan, or 21.7%. Together they constitute more than half of total spending, so cutting these two is most effective. Senior meal services are now available to all older adults; they include senior cafeterias, dining tables, and meal assistance points, with additional subsidies for those in need. For context, as of 1 January 2026, the lowest first-tier monthly minimum wage across all provinces was 2,080 yuan in Qinghai, while the highest was 2,740 yuan in Shanghai (national figures for 2025–2026).

Notes

Monthly costs for daily rentals and hourly rooms are considerably higher than those of shared housing; this is based on practical experience rather than official statistics. Rules regarding access to senior meal points for non-seniors and their pricing vary by region. When seeking employment, be sure to ask whether housing and meals are included — such arrangements can completely eliminate these two major expense categories. 7.18 Do not panic if social insurance contributions are interrupted: pension is cumulative; medical insurance is made up by the rules

  • Money No cost
  • Time Minutes
  • Willpower None
  • Benefit Big
  • Measured in Money
Value: Very highEvidence A
In plain terms

Pension is counted by cumulative years, not continuous years; an interruption does not clear the count. At retirement age, a cumulative full 15 years is enough for monthly payments. For employee medical insurance, once the required years are met you need not pay after retirement; the years differ by place. What a lapse affects are two things: after resident medical insurance is restarted there is a stretch when care is not reimbursed, and local home purchase, hukou, and points schemes often require continuous contributions.

Cost

No money spent. Resident pension and resident medical insurance can be paid yearly on your own. If employee social insurance is interrupted, there is no need to pay someone to park you on a fake payroll just to avoid a gap.

Benefit

Basic old-age insurance is counted by cumulative contribution years; interruptions in the middle do not clear the count. At statutory retirement age, a cumulative full 15 years is enough for monthly pension. If short, you may keep contributing until 15 years are met. When you take a job in another place (formally, across pooling areas), the pension relationship follows you and contribution years keep accumulating. Once employee medical insurance cumulative contributions reach the years set by the state, you need not pay after retirement. The cost of a resident medical insurance lapse is a waiting period: after you restart, there is a stretch when care is not reimbursed (resident medical insurance, item 9) (nationwide)

Notes

The years after which employee medical insurance needs no further payment in retirement are written in law as “years prescribed by the state”; local figures differ, and men and women often differ too. Call 12393 or ask the medical insurance bureau where you are insured. Lapses mainly affect local eligibility that requires continuous months of payment — home purchase, hukou, points — each set locally; check locally. Paying someone to park you on a fake payroll and contribute on your behalf can lose the money and carry legal risk; it is not advised. How to transfer pension and medical relationships when changing cities, and not to withdraw coverage — see Section 19, item 19 (transfer pension and medical relationships to the new insured place). From 2030 the 15-year line rises by 6 months each year toward 20 years; how to count the cost of paying yourself is in Section 5, item 46 (paying employee old-age insurance yourself).

7.19 After prison, bankruptcy, or a dishonest-debtor list, the law still has a path to start over — finish the procedures first

  • Money No cost
  • Time Hours
  • Willpower A lot
  • Benefit Medium
  • Measured in Money
Value: OrdinaryEvidence A
In plain terms

People released after serving a sentence must not be discriminated against in employment, schooling, or social insurance; those in living difficulty are helped into placement by the government. If the crime was committed under age 18 and the sentence was 5 years or less, the record is sealed; you need not report it when joining the military or seeking work. The dishonest list lasts 2 years; once the money is repaid the court should remove the name within 3 working days. Adult criminal records are not sealed; you must report them truthfully when joining the military or seeking work.

Cost

No handling fee. After release from prison, report to the judicial office or subdistrict of the hukou or residence place and apply for resettlement and help (government placement and support). If you are on the list of dishonest persons subject to enforcement, repay what is owed, then apply to the enforcing court to have the name removed. Individuals insured in Shenzhen for a full 3 years may apply for personal bankruptcy. Each step needs materials and interviews, plus a 1-to-3-year observation period. The hard part is telling the past over and over, and lasting through the observation period.

Benefit

Persons released after serving a sentence enjoy equal rights with other citizens by law and must not be discriminated against in employment, schooling, or social security. Those in living difficulty are helped into placement and given lawful assistance by the government of the hukou or residence place (Prison Law (监狱法) revised in 2026, in force from November 1, 2026). A 2010 central document requires stronger vocational training for them, inclusion in dibao when eligible, and transitional placement bases. If the crime was committed under age 18 and the sentence was 5 years or less, the criminal record is sealed; you need not report it when joining the military or seeking work; if you apply for a certificate of no criminal record, it is issued within 3 working days. The dishonest list lasts 2 years. Once the money is repaid, or in situations such as settlement with the other side, the court should remove the name within 3 working days. The Shenzhen Special Economic Zone Personal Bankruptcy Regulations are currently the only personal bankruptcy rules; after bankruptcy is declared and a full 3-year observation period is completed, unpaid debts may be discharged. Enterprise legal persons that cannot pay due debts and owe more than they have (insolvency) may apply for reorganization, settlement, or bankruptcy liquidation. After the bankruptcy procedure ends, the enterprise goes through deregistration. But people who guaranteed for the enterprise and other joint debtors “continue to bear repayment liability by law” for what remains unpaid. If the boss personally signed a guarantee for the company, that person still must repay. Adult prior records are not sealed: Article 100 of the Criminal Law (刑法) says that a person who has lawfully received a criminal penalty must report it truthfully when joining the military or seeking employment and must not conceal it (nationwide; personal bankruptcy only in Shenzhen)

Notes

Adult criminal records are not sealed. Article 100 of the Criminal Law (刑法) requires truthful reporting of a criminal penalty when joining the military or seeking work. Civil servants, judges, lawyers, teachers, and similar posts, and political vetting, have separate statutory limits; the non-discrimination rule above does not change that. Before November 1, 2026, the current Prison Law (监狱法) text corresponds to Articles 37 and 38; article numbers follow the text in force. (中办发〔2010〕5号) was not found as an original page on the central government site; the citation is from a district government republication. During the personal bankruptcy observation period you may not fly first class, engage in high consumption, or buy housing. Eight classes of debt, including compensation for intentional harm to another’s person, are not discharged. A discharge obtained by fraud may still be revoked.

7.20 Before a serious illness, add a one-year medical or critical illness insurance plan on top of basic medical insurance, and look carefully for the phrase “guaranteed renewal.”

  • Money Low
  • Time Minutes
  • Willpower None
  • Benefit Big
  • Measured in Money
Value: HighEvidence B
In plain terms

This kind of insurance covers the part you still pay after medical insurance reimbursement, plus losses from stopping work. Before buying, look for the words “guaranteed renewal”: without them, next year the product may be withdrawn or the price raised. Health status must be disclosed truthfully; concealment can lead to a denied claim. Pay basic medical insurance first, then consider this item.

Cost

For young people, a one-year expense-reimbursement medical plan costs only a few hundred yuan per year. This type of plan reimburses you based on actual medical expenses incurred. A critical illness policy, on the other hand, typically starts at several thousand yuan annually (these figures are rough estimates by the author; no official statistics are available). Purchasing such policies requires you to honestly disclose your health status — a process that takes about half an hour.

Benefit

Regulatory authorities classify such products into two main categories. Medical insurance reimburses you for actual medical expenses incurred, while critical illness insurance pays a predetermined lump sum upon diagnosis of specified illnesses. Both types are designed to cover out-of-pocket costs and lost earnings after basic medical insurance has been applied. Plans with a term of one year or less and no guaranteed renewal clause fall under short-term health insurance. Those with terms exceeding one year or that do include guaranteed renewal provisions are classified as long-term health insurance. “Guaranteed renewal” means that at the end of the term, the insurer must renew the policy under the original terms and at the agreed premium rate. Insurers are prohibited from encouraging the same individual to purchase multiple expense-reimbursement medical plans with overlapping coverage. Even if you buy two such plans, you can only receive reimbursement for the same expense once. The definitions of critical illnesses are standardized across the industry, covering 28 severe conditions and three milder ones. Malignant tumors, acute myocardial infarction, and sequelae of stroke are among the core conditions covered nationwide since 2019–2020.

Notes

This product is rated B because regulatory authorities provide only definitions and rules, without any concrete figures indicating how much money one can save by purchasing it. “Million-yuan medical insurance” (百万医疗险) is a marketing term; legally, it is considered short-term health insurance. Plans lacking a “guaranteed renewal” clause may be withdrawn or have their premiums increased the following year — so always verify this phrase in the policy wording. You cannot claim reimbursement twice for the same expense under two separate medical plans; avoid buying multiple such policies. Individuals with pre-existing conditions who fail to disclose them honestly risk having their claims denied. Truthful disclosure has a two-year limit: once the contract has run a full two years, the insurer can no longer rescind it because you did not disclose truthfully, and it must pay if something happens. If deliberate nondisclosure is found within two years, events before the contract is rescinded are not paid, and the premiums are not refunded. For guidance on which types of losses are worth insuring against, see Section 5, item 39 (“Losses you cannot afford to bear”). First, make sure you’re enrolled in basic resident medical insurance (see Item 9) before considering this option. The standardized definitions of critical illnesses were issued by industry associations under the guidance of the China Banking and Insurance Regulatory Commission, rather than by government decree.

7.21 When there’s nowhere else to sleep, 24-hour venues can only serve as a temporary overnight refuge; shelters should be the first choice

  • Money Low
  • Time Minutes
  • Willpower Some
  • Benefit Small
  • Measured in Money
Value: OrdinaryEvidence B
In plain terms

Airports and train stations can provide a place to spend the night — they have restrooms and power outlets — but no official data confirms they’re safe. Shelters employ staff around the clock; anyone arriving at night receives immediate assistance. In winter, some regions even open temporary cold-weather shelters. Those unwilling to enter a shelter still get food and warm clothing from patrol staff.

Cost

Waiting areas at airports and train stations are usually free. Fast-food restaurants and internet cafés require some spending. Sleep is often restless, and there’s a risk of theft. The real difficulty is that you do not dare truly sleep all night.

Benefit

24-hour venues allow a person to survive the night with access to restrooms and charging points, though no official figures exist on their safety. At the shelters, the Ministry of Civil Affairs requires helplines to stay open all day, with 24-hour duty staff. People in difficulty who come for help are aided first, under the policy. People who cannot find work, victims of theft or robbery, or those suddenly left without income can get emergency transitional living support. Places with the means open community service centers and similar sites as temporary shelters. In winter, people in difficulty are also guided to shelters or temporary cold-weather sites. For those unwilling to enter a shelter, patrol staff give food, clothing, and warm items, and leave a way to ask for help. Patrols increase during nighttime, cold spells, rain, snow, or ice; key locations include train stations, docks, underpasses, bridges and culverts, and active construction sites (since 2013, Civil Affairs Bureaus nationwide run annual winter outreach programs).

Notes

Safety risks are real. Keep valuables close, avoid accepting drinks or food from strangers, and steer clear of isolated corners. Never sleep under bridges, along rivers, or at construction sites at night. Sleeping outdoors in extreme weather can be fatal. Details on meals, lodging, and travel vouchers at shelters are covered in item 4 (“Turning to a shelter when all else fails”). Shelters only assist individuals unable to secure basic needs on their own and lacking supportive relatives or friends. Applicants must give honest information; those who refuse to cooperate receive no aid. The Ministry of Civil Affairs requirement referenced here dates to winter 2022; yearly updates apply locally. Some venues conduct midnight clear-outs — avoid confrontations with security personnel.

7.22 When wages are owed, first figure out who hired you: unlicensed workshops and labor bosses still go to labor inspection; only private work for a household or individual goes to court

  • Money No cost
  • Time Minutes
  • Willpower None
  • Benefit Medium
  • Measured in Money
Value: HighEvidence A
In plain terms

Unlicensed workshops and shops that owe wages can still be complained to labor inspection and taken to labor arbitration; the boss personally can also be pursued. If a labor boss who subcontracted site work owes money, the general contractor or construction entity pays. Only private work for a household or individual — such as being a nanny — is not a labor dispute and must be sued in court.

Cost

No money spent. First clarify three things: whether the other side is running a shop, factory, or business; whether the work was subcontracted from a company or construction site; and whether you work inside someone’s home. Whether the other side has a license can be checked on the national enterprise credit information publicity system.

Benefit

Article 2 of the Labor Contract Law defines employing units as enterprises, individual economic organizations, private non-enterprise units, and similar organizations; a single natural person does not count. Supreme People’s Court labor-dispute interpretations list several disputes that are not labor disputes. First, disputes between a household or individual and a domestic worker. Second, disputes between an individual craftsman and helpers or apprentices. Third, disputes between a rural contracting household and hired persons. Those go to court as ordinary civil disputes, with a 3-year limitation period. Unlicensed employing units are not in that exception. Article 93 of the Labor Contract Law covers units without lawful operating qualifications. For work already done, the unit or its investors must pay wages, economic compensation, and damages. Investors are the people who put money into the unit. Article 29 of that interpretation covers three kinds of units: those without a business license, those whose license was revoked, and those still operating after the license term ended. In a dispute with such a unit, name the unit or its investors as parties. Article 33 of the Labor Security Supervision Regulations says that if there is no business license, or the license has been revoked, but people are still being hired to work, human resources and social security departments still carry out labor security supervision. When personal contracting illegally hires people and harms workers, the organization that contracted out the work and the contracting individual bear joint and several liability for damages (Labor Contract Law, Article 94). Construction entities or construction general contractors sometimes contract or subcontract projects to individuals or units without lawful operating qualifications. When that causes unpaid migrant wages, the construction entity or construction general contractor pays (Regulations on Guaranteeing Payment of Migrant Workers’ Wages Article 36) (nationwide)

Notes

Judge in this order. First see whether the work was passed down from a company or site; if so, go after the contracting company or general contractor. Dedicated wage accounts on sites and general-contractor first payment — see item 2 (when wages are owed, complain to labor inspection first). Next see whether the other side is in business: shops, factories, workshops — licensed or not — go through inspection and arbitration, and name the boss personally in arbitration. Only leftover private work for a household or individual goes to court. Court means you sue and prove yourself; ordinary first-instance procedure is to be finished within 6 months by rule, and can be extended. Lawyer fees are not among the litigation costs the court orders the loser to bear; you pay your own lawyer, or apply for legal aid if you cannot afford it — see item 3 (legal aid). With an IOU you may first apply for a payment order — see item 2 (payment order). Small amounts may use small-claims procedure — see Section 8, item 22 (cheated in second-hand deals; small claims). The limitation period is 3 years — see Section 8, item 19 (rights have deadlines). No route guarantees money in hand; if the other side has no assets, you may win and still get nothing.

7.23 When you already cannot repay credit cards or online loans, call the bank or platform customer service yourself to apply for a personalized installment or deferral; do not borrow new to pay old, and do not pay intermediaries for “interest freeze,” “credit-report repair,” or “anti-collection”

  • Money No cost
  • Time Hours
  • Willpower Some
  • Benefit Medium
  • Measured in Money
Value: OrdinaryEvidence B
In plain terms

If you cannot repay a credit card but are still willing to, you can negotiate a personalized installment with the bank for up to 5 years; once the agreement is signed the bank must stop collection. But the bank may refuse, and overdue records already on the credit report stay. Intermediaries who charge to “freeze interest” or “clean the credit report” have been specifically flagged by regulators — do not use them.

Cost

No money spent. Call the official customer service number printed on the card back or published in the App, say clearly that you cannot repay but are willing to. Have proof of income, unemployment, or illness ready; often you must call several times. Once agreed, repay monthly under the new plan; you cannot open new credit cards until it is paid off. The hard part is answering the bank’s calls and explaining your hardship over and over.

Benefit

For credit cards there are express rules. When debt exceeds your repayment capacity and you are still willing to repay, the bank “may” negotiate equally with you and sign a personalized installment repayment agreement. The agreement lasts at most 5 years. It must state how much is owed, how much each installment is, and whether annual fees and interest are charged during repayment. Once both sides sign, the bank and collection agencies it engages must stop collection. If you do not repay per the agreement, that limit does not apply. If the deal is only oral, the bank must keep a recording at least until the debt is paid off. Debt already under installment cannot be installmented again; personalized installment is the only exception (2022 regulatory notice). When the People’s Bank of China repealed the old bank-card rules in 2025, it stated that credit cards continue under these rules. Online loans have no unified personalized-installment rule; whether deferral or installment is possible depends on the contract and the lender. When the lender is a consumer finance company, rules forbid collection by violence, threats, intimidation, or harassment. Banks and consumer finance companies may not collect from people unrelated to the debt. On paid intermediaries, five departments including the financial regulator issued a joint risk alert in 2026. It says claims such as “loans/credit cards need not be repaid,” “debt negotiation,” “debt swap,” and “credit-report whitewash” are false. Such “agency rights defense” charges high service fees; if you try to quit mid-way you may be sued for breach. They collect your bank cards, phone SIMs, home address, and children’s schools. Providing false materials as they teach, maliciously fleeing debt, or pressing with complaints may, in serious cases, involve crime. The Beijing banking and insurance regulator in 2022 also named ads for “interest freeze,” “stop collection,” and “full interest waiver.” It said that listening to such people, delaying repayment, and not contacting the bank can leave overdue bad records on the credit report. The National Development and Reform Commission ran a 2022 special campaign on “credit-report repair.” The notice says these people blur credit-report objections and credit repair, and defraud under names such as “credit-report repair, whitewash, wipe the slate.” Bad information on a credit report is kept for 5 years from the day the bad act or event ends, then deleted. During the retention period you may add a statement to that record, and the credit-reporting institution must record it (nationwide)

Notes

Personalized installment says the bank “may” negotiate, not that it must agree; the bank may refuse. If talks fail, the bank may sue you for repayment. Ordinary first-instance procedure is to be finished within 6 months by rule, and can be extended; summary procedure is 3 months. Lawyer fees are yours to pay; they are not among litigation costs the court orders the loser to bear. If you still cannot pay after a judgment, enforcement follows — see Section 8, item 20 (sued and under enforcement). Being listed as dishonest — see Section 8, item 21 (listed as dishonest). Simply being unable to repay is not a crime. The judicial interpretation of the Supreme People’s Court and Supreme People’s Procuratorate says you cannot be treated as intending to keep the money just because you missed a payment. Fleeing after overdrawing, changing contact details to dodge collection, or transferring assets may be treated as malicious overdraft. Malicious overdraft is pursued as credit-card fraud; unpaid principal of 50,000 yuan or more counts as a relatively large amount. So take the bank’s calls, and tell the bank when you change number or address. Borrowing new to pay old only rolls interest higher; before any loan, look at the annualized rate — see Section 5, item 7 (convert interest to an annualized rate). High-interest private borrowing — see item 15 (do not borrow usury). If collectors call family or colleagues, or insult or threaten you, complain to the lender first. If the bank does not resolve it, call the free 12378 bank and insurance consumer complaint hotline. Threats to personal safety go to 110. For errors on the credit report, free inquiry and objections — see Section 8, item 9 (free credit-report inquiry). If serious illness leaves you unable to repay, also see item 10 (serious illness: medical insurance and medical assistance first). “Agency surrender of insurance” is the same kind of scheme — see Section 5, item 43 (do not use agency surrender). The main beneficiary is you yourself.
